RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF THOUSAND OAKS
VACATING TWO PUBLIC SERVICE
EASEMENTS IN THE CITY OF THOUSAND
OAKS, CA
WHEREAS, the public service easements, which are described in Exhibit A and Exhibit B, both of which are attached hereto and incorporated by reference herein (“Easements”), are not necessary for present or future use by the City as water pipelines and appurtenances incidental thereto for the transportation of water; and
WHEREAS, vacating the Easements is consistent with City policies and the applicable General Plan; and
WHEREAS, if any Easement facilities were constructed, they have been abandoned and/or removed and are no longer in use or needed for future use; and
WHEREAS, all persons interested in the proposed vacation have been heard; and
WHEREAS, the City may vacate Public Service Easements pursuant to California Streets & Highways Code § 8320-8325.
NOW, THEREFORE, the City Council of the City of Thousand Oaks resolves as follows:

SECTION 1: In accordance with the City’s findings, and pursuant to California Streets and Highways Code § 8330 et seq, the City of Thousand Oaks hereby vacates those public service easements that are described in Exhibit A and Exhibit B.
SECTION 2: The City Manager, or designee, is directed to record this Resolution pursuant to California Streets and Highways Code § 8325 within ten (10) days of its adoption.
SECTION 3: From and after the date this Resolution is recorded, those Easements vacated by this Resolution will no longer constitute Public Service Easements.
SECTION 4: This Resolution will take effect immediately upon adoption.
