5C I T Y O F T O R R A N C E P L A N N I N G C O M M I S S I O N | J U N E 1 7 , 2 0 2 5 •State Law (Gov. Code 65589.5) limits local discretion on housing projects that comply with objective standards
•The revised project qualifies as a “housing development project” under the HAA. •Objective standards = measurable, clear, and free from personal judgment (e.g., height, setbacks, FAR). •Hillside Overlay provisions are subjective (e.g., view impacts, neighborhood compatibility) and not enforceable under the HAA.
•Result: Hillside Overlay standards do not apply; project is subject to R-1 Zone objective standards. •Staff confirmed compliance with all applicable R-1 Zone objective standards.
