A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TORRANCE, CAL¡FORNIA, TERMINATING CERTAIN
AGREEMENTS AND EASEMENTS RELATED TO
SOUNDPROOFING REQUIREMENTS BETWEEN TORMED
AND THE CITY OF TORRANCE AT 34OO . 3440 LOMITA
BOULEVARD
WHEREAS, the Planning Commission of the City of Torrance approved Precise Plan of Development 69-7 on March 18, 1970 with cefiain conditions of approval pertaining to soundproofing; and
WHEREAS, the Planning Commission of the City of Torrance approved Precise Plan of Developmen| T2-14 on September 20, 1972 with certain conditions of approval pertaining to soundproofing; and
WHEREAS, the City of Torrance and TORMED PARTNERSHIP entered into an agreement dated August 20, 1970, and recorded September 10, 1970 as lnstrument No.3866, in Book M3567,
building known as TORPLEX l¡ (3400 Lomita Boulevard); and WHEREAS, a Grant of Easement dated December 18, 1973 recorded February 1,1974 as lnstrument No. 3932, in the Otficial Records of the County of Los Angeles applies nearly identical requirements as the agreement dated August 20, 1970 on a building known as TORPLEX lll (3440 Lomita Boulevard); and
WHEREAS, the Planning Commission of the City of Torrance conducted a public hearing on December 1,2021, to consider an application for a Modification of a previously approved Precise Plan of Development (PP69-7) filed by The Tormed Buildings, Ltd. (David E. Buxton) to allow modification of conditions of approval pertaining to aircraft noise attenuation to an existing medical office building on property located in the Hospital-Medical-Dental (H-M-D) District at 3400 Lomita Boulevard; and
WHEREAS, the Planning Commission of the City of Torrance continued the matter indefinitely to incorporate 3440 Lomita Boulevard to the Modification request; and WHEREAS, the Planning Commission of the City of Torrance conducted a public hearing on January 19,2022, to consider an application for a Modification of a previously approved Precise Plan of Development (PP69-7 and PP72-14) filed by The Tormed Buildings, Ltd. (David E.
Buxton) to allow modification of conditions of approval pertaining to aircraft noise attenuation to existing medical office buildings on properties located in the Hospital-Medical-Dental (H-M-D) District at 3400-3440 Lomita Boulevard; and
WHEREAS, the Planning Commission of the City of Torrance approved the request by a roll call vote of 6-0 with one Commissioner recused;
NOW, THEREFORE, BE lT RESOLVED as follows:
1 . That the agreement dated August 20, 1970, contained in Exhibit A which is attached and hereby made part of this Resolution, between the City of Torrance and Tormed is hereby terminated; and
2. That the Grant of Easement dated December 18, 1973, contained in Exhibit B which is attached and hereby made part of this Resolution, is hereby terminated.
