SECTION 1

WHEREAS, at the June 23, 2026, City Council public hearing, oral and written evidence, including a staff report, were presented and received, and ATTACHMENT #8
COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS FOR SUP-2025-70022 comments and arguments were heard from all interested parties appearing in the matter; and
WHEREAS, certain uses within SP-11 require a Special Use Permit to permit the sale and consumption of alcohol; and
WHEREAS, the SUP application was evaluated and conditioned by the City of Thousand Oaks Community Development and Public Works Departments, the Ventura County Fire Department, and the Thousand Oaks Police Department; and WHEREAS, the findings of the City Council supporting approval of said application are as follows:
1.The SUP is consistent with the Thousand Oaks General Plan and any applicable specific plan or redevelopment plan (TOMC Section 9-
4.2803(c)(1)).
The proposed Special Use Permit is applicable to Subareas B, C, and E, described by SP-11, as amended by SP-2025-70001. Policy LU-13.8 of the General Plan says to “Create a vibrant and captive market to support local businesses by promoting mixed-use with housing, retail and dining, hotels, and a diversity of housing types (in terms of size of units, affordability, and tenure) in and around the Downtown Core area.” By allowing alcohol sales associated with permitted uses, such as restaurants, tasting rooms, and the hotel, the Downtown Core area will be able to attract and retain patrons, particularly those supporting the entertainment uses on site. Therefore, the proposed Project complies with this finding.
2.The SUP complies with all applicable laws, regulations and policies, including the Thousand Oaks Municipal Code (TOMC Section 9-
4.2803(c)(2)).
With the implementation of the suggested conditions, the SUP will satisfy all applicable laws, regulations and policies, including the Thousand Oaks Municipal Code.
Any future establishment operator or tenant proposing to include alcohol sale or service must obtain and maintain an alcohol license from the California Department of Alcoholic Beverage Control, obtain and maintain a City-issue business license, and provide a signed affidavit of acceptance of the conditions associated with SUP-2025-70022. Should any operator/ tenant be unable or unwilling to comply with the conditions of approval included within SUP 2025-70022, a separate Administrative Special Use Permit application pursuant to the requirements of SP-11, as amended will COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS FOR SUP-2025-70022 be required. Additionally, the SUP application has also been reviewed by other City departments and agencies for conformance with applicable laws, regulations, and policies, and provided appropriate conditions of approval.
Therefore, the future on- and off-site sale and consumption of alcoholic beverages complies with all applicable laws, regulations, and policies.
3.The SUP will not be detrimental to the public health, safety or general welfare (TOMC Section 9-4.2803(c)(3)).
With the conditions of approval imposed, the SUP will not be detrimental to public health, safety or general welfare because the Police Department has reviewed the request and finds it to be acceptable, subject to the conditions of approval. Additionally, each establishment must obtain and maintain an alcohol license from the California Department of Alcoholic Beverage Control.
4.The SUP application has been reviewed in conformance with the provisions of the California Environmental Quality Act (TOMC Section 9-4.2803(c)(4)).
The Downtown Project, including said SUP application, was reviewed for conformance with the provisions of the California Environmental Quality Act.
5.The proposed use at the proposed location will be compatible with land uses in the vicinity (TOMC Section 9-4.2803(c)(5)).
The proposed future sale, service, and consumption of alcohol within Specific Plan Subareas B, C, and E will be compatible with land uses in the vicinity as the project area is an infill site on Thousand Oaks Boulevard, which already contains numerous establishments that serve alcohol.
The Thousand Oaks Police Department has reviewed the application in conjunction with crime analysis of the area. The location of the proposed business is in a police reporting district that does not have reported incidents or requests that are considered excessive. Therefore, the Thousand Oaks Police Department does not object to the issuance of the proposed Special Use Permit.
Alcohol sales and consumption are already allowed during events at the existing theatres within Subarea C, at the restaurant and retail uses to the north and east, and at restaurant uses further west of the existing residential uses adjacent to the project area. Furthermore, such uses are anticipated to be an amenity to those living in and visiting the Downtown Core and surrounding area, which is intended, per the General Plan, to be a vibrant COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS FOR SUP-2025-70022 mixed-use destination. Therefore, the SUP will be compatible with the land uses in the vicinity.
SECTION 2
NOW, THEREFORE, BE IT RESOLVED that based on substantial evidence contained within the record, the analysis in the agenda report and consideration of the record, both written and oral, and, having considered the Final EIR and associated Mitigation Monitoring and Reporting Program (Attachment #1), the CEQA Findings of Fact and Statement of Overriding Considerations (Attachment #5), and recommendation of the Planning Commission, the City Council certifies the Final EIR and approves the associated Mitigation Monitoring and Reporting Program, and the CEQA Findings of Fact and Statement of Overriding Considerations, and approves SUP-2025-70022, subject to conformance with the conditions set forth and attached hereto and made a part hereof.
