Appeal of Rejection of Protest
ERBES RD. FENCE REPLACEMENT (CI 5435)

Dear Mr. Finley,
Thank you for your response to our Bid Protest of July 30, 2024 regarding the Erbes Rd. Fence Replacement (Cl 5435). We appreciate your review and rejection of the protest filing.
However, your attention is directed to the matter outlined in Paragraph A: "No bid will be accepted nor any contract entered into without proof of the bidder's and subcontractor' current registration with the Department of Industrial Relations."
Although within three working days of bid opening to the City of Thousand Oaks bidder provided proof of a valid DIR number, the submission of said proof should be again reviewed for clarification of the June 30, 2024 deadline for filing the renewal process including the payment of renewal fee, and the payment of late filing renewal fee if paid subsequently. Specifically, such investigation by the City of Thousand Oaks should verify exactly what date the DIR registration renewal of was actually received by the Department of Industrial Relations.
DPW: 850-20levlCouncil\2024\08272024\CI 5435\Roadway Fence Replacement Project Att 4.pdf From the Department of Industrial Relations website on July 17, 2024 is a printout taken by our offices, wherein the Contractor certify date is 2022-06-15, and the Contractor cation exp date is 2024-06-30 (Contractor certification date) is set forth, for which such posted expiration date is, therefore, such posting indicates bidder did not have a valid and current registration with the Department of Industrial Relations sixteen days prior to the Bid Date of July 17, 2024 Further, from the Department of Industrial Relations website on July 22, 2024 is a printout taken by our offices, wherein the Contractor c ation eff date is 2024-07-22 (Contactor certification date) is set forth.
Therefore, we believe it is incumbent upon the City of Thousand Oaks to diligently investigate the records of the Department of Industrial Relations to independently verify the time of renewal of the certification, and should bidder be found to be technically uncertified as indicated above and herewith, the protest should be deemed upheld and the Erbes Road. Fence Replacement (CI 5435) award be duly made to Guy Construction. Thank you for your review and consideration.
