Wilson Park, for an additional five-year period beginning December 1, 2025 and ending December 31, 2030.

DISCUSSION
Since November 25, 2008, the City of Torrance has maintained a concession agreement with Tyler Sports, Inc. for the operation of the batting cage facility at Charles H. Wilson Park. Under this agreement, the concessionaire was responsible for capital improvements, including the installation of pitching machines, upgrades to light fixtures, repair and replacement of netting, replacement of signage, and the introduction of a new token system.

On May 1, 2012, the concession agreement was amended and restated to include an additional parcel of property (approximately 10,000 sq. ft.) for rental and exclusive use by Tyler Sports Inc.

This new space featured artificial turf and netting for patrons to practice fielding. On November 19, 2013, City Council approved a first amendment to extend the agreement by two additional five-year terms, increase the monthly rental fees, and add another parcel of property (approximately 12,000 sq. ft.). Subsequently, on December 1, 2015, a third amendment was executed to exercise the first five-year option, further extending the term of the concession agreement.

On June 29, 2020, a fourth amendment was executed to update the concessionaire fee schedule, include requirements for compliance with COVID-19 protocols, mandate that all facility participants sign a waiver and release, and revise the indemnification language to address concerns related to COVID-19 and other infectious diseases. 1 City Council

On May 11, 2021, a fifth amendment to the concession agreement was executed to exercise the second of two five-year options, extending the term of the agreement through November 30, 2025.

The sixth amendment to the concession agreement features updated minimum insurance limits to meet the City’s requirements. Additionally, both parties are mutually agreeing to exercise the option to extend the term as outlined in the fifth amendment. Accordingly, staff recommends that City Council approve the sixth amendment to the concession agreement with Tyler Sports, Inc,. for the operation of the batting cage facility at Charles H. Wilson Park, for an additional five-year period beginning December 1, 2025 and ending on December 31, 2030.
