RECOMMENDATION
Recommendation of the Finance Director that City Council:
1. Conduct a public hearing; and
2. Adopt a RESOLUTION authorizing and directing the Los Angeles County Assessor to include delinquent solid waste fees as a special assessment to be collected at the same time and in the same manner as county taxes; and
3. Adopt a RESOLUTION authorizing and directing the Los Angeles County Assessor to include delinquent sewer discharge fees as a special assessment to be collected at the same time and in the same manner as county taxes; and
4. Adopt a RESOLUTION authorizing and directing the Los Angeles County Assessor to include delinquent water usage fees as a special assessment to be collected at the same time and in the same manner as county taxes.

DISCUSSION
On April 12, 2011, your Honorable Body approved Ordinance 3745, adding Section 43.2.14 to the Torrance Municipal Code (“TMC”). This ordinance stipulates that unpaid delinquent solid waste fees shall constitute a lien on the property to which the solid waste collection services are provided and may be collected as a special assessment against the parcel, along with the property taxes. This applies to delinquent fees that remain unpaid for a period of 60 days or more.
On June 18, 2013, your Honorable Body expanded the program to include the collection of delinquent sewer discharge fees by approving Ordinance 3764, adding Section 72.4.6 to the TMC. This ordinance also stipulates that unpaid delinquent sewer discharge fees shall constitute a lien on the property to which the sewer discharge services are provided and will be collected as a special assessment against the parcel, along with the property taxes. This applies to delinquent fees that remain unpaid for a period of 60 days or more. 1 City Council

On October 25, 2022, your Honorable Body expanded the program to include the collection of delinquent water usage fees by approving Ordinance 3906, adding Section 76.2.26 to the TMC.
This ordinance also stipulates that unpaid delinquent water usage fees shall constitute a lien on the property to which the water usage fees are provided and will be collected as a special assessment against the parcel, along with the property taxes. This applies to delinquent fees that remain unpaid for a period of 60 days or more.
Adding these delinquent solid waste, sewer discharge and water usage fees to the property tax roll has proven to be very successful and cost effective. Since Fiscal Year 2022-23, collection rates have been 97.5%. The table below outlines the collection rates since Fiscal Year 2022-23 for the delinquent accounts placed on the property owners’ tax bills:

Before tonight’s public hearing, staff received a delinquent utility account reports from the utility contractor as of April 23, which was used to notify the individual property owners and service recipients by letter sent on May 19 as well as by public notice in the Daily Breeze on July 1, 2026. The letter included the details on the balance owed and the public hearing to take place. On June 12, a second report was produced by the utility contractor to account for any payments made between the first notice sent in May and the preparation for tonight’s council meeting staff report. This report was used as a source document for Exhibit A for the three resolutions before you tonight.
If a customer remits a payment in full by September 4, 2026, the delinquent balance will not be included in their property tax bill. Otherwise, the unpaid fees will be transferred to the County Assessor, and a lien will be placed on their property which remains until the delinquent account is paid or the property is sold. Before the property is sold, the outstanding delinquent solid waste, sewer discharge and water usage fees must be paid in full along with any outstanding penalties.

ANGELES COUNTY ASSESSOR TO INCLUDE DELINQUENT
WATER USAGE FEES
AS A SPECIAL ASSESSMENT TO BE
COLLECTED AT THE SAME TIME AND IN THE SAME MANNER

to collect delinquent
water usage
fees via a special assessment to be
collected with county taxes; and
WHEREAS

the City of Torrance has established special assessment account number 272.56
with the
Los Angeles
County
Assessor
to collect the
delinquent
water
usage
fees;
and
WHEREAS
,
the City of Torrance and its contractor Minol, Inc. have made numerous attempts to collect the delinquent
water usage
fees; and
WHEREAS
,
pursuant to Sections
72094, 72100, 72101 and 72102
of the California
Water code
,
notice was provided to all delinquent account holders of a public hearing to consider the list of proposed special assessments; and
WHEREAS

the duly

noticed public hearing was

, the City Council of the City of Torrance does hereby resolve that:
Section 1.
The list of properties and the amounts to be collected, attached as Exhibit “A”, shall be forwarded to the Los Angeles County Assessor for posting on the tax bill as a special assessment. Exhibit “

” may be modified by the Finance Director to delete those parcels where delinquent bills are paid prior to being submitted to Los Angeles County.

The City Clerk shall
