BACKGROUND:

The Mitigation Fee Act (Act), codified in California Government Code Section 66000 et seq., governs Development Impact Fees (Fees), which are charged to new development projects to fund public capital facilities necessitated by growth, including road improvements, traffic signals, and water/wastewater infrastructure.

Fee revenues must be accounted for separately and used only for their intended purposes. The City currently administers 18 Fees established by City Council resolutions, five of which are no longer collected. Expenditures are authorized through the biennial budget process.
