RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF THOUSAND OAKS AUTHORIZING THE
CITY MANAGER TO NEGOTIATE THE TRANSFER
OF 524 WEST JANSS ROAD TO THE CONEJO
RECREATION AND PARK DISTRICT AND
DECLARING THE PROPERTY EXEMPT SURPLUS
LAND PURSUANT TO THE SURPLUS LAND ACT
WHEREAS, the City of Thousand Oaks received the property at 524 West Janss Road (Site) through the Tract 3465-1 as recorded in Ventura County Miscellaneous Book 97 pages 67 through 73, otherwise designated as APN 552- 003-412-5 as lot “A” for the purpose of open space; and WHEREAS, the City Council of the City of Thousand Oaks desires to explore the possible transfer of the Site to the Conejo Recreation and Park District for development as a neighborhood park; and
WHEREAS, the Surplus Land Act (California Government Code Section 54220 et seq.) is intended to make a local agency’s surplus land available to other public entities and affordable housing sponsors; and
WHEREAS, the Surplus Land Act requires the City to declare property as “surplus land” or “exempt surplus land” before the City may dispose of the property; and
WHEREAS, California Government Code Sections 54221(f)(1) identifies categories of property that constitute “exempt surplus land,” which need not be made available to other public entities or affordable housing sponsors prior to disposition; and
WHEREAS, California Government Code Section 54221(f)(1)(D) provides that local agency property transferred to another local agency for the receiving agency’s use is “exempt surplus land” under the Surplus Land Act; and WHEREAS, California Government Code Section 54221(f)(1)(P)(iv) requires that the City submit the “exempt surplus land” declaration and findings to the Department of Housing and Community Development for confirmation of this determination within certain timelines specific in the Code; and WHEREAS, the disposition of the Site in compliance with California Government Code Section 54221(f)(1)(D) constitutes the disposal of exempt surplus land and, pursuant to California Government Code Section 54222.3, is not subject to the provisions of the Surplus Land Act.

NOW, THEREFORE, the City Council of the City of Thousand Oaks does resolve as follows:
Section 1. The Recitals set forth above are true and correct and are incorporated into this Resolution by this reference.
Section 2. The City Manager, or his designee, is authorized to negotiate the transfer of 524 West Janss Road to the Conejo Recreation and Park District.
Section 3. The City Council of the City of Thousand Oaks hereby declares that the Site is exempt surplus land, contingent upon the Site being transferred to the Conejo Recreation and Park District in compliance with all the applicable requirements of California Government Code Section 54221(f)(1)(D).
