Legislative Update
CEQA Reforms (2025 Budget Trailer Bills)AB 130 and SB 131AB 130 includes the following provisions: • creates a new statutory exemption from CEQA for many qualifying infill housing development projects statewide.• Applies to projects on urbanized sites up to 20 acres (builder’s remedy projects limited to 5 acres)• Exempts eligible housing from environmental review entirely, shortening approval times and reducing costs. • Projects must be in urban settings, consistent with local General Plan and zoning, and not require the demolition of historic resources. 21 22
12 2/10/2026
CEQA Reforms (2025 Budget Trailer Bills)AB 130 and SB 131SB 131 includes the following provisions:• Limits CEQA review for housing projects that “just miss” an exemption by focusing only on impacts caused by the specific condition that disqualified them.• Includes additional statutory exemption for certain non-housing projects such as advanced manufacturing, high-speed rail, and wildfire mitigation systems.• Also streamlines CEQA for certain rezonings, implementing Housing Elements, and narrows administrative record requirements in CEQA litigation.

Transit-Oriented DevelopmentSB 79SB 79 - Upzones neighborhoods immediately surrounding train, light rail, and subway stations in many of the state’s most populous metro areas, regardless of local zoning restrictions. This removes local barriers that previously constrained development. • SB 79 makes housing meeting specified standards an allowed use of residential, mixed-use, or commercial sites within one-quarter or one-half mile of a qualifying transit-oriented development (TOD) –generally mid-rise (4-9 stories). 23 24 13
2/10/2026
Housing Reform Enforcement and PenaltiesAB 712AB 712- Strengthens enforcement of state housing reform laws by creating clear remedies, penalties, and protections when a public agency fails to comply with those laws.

Housing Element Litigation ClarificationsSB 786SB 786 –Clarifies aspects of housing element law and litigation standards to reduce disputes over compliance and implementation.• Extends local compliance period to 120 days after a court order.• Mandatory HCD review if housing element deadlines are not met.• Limits procedural delays (appeals/stays) in housing lawsuits.• Applies to all cities and counties, including charter cities. 25 26
14 2/10/2026
Expedited Judicial Review of Housing DenialsSB 808SB 808 –Creates a fast-track court process for legal challenges when a local agency denies a housing permit or entitlement. Disputes can be resolved in weeks instead of years. “Shot Clock” for Final InspectionsAB 13081308 –“Shut the Clock” for final inspections.• State law designed to prevent delays in project completion.• Applies to inspections for:• Residential• Commercial• Mixed-use projects• Prohibits agencies from using inspection processes to restart or extend approval timelines. 27 28
15 2/10/2026
Application and Post-Entitlement Permits AB 253 and AB 920AB 253: Allows a private plan check if delays in the building department exceed 30 business days for projects of 10 units or fewer. Local government has 10 business days to review a private plan check. Applicant must indemnify the city. AB 920: Requires cities and counties with a population over 150,000 to establish a centralized online housing application portal by January 1, 2028.
