6 • Adopted in 1977.
• Recognizes there are development difficulties in hillside areas. • Established a discretionary review process for development. • Prevents significant adverse impacts upon the view, light, air, and privacy interests of other properties in the vicinity.
CRITERIA FOR GRANTING A VARIANCE
a) There are practical difficulties or unnecessary hardships resulting from the strict enforcement of the Hillside Overlay.
b) The project will not be materially detrimental to the public welfare or to the property of other persons located in the vicinity thereof. c) The project will not substantially interfere with the orderly development of the Hillside Overlay.
7 RECOMMENDATION
Planning Commission and Community Development Director
recommend that City Council:
• Adopt a Resolution denying the Variance request; and
