LAFCo is a public agency that regulates local government boundaries and agencies in California. LAFCo requires the City and any property owner outside the City limits that wishes to use City utility services to obtain an OASA. Obtaining an OASA from LAFCo requires the property owner to sign an agreement requiring them not to protest an annexation to the City if requested in the future (Attachment #2). The property owner is also required to pay a fee to LAFCo and to reimburse the City for the cost of processing the application.
The property owners at 729 Calle Laredo (APN of 663-0-111-085) are pursuing approval from the County of Ventura to build a new detached ADU in the unincorporated Lynn Ranch area. The owners wish to connect a separate new sewer lateral to the City wastewater main. The property lies outside the City boundary but within the City’s wastewater service area. LAFCo does not recognize the City’s entire wastewater service area facilities and boundary received by the City from Ventura Regional Sanitation District on June 18, 1987 (City Contract No. 87-30). Therefore, a property located in the County unincorporated area must go through the LAFCo process. A LAFCo application has been prepared (Attachment #3). The City owns and maintains wastewater mainlines that are currently serving the surrounding area near the property and are able to serve the proposed ADU.
DISCUSSION/ANALYSIS:
The owners of the property at 729 Calle Laredo (APN 663-0-111-085) have requested an additional wastewater service from the City to serve the new ADU.
The attached OASA application has been prepared by staff in conformance with LAFCo requirements. Water service in this area is provided by California American Water Service Company (Cal-Am) and the owners are coordinating with Cal-Am for a potable water connection.
LAFCo requires, before providing services to a customer outside of its boundary, that the City must enter into an OASA with the customer and file an application with LAFCo (Attachment #3). The OASA stipulates that:
•The proposed improvements shall be served by a 4-inch wastewater lateral, to be connected by the applicant to the City’s existing wastewater main; •The owners of the property also agree not to protest future annexation proceedings if initiated by the City.
The attached documents fulfill LAFCo’s requirements and include the application for wastewater services. Staff recommends approval by City Council. .
