Subject: Planning Commission and Community Development – Conduct a Public Hearing and Adopt RESOLUTION to Uphold the Appeal and for the Approval of a Minor Hillside Exemption (MHE24-00037) to allow an as-built rear yard deck on property located within the Hillside Overlay in the Single-Family Residential District (R-1) Zone at 5608 White Court and Determine a Categorical Exemption from the California Environmental Quality Act (CEQA). Expenditure: None.

RECOMMENDATION
Recommendation of the Planning Commission and the Community Development Director that City Council:

1. Conduct a public hearing; and

2. Uphold the appeal; and

3. Adopt a RESOLUTION for the approval of MHE24-00037 to allow an as-built rear yard deck on property located within the Hillside Overlay in the R-1 Zone at 5608 White Court; and

4. Determine a Categorical Exemption from the California Environmental Quality Act (CEQA); Article 19, Section 15303(e) (New Construction and Accessory Structures).

FUNDING
None required.

DISCUSSION
The project applicant, Mike Boosler (Shuji and Lori Yamada), requests approval by the City Council to allow an as-built rear yard deck on property located within the Hillside Overlay in the R-1 Zone. The planning and design provisions of the Hillside Overlay are applicable to the project and therefore require discretionary review and approval of MHE24-00037 to allow the as-built deck.

The primary issue on appeal is whether the as-built deck has the potential to cause a substantial adverse impact to privacy for properties located below the project site along Wayne Avenue. As discussed in detail below, staff has determined that, based on site observations and topography, the deck does not result in such an impact. Staff recommends that City Council uphold the appeal and approve MHE24-00037, as conditioned.

General Plan Land Use Designation
The project site has a General Plan Land Use Designation of Low Density Residential (R- LO). Development in the R-LO land use designation is characterized generally by detached one- and two-story single-family residences on individual lots forming a cohesive neighborhood. A single-family residence with a rear yard deck is deemed consistent with the R-LO land use designation.

Zoning Designation and Adjacent Land Uses
The project site is designated as R-1 Zone as well as Hillside and Local Coastal Overlay (R-H) Zone, also known as the Hillside Overlay. The project site is bound by six parcels that share the same zoning designation and that are developed with similar land uses to the north, east, south, and west.

Project Site
The project site is comprised of a one-story single-family residence situated on an irregular shaped lot measuring 8,281 square feet in area. The project site is oriented towards the northwest, on the southeast side of the cul-de-sac at White Court, west of Wayne Avenue. The project site is located atop a hillside area, with nearby one and two-story residences situated above and below the project site. The pad height of the adjacent one-story residence to the north at 5602 White Court sits slightly below the project site, whereas the pad height of the adjacent one-story residence to the south at 5614 White Court sits slightly above. The residences that abut along the rear at 20521, 20527, 20533 Wayne Avenue are significantly below the project site and sit at the bottom of the hillside area. The project site topography is relatively flat, with the building pad of the existing residence situated entirely above the cul-de-sac at White Court, before sloping downward near the rear property line. Scenic views of the Los Angeles basin and surrounding mountains are observed from the project site due to its elevation and topography.

As-Built Deck
The project involves an as-built deck located in the rear yard. The deck measures approximately 1,755 square feet and spans across the full width of the rear yard and near to the rear property line along the edge of the slope. The deck floor is elevated between 16” to 24” above grade and designed to match the finished floor of the residence. The deck is accessed directly from the residence and side yard and features a low-profile outdoor gas fireplace and a 42” tall guardrail. The deck materials include wood subframing, composite deck boards, and a metal guardrail.

Complaint Case
In February 2024, a complaint was filed with the Community Development Department regarding the unpermitted construction of a deck at the subject property (COM24-00114). An investigation was conducted, and a notice of violation was issued for unpermitted construction. Subsequently, an application was filed for MHE24-00037 to obtain zoning approval of the as-built rear yard deck, which is required prior to the issuance of building permits. Staff notes that approval of MHE24- 00037 would serve to resolve the complaint by allowing the applicant to obtain the necessary building permits and inspections for the as-built deck.

Hillside Overlay
In the Hillside Overlay, the permitting of an as-built deck measuring less than 14’ in height is subject to zoning review via a Minor Hillside Exemption Permit (MHE) to determine that such deck does not have the potential to cause a substantial adverse impact on the view, light, air, and 2 2

privacy of properties in the vicinity, and that there is no significant public controversy thereon. As part of the zoning review process, a courtesy notice was mailed in July 2024 to the owners of properties located adjacent to the project site at 5512, 5602, 5614 White Court, and 20521, 20527, 20533 Wayne Avenue. The notice provides a brief project description, contact information, availability to review the project plans, and comment period.

In response to the notice, correspondence was received from the property owners and/or residents at 20521, 20527, 20533 Wayne Avenue that shared concerns regarding potential impacts to privacy, among other concerns related to drainage and unpermitted work. Staff notes comments regarding potential impacts to privacy are evaluated based on the planning and design provisions of the Hillside Overlay, whereas other concerns related to drainage and unpermitted work are addressed separately at the time of plan check prior to the issuance of building permits.

In July 2024, an initial field assessment was conducted at 20521, 20527 Wayne Avenue with the purpose of conducting outreach, sharing the project plans, and for the consideration of potential substantial adverse impacts to privacy. At that time a field assessment was not conducted from the subject property, and several unsuccessful attempts were made for an assessment at 20533 Wayne Avenue. A field assessment was also not conducted from other properties in the vicinity due to the location of the deck in the rear yard and, in the judgment of staff, the unlikelihood of having a substantial adverse impact to surrounding view, light, air, and privacy.

During the initial field assessment, the property owners and/or residents at 20521, 20527 Wayne Avenue stated the primary concern is impact to privacy in the rear yard. Staff made observations from the rear yard and initially deemed the as-built deck has the potential to result in a substantial adverse impact to privacy because the deck is elevated and appeared to extend beyond the natural slope, thus creating a new vantage point that previously did not exist. The results of the field assessment were then relayed to the applicant, and in response, a privacy hedge was installed along the deck near the edge of the slope and rear property line. After installation of the privacy hedge, the property owners and/or residents at 20521, 20527 Wayne Avenue shared with the staff that their concerns remained.

In response to the ongoing concerns, staff had initially recommended approval of MHE24-00037 with a condition that required removing a portion of the as-built deck to achieve a 10’ setback from the rear property line so as to eliminate a new vantage point that previously did not exist and mitigate the potential substantial adverse impact to privacy for the properties at 20521, 20527 Wayne Avenue. However, as noted earlier in the report, a field assessment was not conducted from the subject property, and therefore staff did not consider the totality of a potential substantial adverse impact to privacy. At that time, staff had also not verified the height of deck as measured from the finished floor to the lowest adjacent grade. Upon further review, staff determined that a field assessment at the subject property was necessary to fully evaluate potential privacy impacts.

In August 2025, a field assessment was completed at the subject property to consider the totality of a potential substantial adverse impact to privacy. Staff also contacted the property owners and/or residents at 5602, 5614 White Court and 20521 Wayne Avenue for the purpose of conducting outreach and for the consideration of potential substantial adverse impacts to privacy. Staff also attempted to contact the property owners and/or residents at 20527, 20533 Wayne Avenue but was unsuccessful and a business card was left on the front door to each residence.

During the second field assessment, the property owners and/or residents at 5602, 5614 White Court shared their support for the project, whereas the property owner and/or resident at 20521 Wayne Avenue shared ongoing concerns related to privacy. Staff made observations from the subject property and verified the finished floor deck height does not exceed 24” above grade. Based on the observations, staff deemed there is no potential to result in a substantial adverse impact to privacy for the properties located at the bottom of the hillside area because the natural field of view is the Los Angeles basin and surrounding mountains on the horizon. Although the deck does create a new vantage point that previously did not exist, the properties along Wayne Avenue are located at the bottom of the hillside area and can only be viewed downward from the rear edge of the deck and cannot be observed directly on the horizon within the natural field of view. Staff also notes the deck is designed to match the finished floor elevation of the residence and does not substantially rise above nor substantially extend beyond the natural slope of the rear yard and does not result in a substantial change in the physical conditions which exist in the area, thus limiting the potential to have a substantial adverse impact onto other properties in the vicinity.

In the judgment of staff, removing a portion of the as-built deck to achieve a 10’ setback from the rear property line does not address concerns related to privacy because of the natural elevation and topography of the subject property, and instead would create an unreasonable hardship for the applicant.

Conclusion
In the judgment of staff, the project is consistent with the R-LO land use designation and complies with the objective development standards of the R-1 Zone as well as the planning and design provisions of the Hillside Overlay and does not require further environmental review. Staff made observations from the as-built deck at the subject property and deemed there is no potential to result in a substantial adverse impact to privacy for the properties located at the bottom of the hillside area because the natural field of view is the Los Angeles basin and surrounding mountains on the horizon. Although the properties along Wayne Avenue can be viewed downward from the rear edge of the deck, those properties are located at the bottom of the hillside area and not observed directly on the horizon within the natural field of view. In the judgment of staff, removing a portion of the as-built deck to achieve a 10’ setback from the rear property line would create an unreasonable hardship for the applicant. For these reasons, staff recommends that City Council uphold the appeal and approve MHE24-00037, as conditioned.

c) That the project is Categorically Exempt pursuant to the 2026 Guidelines for Implementation of the California Environmental Quality Act (CEQA), Article 19, Section 15303(e) (New Construction and Accessory Structures), as the project involves an accessory deck and no unusual circumstances exist;
d) That the project complies with the objective development standards of the Single-Family Residential District (R-1) Zone and the Torrance Municipal Code and is consistent with the Low Density Residential (R-LO) land use designation of the General Plan of the City of Torrance;
e) That the project, as conditioned, will not have a substantial adverse impact upon the view, light, air, and privacy of other properties in the vicinity because the as-built deck is constructed at the same finished floor elevation of the residence, does not exceed 24-inches above the lowest adjacent grade, and does not substantially rise above nor substantially extend beyond the natural slope of the rear yard. In addition, the as-built deck does not result in a substantial change to the physical conditions of the site or surrounding hillside area, therefore limiting the potential to have a substantial adverse impact onto other properties in the vicinity; f) That the project, as conditioned, has been located, planned, and designed so as to cause the least intrusion on the views, light, air, and privacy of other properties in the vicinity because the as-built deck is constructed at the same finished floor elevation of the residence, does not exceed 24-inches above the lowest adjacent grade, and does not substantially rise above nor substantially extend beyond the natural slope of the rear yard. In addition, the as-built deck does not result in a substantial change to the physical conditions of the site or surrounding hillside area, therefore limiting the potential to have a substantial adverse impact onto other properties in the vicinity;
g) That the project, as conditioned, provides an orderly and attractive development in harmony with other properties in the vicinity because the as-built deck is compatible in scale, form, and placement with surrounding hillside residential development and represents an improvement to the rear yard;
h) That the project, as conditioned, will not have a harmful impact upon the land values and investment of other properties in the vicinity because the as-built deck is compatible with surrounding single-family hillside development and does not introduce features that would adversely affect neighborhood character or property values; i) That granting such application would not be materially detrimental to the public welfare and to other properties in the vicinity because the as-built rear yard deck complies with the objective development standards of the R-1 Zone and the planning and design provisions of the Hillside Overlay, including provisions intended to minimize visual intrusion and protect privacy in hillside areas, and is consistent with the R-LO land use designation of the General Plan of the City of Torrance; and
j) That the project, as conditioned, would not cause or result in a substantial adverse cumulative impact on other properties in the vicinity because it does not alter established development patterns, viewing relationships, or topographic conditions within the hillside area and complies with the objective development standards of the R-1 Zone and the planning and design provisions of the Hillside Overlay.

NOW, THEREFORE, BE IT RESOLVED that MHE24-00037 filed by Mike Boosler (Shuji and Lori Yamada) for the consideration of a Minor Hillside Exemption to allow an as-built rear yard deck on property located within the Hillside Overlay in the R-1 Zone at 5608 White Court, on file in the Community Development Department of the City of Torrance, is hereby APPROVED subject to the following conditions:

2. That if MHE24-00037 is not used within one year after granting of the permit, it shall expire and become null and void unless extended by the Community Development Director for an additional period as provided for in Section 92.27.1 of the Torrance Municipal Code;

3. That the applicant shall defend, indemnify, and hold harmless the City of Torrance and its agents, officers, and employees from and against any claim, action, or proceeding against the City agency or its agents, officers, or employees to attack, set aside, void, or annul an approval by the City, including, without limitation, an action by an advisory commission, appeal board, or legislative body concerning this discretionary approval. This defense and indemnification shall include the payment of all legal costs incurred on behalf of the City in connection with the application, and the defense of any claim, action or proceeding challenging the approval of the application or the project. The City will promptly notify the applicant of any claim, action, or proceeding and agrees to cooperate to the extent required for an effective defense. In the event a legal challenge to the discretionary approval is successful, and an award of attorney fees is made to the challenger, the applicant shall be responsible to pay the full amount of such an award; and

4. That the applicant shall obtain all building permits and safety inspections necessary for the project.

8F. COMMUNITY DEVELOPMENT – CONDUCT A PUBLIC HEARING TO CONSIDER APPROVAL OF MHE24-00037: MIKE BOOSLER (SHUJI AND YORI YAMADA) Recommendation of the Community Development Director that Planning Commission conduct a public hearing to consider approval of a Minor Hillside Exemption to allow an existing as-built rear yard deck with guardrail on property located within the Hillside Ov erlay in the R -1 Zone at 5608 White Court. This project is Categorically Exempt from CEQA per Guidelines section 15303 – New Construction. (Res. No. 25-006)
Planning Assistant Lujan presented Item 8F.

Chair Kartsonis noted that the Item contained a Supplemental Item.

Mr. Eric Saiki with Saiki Law Group spoke on behalf of his clients, owners Shuji and Yori Yamada.

Mr. Saiki stated that the owners are not unsympathetic to privacy issues that neighbors may have and questioned if the project began with no privacy, could the project have less than no privacy. Mr. Saiki noted that according to the recommendations, there are no issues to light, air, views, but that that privacy was mentioned.

Mr. Saiki stated that the Yamada’s tried to ameliorate any privacy concerns by taking away a staircase that allowed them to access a rear portion of their property and installed approximately (20) Ficus trees to create a privacy screen.

Mr. Saiki requested that approval be made without the Condition of the 10’ setback, and that the appeal the Yamada’s filed be upheld to allow the as-built deck and privacy screen to exist.

Mr. Saiki provided the Commission with property photos for their reference, stating that City staff only looked at the perspective from the down -slope neighbor and that the conclusions made by City staff is erroneous on several regards.

Mr. Saiki stated that the mitigation suggestion does not work as it does not solve anything.

Chair Kartsonis requested clarifications on the project. Planning Manager Oorts replied that in 2024, a complaint was submitted to City staff that an unpermitted deck was being constructed. Staff conducted field inspections, and code enforcement confirmed that the deck was constructed without a permit. A notice of violation was sent to the homeowners requesting proper permits be obtained. Notices were mailed out to adjacent properties informing the residents of the project, and correspondence was received e xpressing concerns of privacy impacts. Staff prepared a staff report with a recommendation to the Community Development Director that there be a Condition of Approval that would add a 10’ setback to the project. The 10’ setback is in line with Code requirements that there be a 10’ setback with any improvements on a property and is in line with Torrance Municipal Code requirements. The Community Development Director approved the recommendation which the applicant appealed.

Plans Examiner Keo stated that due to the project being in the Hillside Overlay, any decks require a building permit and a geotechnical report by Code. 18 18
ATTACHMENT 5

Provided by City Clerk’s Office 01/06/26
Kelly, a resident directly behind the property (down -slope), spoke on her concerns of privacy. Ms. Kelly requested that the deck be 10’ from the property line.

Deborah spoke on behalf of Mr. Philip Chen, a resident directly behind the property.

Concerns were expressed regarding privacy, the unpermitted deck, and the lack of following Code.

Mike Henton stated that for over 55 years, there have been no issue with neighbors until now. Mr. Henton stated that the Hillside Ordinance was written to prohibit massive decks that have direct and significant impacts on the Hillside Overlay area and that the unpermitted deck violates multiple sections of the Hillside Overlay. Mr. Henton expressed concerns on privacy.

Michelle, a next-door neighbor and friend, spoke in support of the Yamada family, stating that the deck is a great addition to the neighborhood and regarding privacy, there was no difference what could be seen before and after the deck’s construction. Ms. Michell requested that the deck be kept as is.

Marjorie, a resident down-slope, expressed support for the project.

Tom Williamson, a resident across the street from the project, stated that he did not see an issue of the deck as there is no difference of views of standing on-grade or on the deck.

Carl Moore, a resident next to the project, stated that there is no difference in views if there is a deck or not. Mr. Moore stated that neighbors have no interest in peeking into someone’s backyard
Saiki stated that there is no portion of the deck that exceeds 24”.

Planning Manager Oorts stated that the deck does exceed 24” above the slope and that it was proven in photos provided in the staff report and was shown on photo boards by public speakers.

Mr. Saiki stated that a permit has been applied for after the construction of the deck and that it was an estimation that the deck exceeds 24”. Chair Kartsonis referenced the staff report and stated that pictures give an indication that the deck exceeds 24”.

Yori Yamada stated that the licensed contractor stated that a permit was not needed, that a permit was applied for once it was found out one was needed and requested that an agreement be reached.

Planning Manager Oorts provided clarification, stating that staff’s recommendation to the Planning Commission is to deny the appeal and to approve the Minor Hillside Exemption. A “yes” vote will be in favor of staff’s recommendation with a Condition of App roval that the applicant provide a 10’ setback from the rear property line. A “no” vote will uphold the applicant’s appeal.

RECESS: 9:35 p.m.

RECONVENED: 9:42 p.m.

ROLL CALL: All Commissioners present.

Mr. Saiki stated that he agreed that permits are permanence and suggested that measurements of the deck be taken by the City or City contractor to address objective questions.

MOTION: Commissioner Yeh moved to close the public hearing. Commissioner Turner seconded the motion; a roll call vote reflected 7-0 approval.

Commissioner Obejas stated that he is a believer in the permit process and has not been swayed to remove the mitigation to address privacy concerns. 19 19

Provided by City Clerk’s Office 01/06/26
Commissioner Riggs stated that it is prudent to take care of the project in the right way for safety purposes.

Commissioner Turner stated that the geotechnical report is crucial to understanding if the project is built to proper code.

Commissioner Borgialli stated that aside from privacy, the concern is safety for residents below from water erosion. Assistant City Attorney stated that the geotechnical study will address this if the Commission upholds staff’s recommendation. Planning Manager Oorts confirmed.

MOTION: Commissioner Obejas moved to deny the appeal and approve MHE24 -00037 as written. Commissioner Turner seconded the motion; a roll call vote reflected 7-0 approval.

RESOLUTION: Planning Assistant Lujan read the title of Resolution Number 25 -006, a Resolution of the Planning Commission of the City of Torrance, California, denying an appeal and upholding a Community Development Director approval of a Minor Hillside Exemption as provided for in Division 9, Chapter 1, Article 41 of the Torrance Municipal Code to allow an existing as-built rear yard deck with guardrail on property located within the Hillside Overlay in the R -1 Zone at 5608 White Court.

MOTION: Commissioner Obejas moved to adopt Resolution Number 25 -006.

Commissioner Borgialli seconded the motion; a roll call vote reflected 7-0 approval.

Project Site

The subject site is located on the east/southeast side of White Court, as part of the White Court cul de sac, west of Wayne Avenue. From east to west/southwest, White Court slopes up from Wayne Avenue before flattening at the end of the cul de sac. As such , the subject site sits slightly higher
than the property directly northeast, but sits on relatively the same grade as the properties southwest.

Also, White Court is much higher than Wayne Avenue, so the properties on White Court sit at a significantly hig
her grade than those on Wayne Avenue. The subject site itself is relatively flat before sloping down in the last 10
’
at the rear of the property.

As
-
Built Deck

The project proposes to permit an existing as
-
built rear yard deck
with guardrail. Per the plans, the
deck totals 1,755 square feet. The deck is mostly raised 18” above grade

with the
rear end
cantilevering 24” above grade. The deck

extends from the rear of the home to
wards

the rear property
line, with portions as close as approximately 8” to the rear property line. The Code allows decking no more than 24” above grade to extend to property line. The guardrail is the required 42” height.

In February 2024, a Complaint (COM24
-
00114) was filed for unpermitted work, including the deck, guardrail/fence, stairs, and drainage. Planning staff has been in contact with the applicant related to the Complaint since May 2024, and the subject request wa s submitted July 5, 2024. The subject
request is intended to address the Complaint and have the project permitted.

Hillside Overlay

In the Hillside Overlay, residential development is permitted with approval of the Community Development Director provided the requirements listed in Section 91.41.7 of the Torrance Municipal Code are met. To determine the proposed
projec
t will not have a significant adverse impact on the
view, light, air, and privacy of properties in the vicinity, and there is no significant public controversy thereon, notices were mailed on
July

8 , 202
4,

to the registered address of the adjacent property
owners
to the eas
t and west
at
5512, 5602, and 5614 White Court
,
and to the rear/southeast at
20521, 20527, and 20533 Wayne Avenue

(
included within
Attachment
3 ). The notices provide a brief
project description, contact information, availability to review the project plans, and comment period.

In response to the notice,
emails

were received from
20521, 20527, and 20533 Wayne Avenue,
sharing

concerns regarding potential impacts to
privacy, among other concerns

(
included within
Attachment
3 ).

Staff notes that c
omments regarding potential impacts
to privacy are
evaluated based
on the planning and design provisions listed in Section 91.41.6 of the Torrance Municipal Code.

The
other concerns are beyond the purview of staff.

On
July

25 , 202
4 , staff conducted a field assessment at
20521 and 20527 Wayne Avenue

with the
purpose of conducting outreach and for consideration of potential substantial adverse impacts to privacy
. Field assessments were not conducted from other properties due to the proposed location
of the deck

and, in the judgement of staff, the unlikelihood to have a substantial adverse impact to surrounding
view, light, air
,

and privacy.

Staff was unable to coordinate a field assessment with
20533 Wayne Avenue after several attempts, and therefore those comments will not be evaluated.

are

impacts to
privacy to
her rear yard, living room, and bathroom, among other concerns. Similarly, the property owner at 20527 Wayne Avenue stated concerns with privacy impacts to his rear yard. The property owner at 20527 Wayne Avenue stated that he would be willing t
o consider design alternatives, such as pulling
in the deck away from the rear property line.

This was conveyed to the applicant, and in response, a privacy hedge was installed at the rear property line. Upon seeing the privacy hedge, the two neighbors still had concerns.

In the judgment of staff, based on observations made from the rear yard s

of
20521 and 20527 Wayne
Avenue,
the
as
-
built deck as
-
is

result
s

in a substantial adverse impact to
privacy
.

The deck creates
a new vantage point that was not previously there, as the deck is elevated and extended beyond the natural slope. This new vantage point adversely impacts privacy to the rear neighbors as the deck essentially functions as an elevated viewi
ng platform and allows views into the neighbors’ rear yards and living ar
eas. To mitigate these impacts, staff recommends that the deck be limited to the 10’ rear yard setback minimum.

Staff has concerns with the privacy hedge as the primary mitigation, as landscape related enforcement has been difficult. The recommended reduction to the 10’ rear yard setback creates greater separation and distance thus reducing the ability to view into neighboring properties, and
eliminates the newly created elevated and extended vantage point, and should help alleviate privacy impacts.

Additional Correspondence

As mentioned,
the Complaint (COM24
-
00114) was filed

in February 2024. Staff
had been in contact
with the opposing neighbors

since then, but did not include past correspondence
received prior to
the official submittal of the subject
request
as part of that staff report.

Past correspondence, as well
as new correspondence has been

included for the Planning Commission’s consideration.

CONCLUSION

In the judgment of staff, the
subject deck, as conditioned,

conforms to the development standards of
the Hillside Overlay and
with the reduction,
would not have a substantial adverse impact on the view, light, air, and privacy of other properties within the Hillside Overlay . The reduced deck will not
significantly impact the privacy of the rear neighbors at 20521 and 20527 Wayne Avenue .

The

project complies with the objective development standards for decking

and is consistent with the Low
Density Residential land use designation of the Torrance General Plan. For these reasons, staff
recommends approval of the
request, as conditioned
.

SUBJECT: 5608 White Court
Minor H

ill

side Exemption (MHE24-00037)
The project applicant

,
M

i

ke Boosler (Shuji and Lori Yamada)

,
requests consideration by the Community
Development Director for approval of a Minor Hillside Exemption to allow an existing as-built rear yard deck with guardrail on property located with

i

n the Hills

i

de Overlay in the R-1 Zone at 5608 White Court

.

The development standards for decking as well as the planning and design provisions of the Hillside Overlay are applicable to the project. Staff has determined the project

,
as conditioned

,
complies with
the developments standards and is consistent w

i

th the Low Density Residential land use designation of
the Torrance Genera

l
Plan. The balance of this report provides an overview of the project.

Project Site
The subject site is located on the east/southeast side of White Court

,
as part of the White Court cut

-

de

sac

,
west of Wayne Avenue

.

From east to west/southwest

,
White Court slopes up from Wayne Avenue
before flattening at the end of the cui de sac

.

As such

,
the subject site sits slightly higher than the
property directly northeast

,
but s

i

ts on relatively the same grade as the properties southwest. Also

,
White Court is much higher than Wayne Avenue

,
so the properties on White Court sit at a significantly higher grade than those on Wayne Avenue

.

The subject site i
tself is relatively flat before sloping down
in the last 10 feet at the rear of the property

.

As-Built Deck
The project proposes to permit an existing as-bu

,
the deck
totals 1

above grade and extends from the rear of the
home to the rear property line

,
with portions as close as approximately 8" to the rear property line

.

The
Code allows decking no more than 24

"
above grade to extend to property line

.

The guardrail is the
required 42

ght. Staff notes the northeast elevation on the plans shows the deck ending when the property begins to slope down

;
however

,
neighbo

r
photos and field visits show the rear end of the deck
actually cantilevers over and extends beyond the slope

.

In February 2024

,
a Complaint (COM24-00114) was filed for unpermitted work

,
including the deck

,
guardrail/fence

,
stairs

,
and dra

and the subject request was submitted July 5, 2024

.

Similarly

,
the property owner at 20527
Wayne Avenue stated concerns with pr

i

vacy
i
mpacts to his rear yard

.

The property owner at 20527
Wayne Avenue stated that he would be will

i

ng to consider des

i

gn alternatives

,
such as pulling in the
deck away from the rear property line

.

This was conveyed to the appl

i

cant

,
and in response

,
a privacy hedge was installed at the rear property
line

.

Upon seeing the privacy hedge

,
the two ne

i

ghbors still had concerns

.

In the judgment of staff

,
based on observations made from the rear yards of 20521 and 20527 Wayne Avenue

,
the as-built deck as-is results in a substantial adverse impact to privacy. The deck creates a new vantage point that was not previously there

,
as the deck is elevated and extended beyond the
natural slope

.

This new vantage point adversely impacts privacy to the rear neighbors as the deck essentially functions as an elevated viewing platform and allows views into the neighbors

'
rear yards
and l

i

ving areas

.

To mitigate these impacts

,
staff recommends that the deck be lim

i

ted to the 10' rear
yard setback minimum

.

Staff has concerns w

i

th the privacy hedge as the primary m

i

tigation

,
as landscape re

l

ated enforcement
has been difficult. The recommended reduction to the 10

'
rear yard setback creates greate

r
separation
and distance thus reducing the abil

i

ty to view into ne

i

ghboring properties

,
and eliminates the newly
created elevated and extended vantage po

i

nt

,
and should help alleviate privacy i
mpacts.

Conclusion
In the judgment of staff

,
the subject deck

,
as conditioned

,
conforms to the development standards of
the Hillside Overlay and with the reduction

,
would not have a substantial adverse impact on the view

,
light

,
a

i

r

,
and privacy of other properties within the Hills

i

de Overlay

.

The reduced deck will not
s

i

gnificantly impactthe privacyof the rear neighbors at 20521 and 20527Wayne Avenue

.

The project
complies with the objective development standa

r

ds for decking and is consistentwith the Low Density
Residential land use designation of the Torrance General Plan. For these reasons

,
staff recommends
approval ofthe request,as condit

i

oned.

53 Dear City of Torrance,

We have serious concerns about the detrimental impact of recent backyard deck construction at 5608 White Court.

We believe that the reckless and cavalier approach to the structure’s installation threatens all homes on the
downslope side which are adjacent, namely those homes on Wayne Ave.

Exhibit One:

Pictured in this photo is a drainage pipe which redirects surface water backwards away from the street toward the backyard neighbor.

Why this matters:

This arrangement conflicts directly with the details outlined in the Hillside Overlay. Specifically: 9.41.9 https://www.codepublishing.com/CA/Torrance/html/Torrance09/Torrance0901.html#:~:text=91.41.9%20DEVELOPMENT%20STANDARDS,the%20 pro posed
%20project
.

The documented drainage arrangement collects, concentrates and redirects surface water away from street and storm drains where infrastructure is designed to evacuate such run -
off and instead sends it to
accumulate in a slopeside which is untested for acco
modating such water volume. The residents note
that their backyard floods, following this drains appearance.

34 54
54 Included is an aerial of likely water collection surface.

The highlighted boundary in Yellow outlines all rearward surfaces east of the roofline ridge that collect surface water including the new deck surface. Combined this is likely 2000 square feet of rainwater collecting funnel which redirects water toward the

backyard neighbor. This likely results in hundreds if
not thousands of cubic feet of run
-
off to be sent into the slope
-
side.

Why this matters:

The slope side as prepared on the Wayne avenue

side at 20527 Wayne, consists of only ice plant
succulents. These provide only topsoil preservation. As succulents they protect the uphill neighbor from risk of fire travelling uphill. However, these plants are not effective at maintaining slopeside integ rity.

35 55
55 https://www.southbayparks.org/journalandnewsletter/2023/2/13/so -
whats
-
wrong
-
with
-
ice
-
plant#:~:text=While%20the%20original%20plant%20may,up%20to%206%20inches%20deep .

Had the uphill neighbor consulted the downslope neighbor of their construction plans, perhaps there might have been an amicable way to shore up the integrity of the slope. Retaining walls or appropriate vegetation could be planned to improve the soil inte
grity. However, the construction of the decking and
redirect of gutters and deck surface collect and send water toward the backyard neighbors on Wayne suggest no such consideration was made. There is a real -
world, material risk that copious amounts of
rain
water after an El Nino season could saturate the slope and be a ticking time -
bomb until a
subterranean shear
-
plane allows the hillside to flow, slide, shear or descend catastrophically into the homes on Wayne below. Such an outcome would likely result in

1. Property damage

2. Loss of property value to all nearby

3. Red
-
tagged lot and adjacent lots

4. Negative property value requiring stability studies

5. Demolition, in order, to rehabilitate with heavy machinery

6. Uninsurability of all homes in the vicinity

7. Injury or Death

Why this is a realistic concern.

We have had recent property destroying events here locally in our neighboring city.

In this case in Rolling Hills Estates, preparation for adjacent areas was prioritized. No such measures were afforded in our case. No notice given. No accommodation. No collaboration. No opportunity to discuss and work together as a team. No concern afford
ed neighbors. Not only is this un
-
neighborly
-
like
behavior, we suspect it is not to code.

Secondary Impacts:

Loss of Privacy

Our residents submit these photos as indicators of intrusion into their privacy.

37 57
57 Witness the workman who is not even near the deck’s edge. Lower body half obstructed. Standing in the middle of the deck far from the handrail communicating with hand signals to the residents who were not in the backyard but rather indoors behind glass in
their dining room.

If dining room, house interior privacy is not enough of an invasive infringement, witness this capture from the master bathroom shower. Again, workman

in plain view. 5608 White Court has since planted
landscaping at the handrail’s edge of the deck. (not pictured) Such low growing shrubbery protects their privacy, however this foliage is not of human height and does nothing to offer privacy to neighbors surrounding as handrail height is only 42 inches and any human can easily peer over, down into the downslope neighbors’ homes, windows, bathrooms, bedrooms.

We have no confirmation that the neighbor at 5608 White Court has conformed to code regarding surface water, run
-
off management. We have grave concerns about the
welfare

of our residents, the
value
of
the properties downhill from 5608 White Court, the future insurability

of said properties, the

safety
of
the homes’ residents, and the

privacy

of all residents downhill from 5608 White Court. These concerns seem to be indicated in the guidelines required for Hillside Overlay construction approval.

https://www.codepublishing.com/CA/Torrance/html/Torrance09/Torrance0901.html#91.41:~:text=91.41.6%20PLANNING%20AND,in%20the%2 0vicinity
.

38 58
58 Likely Homes affected by 5608 White Court’s deck construction.

These are merely the homes in the immediate vicinity whose privacy will be affected by direct line of sight. Should slide, soil movement or liquefaction be recorded. It is likely that every home on Wayne avenue will find that they are no longer insurable
due to slide risk. Ordinarily slide risk is not a naturally occurring thing, however this construction is a man
-
made development which artifically affects the land.

It provides for
unnatural

collection of surface water and redirects it to places it was n ever intended nor
designed to safely accommodate.

This danger is easily avoided simply by adhering to code, or collaborating with neighbors. The deck construction at 5608 White court involved none of these. The slide danger is left to the downhill residents to contend with, unexpected, unplanned and unbud
geted for. We feel this is patently unfair, and adverse to the neighboring residents. Might we remind all those involved that while catastrophic to the downhill neighbors, any such slide and soil integrity problems that occur on this hillside occupied by 5 608 White
court will also adversely affect the inhabitants of that household on the uphill side at 5608 White Court.

This is a collective concern for all those in the vicinity including the owners of 5608 White Court and all such oversights must be remedied.
