Public Works Director Bilezerian said that he frequently communicates with the District 7 office to make sure they are keeping their responsibilities and look into more ways to increase and maintain cleanliness.

9G AUTHORIZE STAFF TO PREPARE AN AGENDA ITEM TO SUBMIT FOR VOTER CONSIDERATION A LOCAL 3/¿ CENT SALES TAX BALLOT MEASURE ON THE JUNE 7,2022 ELECTTON
Recommendation of the City Manager and Finance Director that City Council review resident polling results and authorize staff to prepare an agenda item to submit for voter consideration a local 3/q cêrú sales tax ballot measure on the June 7, 2022, election.

Mayor Furey emphasized the importance of tax funds and grants while acknowledging the public distaste for them. He said Torrance has no control over federal and state taxes and that Torrance has not had much revenue increases to maintain or improve services. He asked how many employees Torrance had in 2000.

City Manager Chaparyan said it was about 1250 FTs. He said through budget reductions there have been 130 positions in the city budget over the years. He said those positions are now gone and have not increased but that they have reorganized through conversion of positions in Police and Fire Departments.

Mayor Furey noted the many issues Torrance has faced in recent years that have increased costs. He said small increases to taxes support vital infrastructure and can provide benefits to the city. He said that significant amount of the income of the sales tax comes from non-Torrance residents. He said education for the public would be important.

Councilmember Ashcraft reported the transparency they city has provided for the public, in specific using a mailer. She reminded the public that the sales tax increase would not apply to food and medication. She said a citizen oversight committee could be beneficial. She said mandatory costs are going up and revenues have stayed flat, so this would be a necessary measure.

Councilmember Mattucci recalled his stance on opposition to raising taxes. He acknowledged the budget shortfalls but cited many of them are pandemic related. He stressed that public safety services were important. He said as leaders and staff move on from service, how could they be ceftain that future leaders and staff will use fund correctly. He added that a 2/3 majority vote should be used especially when it comes to raising taxes. He said the only way he would support another tax would be if the tax was a special tax in which 1OO"/" of the money went to public safety.

Councilmember Griffiths asked if a 2/3 public majority vote was required if this were a specific use tax.

City Manager Chaparyan confirmed that to be true.

Aleksander Alderete
Minutes Secretary
6 City Council
January 25,2022

Councilmember Griffiths asked how a S-cent sales tax increase would affect an average Torrance resident.

Finance Director Sheila Poisson responded that it would be about $130 per year per resident for the 3/q cênI increase, so the 5-cent increase would be under $100.

Councilmember Griffiths said that was a small price to pay to support the city. He said that Torrance needs to be helped and protected through this tax.

Members of the public spoke
Councilmember Chen commented that using the reserves to balance the budget over multiple years was not the correct way. He said those funds need to be for emergencies such as the pandemic. He stressed find other means to bring in revenue. He said that compared to this measure, Measure X would have been the better proposal. He said public safety was paramount.

He disagrees with the civilian oversight committee as he said that is the job of the City Council.

He said he is not yet ready to support this.

Councilmember Griffiths clarified that he is not supportive of increasing taxes. He said previous tax proposals that have passed has not benefitted Torrance and he opposed them. He recalled the mandated expenses from the state and federal government that have increased costs without compensation. He cited other events such as legal fees, cyber-attacks, and labor costs.

He said other cities have benefited from these types of measures and Torrance is a minority in not having this. He cited pension costs and the steps that Torrance has taken to mitigate the burden but said those obligations will still need to be paid. He said election costs have increased as well as general cost goods. He said Torrance is heavily reliant on sales tax and online sales have increased causing Torrance to lose out. He said security costs have increased too. He said Torrance has cut spending and continues to do so but noted that Torrance needs more revenues to provide good services.

Councilmember Kalani said this was about giving Torrance residents the choice rather than making the choice. She said she does not support new taxes but that Torrance needs revenues to support the services it provides. She said Torrance needs to keep up with inflation.

She emphasized the importance of the voters.

Councilmember Walser stressed the need to protect the city. He cited many of the issues that Councilmember Griffiths brought up and stated that need to guard against the unknown variables. He supports the measure to safeguard Torrance and support services. He said there is a max rate that can be increased to but reminded the public that an outside party could take advantage of if Torrance does not utilize it.

Councilmember Ashcraft echoed Councilmember Kalani's statement that it is about choice for voters. She said reserves have been used accordingly and that they need to be replenished for the next emergency. She reminded that this is not a tax on every single person and that one does not have to spend on items all the time.

Mayor Furey asked for the public if portions of this could be earmarked for specific departments such as the Police or Fire Department.

City Attorney Patrick Sullivan said that is not possible and that only a special tax can do that.

He said a general tax goes to the General Fund which can be handled by the City Council, but once special percentages are earmarked it then becomes a special tax requiring a2/3 majority vote.

Aleksander Alderete
Minutes Secretary
7 City Council
January 25,2022

Mayor Furey said that the reserves were used appropriately in the past. He said Torrance has received some funds for reserves from the federal government. He said Measure X was designed to take advantage of a tax increase before an outside party did, but that there was no outreach. He said this measure has had much more education for the public. He said Torrance has provided great services, been good stewards and deserves a raise. He said sales tax is best way to raise funds from businesses.

City Manager Chaparyan recommended the City Council move foruvard with the more popular lz cenl increase public ballot measure rather than the 3/+ cenl increase. He said staff would return February 15 with the resolution for City Council consideration for approval.

Councilmember Walser asked if the percentages were going to be determined later after more research was done.

City Manager Chaparyan answered that research has shown that the lz cenl increase was more popular and that it was the preferred percentage to consider. He said this would have a higher likelihood of passing. He reminded the public that the funds would be going to vital services and reserves.

City Attorney Sullivan said that it was possible to bring folvard two resolutions with the 7z and 3/+ cênl increases and added that there was no further polling of the public that was being planned.

Councilmember Walser said that if lhe lz cent increase presented a better opportunity then he would go in that direction.

MOTION: Councilmember Ashcraft moved to authorize staff to prepare an agenda item to submit for voter consideration a local lz cenl sales tax ballot measure on the June 7, 2022, election. Councilmember Walser seconded the motion. The motion carried 5-2 with Councilmembers Chen and Mattuccivoting no.

Councilmember Griffiths said his preference was for the 3/q cêt1t increase but said lhe lz cent increase was a reasonable compromise based on polling information and for those hesitant about raising taxes. He said this will still leave an outside party to come in and take taxpayer money away from Torrance.

City Attorney Sullivan explained that a city cannot enforce an anti-camping law on someone due to their being homeless unless there are shelter beds available. He said in Torrance there are no shelter beds available and therefore anti-camping cannot be enforced.

Councilmember Mattucci further asked for confirmation that it includes anyone on public spaces such as sidewalks, parks, etc.

City Attorney Sullivan said that was correct.

Councilmember Griffiths emphasized the fact that elections have greatly increased. He asked where that money comes from to pay for these elections.

City Clerk Poirier answered that it comes from the General Fund.

Councilmember Griffiths said that the General Fund comes from taxpayer money. He said the General Fund is struggling to pay for growing expenses that Torrance has no control over. He said getting amendments will be more difficult if Torrance cannot pay for çity elections. He reiterated his earlier point that the sales tax is necessary to pay for these obligations.

Councilmember Chen recalled when there were lower costs for a municipal election where there were more at-large seats than a previous year which had less at-large seats and was more expensive.

City Clerk Poirier said the County explained that it depends on how many cities consolidate with them and some of the election costs are shared among cities. She added that cost increases from 201 8-2020 are passed down costs from the voting machines and other upgrades to cities.
