Recently, we heard silly Steve Madrone was banging on doors to get his opponent's signs taken down.

Then, we heard silly Steve Madrone got the City Manager and City Clerk to call round. This would be funny too, but we heard about a "bribe" offered?
Larry Doss for Supervisor
We need truth and transparency in City and County Goverment, not backroom government deals and small business political abuse.

Silly Steve Madrone took the City's covid hysterics and attacks on our local businesses to the County
Supervisors - they said he and the City were wrong! He
is wrong for Trinidad, wrong for our small businesses,
and wrong for our government.

CITY OF TRINIDAD
RE: T.O.T. Update
ATTENTION: City Manager
Eli,
After the muddled City responses from Tuesday's City Council meeting April 12, 2022, I request a court evidence reliable, clear and concise reporting of the following items. Please provide supporting references and links to our current City of Trinidad Codes. Please provide any City attorney opinion and direction that has been accepted regarding litigation exposure.

1. Payment: What the City now requires, under fine and penalty, and risk of litigation, of our City businesses, specifically those businesses which it is requiring to charge, collect, account, file, and pay for their guests' hotel tax, or as we call it, transient occupancy tax, TOT.
a. Responsibilities for Payment
b. Updated Rate
c. Updated Filing Requirements / Forms
d. Penalties for Late Payments and Filings
under fine and penalty, and risk of litigation, it has required to charge, collect, account, file, and pay for their guests' hotel tax, or as we 2. Refunding: What the City now requires, itself under risk of litigation, of our City businesses, specifically those businesses which call it, transient occupancy tax, TOT.
a. How we handle refunding the City's unconstitutional increases it has required us to charge, collect, account, file, and pay under penalty of fine and threat of litigation.
right and make every effort to return all improper tax increases to our guests. b. Whether or not you agree with me, that regardless of any stated probability of a statute of limitation, the City will do what is

3. Where we are going with this issue. If the City is writing an increase in the tax, to present to the electorate in November, I want to know.

In January, I requested City signature and date requirements and whatever filing paperwork is necessary for a citizen initiative to put on the next ballot. As I gather signatures for my City councilman campaign, I would also like to gather signatures for a few initiatives. And yes, one would be keeping the tax at 8% for 7 years and additionally requiring the City to return all improperly raised guest tax increases since 2011 - first to our guests and the balance to a fund that supports the businesses which the City required to charge, collect, account, file, and pay under penalty of fine and threat of litigation.

I request it be sent to each business required to collect, account, report and pay TOT and to our B&B Hotel this time too.

Re: Resolution 2021-14 - T.O.T. - TOURIST OCCUPANCY TAX RATE TO 12% Preliminary Action by City Tax Administrator
You are receiving this letter because you are involved in transactions with the City of Trinidad Tourist Occupancy Tax (TOT). (Trinidad Municipal Code Chapter 3.20) As you may know, Resolution 2021-14 was adopted by the City Council on November 9, 2021, which was entitled "A RESOULTION OF THE TRINIDAD CITY COUNCIL TO INCREASE THE TOURIST OCCUPANCY TAX RATE TO 12% EFFECTIVE JANUARY 01, 2022" (see attached).

The City Manager and City Tax Administrator (City Clerk), upon consultation with the City Attorney's office, has determined at this time to not implement the TOT increase to 12% as provided for in Resolution 2021-14. The matter will be presented to the City Council for consideration and potential rescission of the Resolution at a future City Council meeting.

This is preliminary action by the City Tax Administrator. As such, please be advised that the City Tax Administrator at this time intends to collect the TOT at the previous rate set by the TOT Ordinance (i.e., 10%) from and after January 1, 2022, not at the increased rate. We apologize for any inconvenience this may create.

Should you have any questions please do not hesitate to contact me.

Eli Naffah

REGARDING: RESOLUTION 2021-12: Disruptions and Findings, only under certain circumstances provided the legislative body makes certain findings emphasis added
Disruptions. At last month's Council meeting, Tyler and I were "locked out" and could not participate. I assume this was not intentional and others were similarly unable to "attend" online.

Per Assembly Bill 361(2021), the meeting should have been stopped until this was corrected.

Code § 54953 (e) (2) (A)- (B).) Additionally, where there is a disruption in the public broadcast of the call-in or internet-based meeting service, the legislative body must cease and take no further action on agenda items until public access is restored. (Gov.

Code § 54953 (e) (2) (D).)
Findings are misleading and not adequate. Particularly, number 2. While the California Legislature did vote against Republican led efforts to end the Governor's 2 year long "State of Emergency" last month, that is but the primary requirement.

AB 361 (1), "... when a legislative body of a local agency holds a meeting during a declared state of emergency, as that term is defined, when state or local health officials have imposed or recommended measures to promote social distancing, during a proclaimed state of emergency held for the purpose of determining, by majority vote, whether meeting in person would present imminent risks to the health or safety of attendees, and during a proclaimed state of emergency when the legislative body has determined that meeting in person would present imminent risks to the health or safety of attendees, as provided." This May 2022 City of Trinidad, City Council Meeting and future meetings should be held in public, in Town Hall.

Eli,
Please provide a written update - it's been almost 4 months since I've formally requested City forms, documentation, and procedures.

1. Please confirm in writing, as you told Tyler and I, that the City is concurrently gathering this information as it is preparing to introduce a 4% increase in T.O.T. to the Electorate.

2. Please update us in writing, what has been done, when we can expect the documents and information, and when the deadlines are.

CITY OF TRINIDAD
ATTENTION: City Manger, Tax Administrator, City Council Thank you Eli.

I still request, as I have since January, you provide me our voter initiative procedure clarification, signature count and deadlines. The City should know this, and not have to wait for some materials from the County. I'll say it again, more formally now, it seems the City of Trinidad would do right by consulting and conforming to the State of California, regarding the Initiative Process, not the County of Humboldt.

I'll further and separately take up my County of Humboldt, Measure J (June 7, 2022) concerns, but as the City of Trinidad Council, you, our city manager, our tax administrator and our city attorney have demonstrated some befuddlement around City ordinances and resolutions, particularly increasing and rescinding and refunding hotel tax increases this year, please also take notice:
(emphasis added)

CALIFORNIA CONSTITUTION - CONS
ARTICLE XIII C [VOTER APPROVAL FOR LOCAL TAX LEVIES]

1. General Election: Unlike the County, by "waiting" until the General Election in November 2022, the City may have avoided another possible non-compliance with our State of California Constitution.

SEC. 2.
(b) "The election required by this subdivision shall be consolidated with a regularly scheduled general election."

2. Special Tax: Even though it gets placed and spent in the general fund, it seems the Hotel Tax (TOT), which is imposed for a specific purpose, particularly and only on guests who stay with our commercia lodging businesses and our short-term rental properties, is a special tax. It must be approved by a two- thirds vote of the electorate, when it is a legislative referral.

SECTION 1.

Definitions.
(d) "Special tax" means any tax imposed for specific purposes, including a tax imposed for specific purposes, which is placed into a general fund.

SEC. 2.
(d) "...increase any special tax unless and until that tax is submitted to the electorate and approved by a two- thirds vote."

3. Initiative Power for Local Taxes: The City of Trinidad shall not "... impose a signature requirement higher than that applicable to statewide statutory initiatives." SEC. 3.

Initiative Power for Local Taxes, Assessments, Fees and Charges. Notwithstanding any other provision of this Constitution, including, but not limited to, Sections 8 and 9 of Article II, the initiative power shall not be prohibited or otherwise limited in matters of reducing or repealing any local tax, assessment, fee or charge. The power of initiative to affect local taxes, assessments, fees and charges shall be applicable to all local governments and neither the Legislature nor any local government charter shall impose a signature requirement higher than that applicable to statewide statutory initiatives.

I will, again, strongly suggest the City of Trinidad follow the State of California Constitution. And, further, I strongly suggest the City of Trinidad contact the State of California for our initiative procedure clarification, signature count and deadlines.

https://ballotpedia.org/Laws governing local ballot measures in California The local units of government in California that make the initiative process available are:
• All 361 general law cities, which have a state mandated initiative and referendum process for ordinances.

In 1996, California voters approved a statewide initiative - Proposition 218-that added Article XIII C and Article XIII D to the state constitution and governs taxes imposed by local governments. Article XII C, section 2, provided the following rules for approval of taxes imposed by local governments: (1) general taxes must be approved by a simple majority of voters; (2) general taxes must be put before voters at a regular, general election; and (3) special taxes must be approved by a two-thirds supermajority of Unlike a City tax increase, a citizen initiative has different requirements for when it can be introduced to our Electorate, and how many votes it needs for passage - simple majority - even if it is a special tax.

Taxes imposed by citizen initiatives
Local citizen initiatives can be used to levy taxes in California. Following the approval of Proposition 218 in 1996, the restrictions outlined above concerning special and general taxes were applied to citizen initiatives. In August 2017, however, the California Supreme Court ruled in California Cannabis Coalition v. City of Upland that one provision of Proposition 218-the requirement that general taxes be put on the ballot during regular, general elections contained in Article XIII C, section 2(b) - did not apply to citizen initiatives. The court's ruling argued that the citizen initiative process is separate from the actions of local governments and stated that this meant taxes imposed by citizen initiatives do not fall under the category of taxes imposed by local governments.

The ruling also stated that the local initiative process in California[2] contained a mechanism by which initiatives can qualify for special election ballots and that this provision should not be restricted by Article XIII C, section 2(b), which does not explicitly mention the initiative power. Since Article XIII C, section 2 - which also contains the majority voter approval requirement for general taxes and the two-thirds supermajority voter approval requirement for special taxes-refers to taxes imposed by local governments throughout, this ruling raised questions about whether or not the other provisions of Proposition 218 applied to citizen initiatives.

ARTICLE XIII C [VOTER APPROVAL FOR LOCAL TAX LEVIES]
SECTION 1. (emphasis added)
Definitions.
(d) "Special tax" means any tax imposed for specific purposes, including a tax imposed for specific purposes, which is placed into a general fund
(e) As used in this article, "tax" means any levy, charge, or exaction of any kind imposed by a local government, except the following:

(2) A charge imposed for a specific government service or product provided directly to the payor that is not provided to those not charged, and which does not exceed the reasonable costs to the local government of providing the service or product.

The local government bears the burden of proving by a preponderance of the evidence that a levy, charge, or other exaction is not a tax, that the amount is no more than necessary to cover the reasonable costs of the governmental activity, and that the manner in which those costs are allocated to a payor bear a fair or reasonable relationship to the payor's burdens on, or benefits received from, the governmental activity.

(d) No local government may impose, extend, or increase any special tax unless and until that tax is submitted to the electorate and approved by a two-thirds vote. Positive correlations were stronger in Western than in Eastern European countries.
