WHEREAS, California Health and Safety Code Sections 17958, 17958.5 and 17958.7 require the governing body of a city, prior to adoption of any amendments, additions, deletions, or revisions to the California Building Code, to expressly find that such amendments are reasonably necessary and required due to local climatic, geological, or topographical conditions; and WHEREAS, after due consideration, the City Council hereby finds that due to local climatic, geologic and topographic conditions that exist in Thousand Oaks, amendments and revisions to the Title 24 California Code of Regulations, 2025 California Building Codes, are reasonably necessary and required to provide sufficient and effective protection of life, health, safety, welfare, and property; and, WHEREAS, in support of these amendments, additions, deletions, and revisions, the City Council hereby makes the following findings:

1. The City Council, after due consideration, finds and determines that, due to the need to establish administrative procedures to enforce the California Building Code, as well as due to local climatic, geological, or topographical conditions, including unusual soil conditions prevailing within the City, the public health and welfare would best be served by adding to and amending the California Building Code, related to grading. The City of Thousand Oaks contains several types of soil materials, but none as renowned as the expansive clay that caused massive foundation failures in the Conejo Valley during the early 1960's (prior to the City’s incorporation). The area is also in a seismically active area underlain by faults capable of producing significant earthquakes.

2. Thousand Oaks experiences unique local climatic conditions and local weather phenomenon which include periods of high temperature accompanied by low humidity and strong winds each year. These conditions create a high fire risk which may exacerbate fire development and fire spread. As a direct result of these climatic conditions, more stringent construction regulations are required to limit potential fire damage and to establish specific fire construction, reconstruction, and repair criteria. For example, typically from September to May, the strong, hot, and dry “Santa Ana” winds may result in wind-driven wildfire or non-wildfire events. These climatic conditions warrant departure from the California State Building Code regulations and introduction of more stringent construction regulations to limit potential fire damage and to establish specific fire construction, reconstruction, and repair criteria.

3. Thousand Oaks is located in a potentially high seismic activity zone and has unique local geological conditions, which may result in cdd:450-15\H:\COMMON\City Council\CC Agenda Items\2025\10072025\Building Code Update\Ordinance.docx/pz (FILE ID: MCA 25-70002)

earthquake hazards. Proximate and potentially active faults include the Boney Mountain Fault, Sycamore Canyon Fault, and Simi-Santa Rosa Valley Fault. The City also possesses poor soil quality, from sandy to rocky soil, including expansive (shrink/swell) soil, which may produce embankment failure, hydro-compaction/hydro-collapse, subsidence, and settlement. As a direct result of such geological findings, structures require deeper footings/foundations with additional reinforcement to mitigate these instability factors. Thousand Oaks is also located in a valley where the soil is predominantly expansive, where soil volume expands as water/moisture content increases and shrinks as water/moisture content decreases. As a direct result of these geological conditions, more stringent construction regulations are required to limit potential seismic and potentially damaging soil conditions, and to establish specific seismic and soil construction, reconstruction, repair, and reinforcement criteria.

4. Thousand Oaks contains mountainous terrain and knolls with steep slopes and uneven hillsides which can contribute to wildfire risk. The City possesses several flood hazard areas subject to periodic inundation, which may result in life and property loss or destruction, sanitation, and other health, safety, and welfare hazards. Seasonal rains may oversaturate the soil, causing periodic landslides, mudslides, rockslides, rockfalls, and debris flow and creating detrimental effects on in-ground structures. Such conditions contribute to flooding, debris flow, landslide, and mudslide hazards. As a direct result of these topographical conditions, more stringent construction regulations are required to limit potential damage, and to establish specific construction, reconstruction, and repair criteria.

NOW, THEREFORE, the City Council of the City of Thousand Oaks does ordain as follows:

Part 1
Sections 8-1.01 through 8-1.25, 8-1.27, and Chapters 4, 5, 6, 7, 8, 10, 14, 16, and 17 of Title 8 of the Thousand Oaks Municipal Code are hereby repealed.

Part 2
Sections 8-1.01 through 8-1.25 and 8-1.27, of Chapter 1 of Title 8 of the Thousand Oaks Municipal Code are hereby readopted to read as follows:

CHAPTER 1. BUILDING CODE
