TO:Andrew P. Powers, City Manager
FROM:Laura B. Maguire, City Clerk
DATE:November 19, 2024
SUBJECT: Conflict of Interest Resolution Update
RECOMMENDATION:

1. Adopt resolution updating designated employees, officers, and disclosure category list for Conflict of Interest.

2. Find that the action of adopting the resolution is not a project under the California Environmental Quality Act.

LEVINE ACT ITEM: No
FINANCIAL IMPACT:

No Additional Funding Requested. Minimal staff time required to coordinate research efforts and prepare the report and resolution is included in the Adopted FY 2024-25 General Fund Budget.

BACKGROUND:

The Political Reform Act and Fair Political Practices Commission (FPPC) Code of Regulations require all local agencies to conduct a Biennial Review of their Conflict of Interest Codes. The City Clerk Department conducted the 2024 Conflict of Interest Biennial Review of the municipal code and Designated Filer Resolution in September and October. The resolution determines which employees, committee members, and consultants make or participate in making decisions which may have a foreseeable material effect on any financial interest. The resolution also identifies the appropriate disclosure categories under the Conflict of Interest Code.

Designated positions must file Assuming, Annual, and Leaving Office Statements per the Political Reform Act.

DISCUSSION/ANALYSIS:

The Filing Official for the City must ensure that the City’s Conflict of Interest Code is accurate by completing these steps: 1) review organizational charts to ensure all “similar” level positions are reporting; 2) review disclosure categories to ensure

9 “similar” positions have the same reporting categories; 3) ensure reporting categories are tailored to positions; 4) ensure reporting of real property interest applies to all positions where an individual decision can affect real property; and 5) add any new positions and changes to titles due to reclassifications.

The City Clerk Department conducted the required 2024 Biennial Conflict of Interest Review, as requested by FPPC, and completed all recommended FPPC steps. The review revealed the following changes in the list of Designated Employees were needed to match new position titles:

9 The Conflict of Interest Resolution (Attachment #1) has been updated to include the revised departments, positions, and titles.

Consistent monitoring of positions and updating the Conflict of Interest Designated Filers Resolution complies with the Political Reform Act.
