Re: Axel Lindgren Memorial Trail CDP Appeal
Discussion/decision on a Coastal Development Permit for continued temporary closure of the Axel Lindgren Memorial Trail (ALMT) due to unsafe conditions.

From: Kathleen Lake and Tom Davies
This letter conveys our strong request for the Trinidad City Council to open both of the city trails, the Axel Lindgren Memorial Trail (ALMT) and the Van Wycke Trail (VWT) as soon as possible. Do not consider or approve further extensions of Coastal Development permits for the Axel Lindgren Trail tonight. The trail is a primary coastal access trail as are other trails in the area that have also been damaged and repaired. Promised repairs apparently have not begun despite the long closure and the City Manager’s promises of opening the ALMT in July. Prior long discussions by the City of Trinidad regarding both of these trails and their repairs appear to have been disingenuous. At this point in time, the closure of these Trinidad trails appear to clearly be a program by the City to close trails, rather than finding solutions to “re-open” trails. Continuing extensions of the CDP’s to allow our trails to be closed have become a regular occurrence and must stop.

Do not approve a CDP any longer for the ALMT.

Thank you,
Kathleen Lake
Tom Davies

Dear City Council:

Below please find and read my public comment that I submitted to the Planning Commission for the July 17, 2024 meeting. At the July 17th meeting, the Commissioners unanimously agreed to not grant an extension for the temporary closure of the Axel Lindgren Memorial Trail (ALMT). I, along with others in our community, am grateful for their decision not to extend this closure.

I hereby request that the City Council supports the Planning Commission’s decision not to grant an extension for the temporary closure of the ALMT. Please advocate for the community, Trinidad businesses, Humboldt County visitors and tourists by opening all City trails as soon as possible.

A couple of weeks ago, I had a discussion with the City Manager about the recent repairs competed on the access trail to College Cove Beach. The City Manager stated he would try to find out who the State Park system used with the possibility of using the same company to repair the ALMT. This seems a logical first step for Trinidad’s ALMT problem.

It has been a year and a half since the ALMT closure. It is unacceptable, after this length of time, that no headway has been made toward remediation.

Trinidad is a beautiful city. The best features of Trinidad are its trails and beaches.

I was told that the Galindo Trail is scheduled to be closed permanently; I am deeply concerned about this news of yet another trail closure in Trinidad. The Galindo Trail is used by many to safely access the beach and pier. I often see children, with their teachers, use the Galindo Trail. I feel no trails should be permanently closed in Trinidad. It seems closing trails has become a slow moving epidemic in the City Trinidad.

The appeal for an extension for the temporary closure of the Axel Lindgren Memorial Trail was initiated by City staff. However, many City residents strongly oppose this closure. As stated at the July 17, 2023 Planning Commission meeting:
“The lack of progress towards repair interferes with the public’s right of access.” Thank you in advance for denying an extension and doing whatever it takes to reopen all of our trails in Trinidad.

Sincerely,
Anita Thompson

Dear Planning Commissioners:

I am writing to request that you vote no on Agenda Item # 4. “Trinidad 2024-09:

Discussion/decision on a Coastal Development Permit for continued temporary closure of the Axel Lindgren Memorial Trail (ALMT) due to unsafe conditions.

Trail closure authorization is proposed for one year while the City works with stakeholders to develop and plan additional repair options. Located at the ALMT; APN: 042-091-005.”
During the past few months at both the Planning Commission and the City Council meetings, it was stated, by the City Manager, that “the ALMT would probably be open in July”. I am surprised and upset that the ALMT was not reopened in July and there is now a request for another extension, this time for one year.

At the April 19, 2023 meeting, the Planning Commission agreed to an extension for the ALMT. One Commissioner was “encouraged by the dialogue” during the public comment section which were made by members of the Tsurai Management Team. During the motion, it was stated that the extension was based on “substantial progress to be made during the initial time period”. At the same meeting, an alternate motion was made with another condition of approval, that the Planning Commission and the City Council receive monthly reports on progress made on the Parker Creek Trail and the Axel Lindgren Memorial Trail.

It is obvious that reopening the Axel Lindgren Memorial Trail is not a priority. The ALMT trail provides public access to the coast; this trail is used by the community and our visitors. The ALMT should have reopened by Memorial Day weekend or as stated by the City Manager, by this July. The Axel Lindgren Memorial Trail was temporarily closed over a year ago with extensions granted based on “substantial progress made”, the criteria for previous extensions was not met, substantial progress has not been made on this project.

Sincerely,
Anita Thompson

Dear City Manager:

This is a request to submit the following in both your written and verbal City Council Staff Supplemental Report for the August 13, 2024 City Council meeting:

Please provide the current total amount charged by Pacific Watershed Association.

It was never reported, although requested several times, the hourly rate charged to the City by Pacific Watershed Association (PWA). Please report PWA's hourly rate.

For the month of August, how many hours has the City been billed so far by Coleman Engineering?
Please include detailed descriptions of services rendered by both Coleman Engineering and Pacific Watershed Association.

Below please find Coleman Engineering consultant charges (approximate, however the data below was reported from your City Council Staff Report Supplemental):

1. Total Coleman Engineering charged from Oct. 2021 – July 2024: $ 751,344

2. Monthly average amount charged from Oct. 2021 – July 2024: $ 22,768

3. Total charged from January 2024 – July 2024: $ 80,479

4. Monthly average charged from Jan. 2024 – July 2024: $ 11,497

5. Coleman Engineering weekly average charged for 2024: $ 2,874 Suggestion for recruiting a T3 Water Treatment Operator: Contact California State Water Board and find out whether or not they can assist the City with finding a Chief Plant Operator. Coleman Engineering’s consultant fees continue to be exorbitant and unsustainable. In addition to Coleman Engineering, the City is also paying water plant personnel to operate its water plant.

Thank you in advance.

Dear Mayor and City Council,
The Planning Commission made the correct decision to deny an extension of the CDP for “temporary” closure of the Axel Lindgren Memorial Trail (ALMT). The concept of “temporary closure” of trails has been badly abused since the July 2019 closure of the Van Wycke Trail, which is still closed. There is no reason that the ALMT cannot be temporarily repaired and put back in service quickly. This is supposed to be the main trail to the beach under the litigation settlement between the City and John Frame. It is the main trail that our tourists use to get to Old Home Beach. Any discussions that have to be held regarding a long term fix for the trail can occur after the trail is back in service.

The bigger issue is that it is time for a tribe to step up and agree to purchase the 12.5 acres from the City.

The City should not own this important cultural resource. If the Yurok Tribe is not interested in acquiring on the terms the City offers, it is time to look for another tribe that might be interested in accepting it.

The appeal of the Planning Commission decision should be denied.

Hi Gabe,
Please distribute my email below to the City Council for their meeting tomorrow night (8/13/24) for Agenda Item #3 re: the continued closure of the ALMT.
************************************************************************************ Dear City Councilmembers:

Please do not allow for the continued closure of the ALMT. The ALMT has already been closed for 1-1/2 years with no clear plans for reopening. This is exactly what has happened with the Van Wycke Trail— where it is being repeatedly closed with no concrete plans for repairs or reopening.

The trails in Trinidad are a unique and important feature of Trinidad’s character and charm. Allowing continued “temporary” closures is very misleading and unfair to the public, because it implies the trails will be reopened in a reasonable amount of time. The term “temporary” is being abused, here, because these serial closures have become de facto permanent closures of our trails.

These trail closures are troubling, because it means the public no longer has easy, scenic, peaceful public access to the beaches, pier, Trinidad Head, etc. We are being asked to trade traffic-free, scenic trails for a pedestrian walkway on a busy, noisy, urbanized street (Edwards).

I am asking this City Council to please uphold the Planning Commission’s denial for the extended closure of the ALMT, so that the City can move forward with the necessary repairs so the ALMT can be reopened as soon as possible. I’m hoping, too, that the City Council is mindful that the VWT has been closed for over 5 years now, even though the upslope property owners are amenable to re-routing the trail upslope away from the eroding coastal bluff. Please pursue the re-routing solution so the public can once again freely use the VWT.

Thank you for considering my comments on this important issue concerning public access to our coast.

PROLOGUE
''The Fifth Amendment to the Constitution says ' ... nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."' In 2020, the City of Trinidad California seems to have performed what's called a taking (Arndt 5.9.1 Takings Clause) on several local businesses. The City mostly closed Short Term Rentals, STRs, with a 90 day Moratorium Resolution and a 90 day Moratorium Urgency Ordinance - that's six months of lost revenue, in one year.

We notified the City we would not comply with any STR Moratoriums, but we would remain open under State guidance and designation as an "Essential Business." City Manager, Eli Naffah confirmed our status to us personally and also at a City Council Meeting. Nothing happened for months.

Probably anticipating our *UNcompliance, they tried to legislate my business into their bogus and law breaking STR Moratorium Urgency (Zoning) Ordinance. They went after me and my business with smears, lies, and law-fare. lnstea.d of charging and fining us for each ordinance violation the City filed two lawsufts. Why? Their scheme to "approve" which guests could stay would force us to break health and safety protocols and California Personal Privacy laws, we did not comply. I told them we are not an STR. Non-compliant, we did continue to pay our guest Transient Occupancy Tax, TOT, upon each guest's checkout. We had, with permission, used this procedure for the last Quarter of 2020. Ooops, the City accepted our non-compliance and regular terms - they collected TOT payments (CA CMI Code § 1565-1590) throughout their moratorium and knew exactly how many guest stays we had - ordinance "violations" (5). t
In addition to our Federal and State Constitutions and Bill of Rights, as part of Q!S8, in the Commercial Facilities Sector, Lodging, the Federal government supported us remaining open during the 2020 "pandemic." The State had set up Regional Areas of Counties with independent provisions for closures, but our Region enjoyed full red tier openings - churches, gyms, restaurants, etc. In fact, when requested, even the Humboldt County Supes rejected the City's request to join them in closing STRs by ordinance. County Health explained it was a State Public Health Department decision, not a local legislative one-even with all Trinidad's experts.

When Planning Commission Chair Richard Johnson asked about the County's reaction to the City's STR moratorium ordinance request, Councilman Jack West did appear to lie by reporting only that the County did nothing. Shame on you Jack.

PART1

LAW-FARE
Instead of charging and fining us for each ordinance violation, the City filed two lawsuits.

Why?
In fact, until this incident is investigated and this question is fully answered, there will be no resolution and no Justice.

The City decided to blindside and smear me with a bogus Workplace Violence Harassment Restraining order and a second lawsuit that was partially an Injunction against having an STR as my business. Of course I don't own an STR, so that part was easy.

The City spent tens of thousands of our dollars. Councilman Steve Ladwig voted to continue to trial, but the rest of the current City Council (thankfully) voted to drop it with a $5,000.00 settlement. Still like extortion, but I saved it and my business thousands.

How did the 2020 City Council justify threatening and then taking selective adverse legal actions? What did they truthfully want to happen? Only they can provide these answers under an official investigation, testifying at a City Council Hearing under Oath.

As an "essential business" our commercial bed and breakfast hotel is part of the federally defined commercial sector of our nation's critical infrastructure, QSA. It cannot be preemptively closed or illegally restricted by the Trinidad City Council's STR Moratorium Ordinance. The definition of an STR is defined by California Law, not some seemingly hackish City attorney in his bogus ordinance.

Again, I ask, "Why not just cite us for non-compliant stays?" t
Why fight back?
Trinidad, California is my home. The Trinidad Bay Bed and Breakfast Hotel is my home. We've hosted thousands of guests over the past seventeen years.

Previous owners have worked unimaginably hard for this business and our community, and visiting guests. We fought City litigation for our guests, our business, our home and yes, even for our City.

Appeals
Challenging Council decisions, actions, resolutions and ordinances must be at least as easy as passing them.

This can become standard operating procedure printed on each agenda, much like we do with instructing PUBLIC COMMENT, ITEMS FROM THE FLOOR, and CONSENT AGENDA Appeal information is especially important to include with legislation and when eommunicating with those it impacts.

At each stage of governance, residents have an absolute right to due process, including the right to fair and impartial appeal process.

PART2

HEALTH &SAFETY
The City's bogus STR zoning ordinance had nothing to do with keeping us, our guests, or the community safe.

With malice, it deliberately and irrationally used fear, fraud and pretext to force compliance.

Under phony nuisance and health threats, the City seems to have engaged in retaliatory conspiracy, fraud, violation of Rights, malicious prosecution, and defamation of character. How do we prevent this from happening to another Trinidad resident or business?
Truth and Liberty or Control
The misuse and abuse of judicial powers, and selective prosecution are never okay. That it was used in our tiny city should not go without accountability and the Truth being disclosed. The current Trinidad City Council should simply obey their oath, obey their ethics, and open an official inquiry.

We notified the City we would not comply with any STR Moratoriums, but that we would remain open under State guidance and designation as an "Essential Business." City Manager, Eli Naffah, confirmed our status to us and at a Council Meeting. Nothing happened for months. Probably anticipating our *UNcompliance, they decided to try and legislate my business into their bogus and law breaking STR Moratorium Urgency (Zoning) Ordinance. They went after me and my business with smears, lies, and law-fare.

The 2020 anti-STA Resolution and Ordinance go beyond a casual disregard of years of progress and compromise. City Council and Staff have disingenuously moved against inalienable rights and freedoms protected by our Federal and State Constitutions and our Bill of Rights. Illegitimately declaring an "emergency" or urgent nuisance and health threat with a Frankensteinized zoning ordinance does not excuse suspending inalienabte Rights and Liberty.

Everyone knew better.

The closures proved harmful not helpful during the 2020 "coronavirus pandemic." By the end of 2020, everyone knew better. The County tried to help, but Councilmemeber Jack West withheld their information. Upon County rejection, and per law, duty and the STR Urgency Ordinance promise, it should have been reviewed and rescinded. There never were any closures for lodging in our Region - other than those attempted here by Trinidad's apparent "experts." Staff that were on that call and said nothing are complicit too.

The 2020 City Council and Manager lied. A knowing lie of omission, they kept the County Supervisor's, and Dr. Hoffman's information from us. Why? To keep their retaliatory STR ordinance and plans for law-fare in place for the 90 days they illegally wrote it for? https:/ /humboldt.granicus.com/MediaPlayer. php?view id- 5&clip id-1460&rneta id-303432 @ 1 :50:55 Dr. Hoffman, County of Humboldt Health Officer: saying closure and restrictions by health order are not needed. Unnecessary. We already have a State advisory on travel in place. If ICU capacity goes down to less than 15%, State of California orders on travel restrictions and closures would kick in. *UNCOMPLIANT
Consent Through Compliance? To withhold consent, one must not comply. Statism attempts to force compliance through coercion, not Constitutional consent.

Uncompliant means something that is not able to be complied with. Uncomp!iant refers to a refusal to comply with a request or demand, rather than a failure to comply. Uncompliant can also describe a person who is difficult to work with or one who resists authority.

Consent can not be mandated.

It must be freely granted. Consent cannot be coerced, compelled, commanded or demanded. "If compliance implies consent to be governed by bad legislation, then refusing to comply withholds consent: become ungovernable. Compliance requires consent, not coercion." https://substack,coml@burnjngbright CIVIL CODE - CIV CHAPTER 3. Consent (1565 - 1590) 1566. A consent which is not free is nevertheless not absolutely void, but may be rescinded by the parties, in the manner prescribed by the Chapter on Rescission. 1589. A voluntary acceptance of the benefit of a transaction is equivalent to a consent to all the obligations arising from it, so far as the facts are known, or ought to be known, to the person accepting.

The City consented to my terms. Rejecting their STR Moratorium Ordinance, but continuing as usual with TOT payments. It was their voluntary acceptance of TOT during their Ordinance that was the benefit of a transaction CIV § 1589. • Retaliating against our City lodging businesses, the Trinidad Bay Bed and Breakfast Hotel, and me personally, the 2020 Council perniciously colluded with Staff in closed session meetings to coercively restrict our lawful business with explicit threats, an illegal ordinance, and law-fare. An Ordinance which, if we complied, would force us to break guest's and our CA Civil Personal Rights. Absolutely not.

CIVIL CODE - CIV DIVISION 1. PERSONS [38 - 86) PART 2. PERSONAL RIGHTS (43 - 53. 7) ( Part 2_enacted 1872. )

53.5. (a) Notwithstanding any other law, except as specified in this section, an innkeeper, hotelkeeper, motelkeeper, lodginghouse keeper, or owner or operator of an inn, hotel, motel, lodginghouse, or other similar accommodations, or any employee or agent thereof, who offers or accepts payment for rooms, sleeping accommodations, or board and lodging, or other similar accommodation, shall not disclose, produce, provide, release, transfer, disseminate, or otherwise communicate, except to a California peace officer, all or any part of a guest record orally, in writing, or by electronic or any other means to a third party without a court-issued subpoena, warrant, or order. (c) "Guest record" for purposes of this section includes any record that Identifies an individual guest, boarder, occupant, lodger, customer, or invitee, including, but not limited to, their name, social security number or other unique identifying number, date of birth, location of birth, address, telephone number, driver's license number, other official form of identification, credit card number, or automobile license plate number. (e) "Court issued subpoena, warrant, or order" for purposes of this section is limited to subpoenas, warrants, or orders issued by a judicial officer. An administrative subpoena, warrant, or order is not sufficient for purposes of this section.

We Can Disagree and Coexist
Disagreement is unavoidable. Its importance in our lives is unquestionable. Turning disagreement into something constructive, as opposed to destructive, is undeniably the better way forward. We must move forward together with our reciprocal obligations and duties in mutual respect and mutual governance.

May no other suffer the law-fare, lies, and abuse of a
