TO:Andrew P. Powers, City Manager
FROM:Clifford G. Finley, Public Works Director
DATE:April 8, 2025
SUBJECT: Intent to Vacate Water Easements at Timber School Site Located at 1872 Newbury Road
RECOMMENDATION:

1. Adopt resolution declaring the City’s intention to summarily vacate waterline easements at the Timber School property, 1872 Newbury Road, and setting the date for a public hearing, and authorize the City Engineer to execute all necessary documents.

2. Find that this action is exempt from the California Environmental Quality Act under the general rule exemption pursuant to California Code of Regulations § 15061(b)(3).

LEVINE ACT ITEM: Yes
FINANCIAL IMPACT:

No Additional Funding Requested. Minimal staff time required to prepare and process the resolution and related documentation is included in the Adopted FY 2024-25 Water Fund Budget.

BACKGROUND:

In April 1982, Easement No. 046531 was recorded for a waterline dedicated to the City per Grant Deed No. 085024 located at, what was at that time, the Conejo Valley Unified School District’s Timber School site at the southeast corner of Newbury Road and Kelley Road (Attachments #1, #2, and #3). The waterline extended into the site to serve two onsite fire hydrants among the school shop buildings. The easement encompassed the waterline, fire hydrants, and meters.

In November 2021, the City entered into a Development Agreement (DAGR-2020- 70273) with Daylight T.O., LLC to redevelop the Timber School site at 1872 Newbury Road. Pursuant to DAGR-2020-70273 Condition No. 91 and during the subsequent plan check and processing of the redevelopment, staff determined the

existing City waterline and easement could not be used for the redevelopment project and that a new water system would be installed to provide water services to the proposed improvements. Moreover, no other agencies, companies, or persons have any property rights under the same easement.

The current owner of the subject Timber School property, Thousand Oaks Multifamily, LLC, is requesting the City vacate the easement and pipeline improvements located on the site since they are no longer required.

DISCUSSION/ANALYSIS:

Articles 1 and 2 of Division 9, Part 3, Chapter 4 of California Streets and Highways Code, Sections 8333, 8335, and 8336, allow the legislative body of a local agency to summarily vacate a public service easement by adopting a resolution of vacation under one of three scenarios. The first scenario is that the easement and public utility facilities that would be affected by the vacation have not been used for five consecutive years. Staff has researched the proposed abandonment and has found that the existing utilities in the area have already been removed, and that the easement area has not been used in the past five years. The public service easement may also be vacated if the easement is determined to be excess by the City and there are no other public facilities located within the easement.

Under State law, the process to abandon the water line easement, in this case, is to have City Council adopt a resolution of vacation. The attached resolution (Attachment #4) declares the City’s intention to vacate the easement and improvements under all applicable State criteria. Staff recommends City Council approve the resolution declaring intent to vacate the easements and setting a public hearing for May 13, 2025 (Attachment #4). Upon adoption of the final resolution vacating the easements after the public hearing, the City Clerk will record the vacation with the County of Ventura.
