10. HEARINGS
1 0A. CONSIDER APPEAL OF SLING PILOT ACADEMY REGARDING NON-RENEWAL OF
BUSINESS LICENSE
Recommendation of the Finance Director that City Council deny the appeal filed by Sling Pilot Academy regarding the non-renewal of their business license.
Councilmember Kalani recused herself at 9:30 p.m .
Finance Director Sheila Poisson introduced the item to the City Council.
The appellant, Stan Barankiewicz with Orbach Huff and Henderson representing Sling Academy, stated that there was an attempt by Sling Academy to go before the LRB that was not acted upon. He discussed the non-renewal letter, the attempts of the city to limit and regulate flying aircraft, and Resolution No. 77-215 was adopted to regulate aircraft. He stated the city cannot regulate aircraft by case law, which comes from the FAA.
The proponent, Alan Fenstermacher with Rutan and Tucker representing the City of Torrance Finance Department, stated that the brief submitted adequately addressed all the arguments. He noted some of the high points, including that the business license was not revoked, rather it was not renewed due to not being valid in the first place. He stated that there was no property right because of this, and many cases have upheld this. He continued that the city has the power to remand this back to the LRB if it chooses. He also stated that certain turn regulations do not impact the number of flights, as seen at other airports. He continued that this was a business license regulation, and it has nothing to do with land use regulation. Thus, there should not be an ordinance. He concluded that the appellant was arguing that due to many years of operation there is a right to continue the use of the airport, and that the city is within its right to perform these actions.
Members of the public were allowed to speak at this time.
Michael Lyon stated that if the City Council follows through, peace and mind would be restored to residents and supported limiting the amount of flight schools.
A member of the public stated that the noise was greatly overstated. He added that the landing fees would lead to less flights and that Sling Academy have the quietest planes.
A member of the public stated that her life was dependent on Sling Academy and that many of the residents knew there would be airplanes in their resident vicinities.
A member of the public stated that the city created this problem when they allowed more schools to enter the city. He added that it meant that residents would need to pay for lawyer fees on behalf of the city.
Mr. Barankiewicz stated that all of this was predicated on an unenforceable and invalid resolution incorporated into the master plan. He continued that a resolution would need to be adopted. He added that only the FAA can have purview over the flights and Torrance cannot regulate the air flight.
MOTION: Councilmember Lewis moved to close the public hearing. Councilmember Kaji seconded the motion. The motion carried by a vote of 6-0 with Councilmember Kalani recused.
