Expenditure: None.
RECOMMENDATION
Recommendation of the City Manager that City Council adopt a RESOLUTION authorizing access to state criminal history information for employment, volunteers, and contractors through the Department of Justice, and repealing Resolution No. 2002-111.
FUNDING
None required.
DISCUSSION
In 2002, the City Council adopted Resolution No. 2002-111, authorizing the City of Torrance to access state summary criminal history information for purposes related to employment, including volunteers and contract employees. Since then, state laws governing the use of criminal history information in employment decisions have changed.
To ensure compliance with current legal requirements, including those set forth in California Government Code § 12952, this updated resolution is proposed. This resolution removes outdated language from the original resolution and ensures the City remains legally compliant with state law. It continues to authorize the City to access summary criminal history information for the same purposes as previously allowed, while aligning the City's practices with current legal standards.
