A RESOLUTION OF THE CITY COUNCIL OF TORRANCE,
CALIFORNIA, UPHOLDING AN APPEAL AND DENYTNG A
CONDITIONAL USE PERM¡T AS PROVIDED FOR IN
D¡VISION 9, CHAPTER 5, ARTICLE 1 OF THE TORRANCE
MUNICIPAL TO ALLOW THE CONSTRUCTION AND
OPERATION OF AN AUTOMATIC CARWASH ON
PROPERTY LOCATED IN THE C3-PP ZONE AT 2880
SEPULVEDA BOULEVARD
CUP21-00008: PM DESIG GROUP (PEGAH FAZELI)
WHEREAS, the Planning Commission of the City of Torrance conducted a public hearing on November 3,2021, to consider an application for a Conditional Use Permit filed by PM Design Group (Pegah Fazeli) to allow the construction and operation of an automatic canryash on property located in the C3-PP Zone at 2880 Sepulveda Boulevard; and WHEREAS, the Planning Commission approved the subject request by a vote of 4-2, with a Commissioner absent; and
WHEREAS, an appeal to the City Council was filed on November 18,2021; and WHEREAS, the City Council of the City of Torrance conducted a public hearing on March 15, 2022, to consider an application for a Conditional Use Permit filed by PM Design Group (Pegah Fazeli) to allow the construction and operation of an automatic carwash on property located in the C3-PP Zone a12880 Sepulveda Boulevard; and
WHEREAS, the matter was continued to March 29,2022; and WHEREAS, the City Council of the City of Torrance conducted a public hearing on March 29, 2022, to consider an application for a Conditional Use Permit filed by PM Design Group (Pegah Fazeli) to allow the construction and operation of an automatic carwash on properly located in the C3-PP Zone a12880 Sepulveda Boulevard; and
WHEREAS, on March 29,2022, the City Council of the City of Torrance by roll call vote upheld the appeal and denied the subject request; and
WHEREAS, due and legal publication of notice was given to owners of property in the vicinity thereof and due and legal hearings have been held, all in accordance with the provisions of Division 9, Chapter 5, Arlicle 1 of the Torrance Municipal Code; and WHEREAS, the City Council of the City of Torrance does hereby find and determine as follows a) That the property for this Conditional Use Permit is located at 2880 Sepulveda Boulevard; b) That the property is described as Lot 1 as shown on Parcel Map No. 2960, filed in Book 38
California;
c) That in-fill development projects within City limits on a project site of no more than five acres substantially surrounded by urban uses are Categorically Exempted by the Guidelines for lmplementation of the California Environmental Quality Act, Section 15332; d) That the proposed carwash is conditionally permitted in the C3-PP Zone; e) That the proposed use will impair the integrity and character of the zoning district because the carwash is not compatible with surrounding uses;
f) That the proposed use will not be compatible with existing and future uses within the zone and area because the carwash is not in character with surrounding development and has the potential to create nuisances; and
g) That the proposed use may discourage the orderly development of the City as provided for in its General Plan because the carwash is not compatible with the surrounding area.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF TORRANCE HEREBY DENIED CUP21-00008, filed by PM Design Group (Pegah Fazeli) to allow the construction and operation of an automatic carwash on property located irt the C3-PP Zone at 2880 Sepulveda Boulevard.
