DISCUSS AND PROVIDE DIRECTION TO CITY CLERK ON FILLING UNEXPIRED DISTRICT 2 TERM OF COUNCILMEMBER GEORGE CHEN
Recommendation of the City Clerk that City Council discuss and provide direction to the City Clerk on filling the unexpired District 2 City Council seat (term expiring March 2024) created by the election of Councilmember George Chen as Mayor.
City Clerk Poirier summarized the options available to fill the vacancy that was opened when then-Councilmember Chen was elected as Mayor. The last City Council meeting before the end of 60-day period to fill the vacancy will take place on August 23. Historically, vacancies have been filled by appointment; this can be done either via nominations from the City Council or by soliciting applications for appointment by the City Council and voting on those who have applied. ln addition, the City Council can call a special election before the 60-day period ends. The deadline to receive completed applications would be Thursday, August 11, and the appointment would take place on Tuesday, August 23.
City Clerk Poirier was unable to obtain a quote for an all-mail ballot election from the Los Angeles County Registrar-Recorder's Office as one would not be provided until two weeks after the requested date.
Councilmember Mattucci asked if an all-mail ballot election remained an option. City Clerk Poirier responded that the City Attorney had brought forth an ordinance at the City Council meeting of April 21, 2020 to allow the City of Torrance to conduct an all-mail ballot election and the City Council did not choose to adopt the ordinance.
Councilmember Mattucci then asked if the City Council could call a special meeting prior to the end of the 60-day period and City Clerk Poirier responded in the affirmative.
Councilmember Griffiths stated that he would like for the Council to revisit an all-mail ballot election and opined that the Council appoint a councilmember like in the past.
Councilmember Sheikh asked when the special election date would be held, if pursued, and City Clerk Poirier responded that the election would take place in November or December 2022 and possibly January 2023 and be consolidated with Los Angeles County with vote centers and not an all-mail ballot.
Councilmember Mattucci stated that he is leaning toward the appointment option Rene Salazar

108. GONDUCT PUBLIC HEAR¡NG ON RESOLUTION OF IMPASSE WITH TORRANCE MUNICIPAL EMPLOYEES - AFSCME LOCAL 1117
Recommendation of the City Manager that City Council impose Last, Best, and Final Offer on Torrance Municipal Employees - AFSCME Local 1117 (TME-AFSCME) in the amount of approximately $682,391 .
Assistant to the City Manager Jamie Le provided historical background on requirements for Bus Operators, Relief Bus Operators, and Apprentice Relief Bus Operators. During the presentation, Ms. Le discussed the results of a survey of other transit agency practices regarding surveillance, which were that most agencies conduct both audio and video surveillance on bus operators. AFSCME and the City have made great progress in negotiations but regarding wages, expanding the camera view, and adding audio, both sides have exhausted the meet and confer process and mediation, and are now before Councilfor resolution.
The City made its last, best, and final offer on February 13,2022. The City offered an 8o/o increase for Bus Operators and Relief Bus Operators, and a 20% increase for Apprentice Relief Bus Operators to assist with recruitment. lf the department is unable to hire bus operators, the City will be forced to cut service and that will reduce funding.
Management maintains that privacy is not an expectation when driving a City bus as Torrance Transit Buses are public spaces.
Staff recommends that the City impose its last, best, and final offer in order to recruit operators at market rate, reinstate bus lines that have been on hiatus, and generate revenue.
Councilmember Sheikh disclosed that he had meetings with staff and representatives of AFSCME Local1117.
Rene Salazar I City Council
Minutes Secretary July 26,2Q22
Bob Adams, Business Representative for AFSCME District Council 36 and AFSCME Local 1 117 made a presentation in response. Mr. Adams emphasized that there is an industry- wide bus operator shortage and operators do not feel safe. He added that Transit has a deep history of abusing the disciplinary process and that there is a lack of trust in Transit management by the bus operators that has interfered with negotiations. There is agreement regarding the Safety Event Review Board, fob sign in and replacement, and Vehicle Condition Report. The compensation for the bus operators is not competitive as the current and proposed pay is below six other transit agencies in the region. He ended his presentation by urging the City Council to send the City back to the table.
Members of the public spoke
Councilmember Kaji expressed concern that the City's salary for bus operators is not competitive and that the expressed lack of trust between the employees and management is troubling, as is the low employee morale.
Assistant to the City Manager Le responded that staff has exhausted all methods of resolution and recommends that the City impose its last, best, and final offer on AFSCME. Staff concluded the way to increase revenue is to have more bus lines and that can be accomplished with hiring more bus operators, and imposing the last, best and final offer is the best way to accomplish that.
Mr. Adams replied that wages must be competitive and the City's offer is not enough MOTION: Councilmember Griffiths moved to close the public hearing. Councilmember Kalani seconded the motion. The motion carried by a vote of 6-0.
MOTION: Councilmember Griffiths moved to concur with staff recommendation and impose the last, best, and final offer on AFSCME Local 1117 and Councilmember Kalani seconded the motion. The motion carried by a 4-2 vote with Councilmembers Kaji and Mattucci voting no.
