7.DISCUSSION ITEMS

7.1 STAFF REPORT – Truckee River Legacy Trail Phase 4A (C0702) Construction Bidding Authorization and Project Update.

Recommended Action: Authorize Town Staff to advertise the Truckee River Legacy Trail Phase 4A Project (C0702) for construction bids for construction in summer 2022 and authorize the Town Manager to enter into a cost sharing agreement with the Truckee Donner Public Utility District and Truckee Donner Land Trust for construction of a new waterline through the project area, as outlined in this staff report.

Jessica Thompson, Senior Engineer, presented from the staff report (presentation is on file with the Town Clerk).

Council Discussion:
Trail section J is part of the Master Plan and if Hilltop is developed, those developers would not be responsible for building Trail Section J, it would be the responsibility of the Town. Linkage and separation from roads and sidewalks are important to the overall vision of the Legacy Trail.
Upcoming projects would not exceed Measure R funding and would be adequate to fund including J line without detracting from other projects. A small shuttle bus could work with the fire lane and would need to work with Truckee Donner Land Trust (TDLT) for bike share parking. This project will come back to Council for the contract award. Staff looked at alternative locations for the bridge, and selected the current location due to; bank elevation, distance from river bend (which can cause scour and turbulence), needs a shorter section of bridge, flow on and off trail, and park design. Bridge design and location were discussed at a previous Council meeting. TDLT as 75% funding partner for bridge made it feasible to include with this phase.

Mayor Henderson opened the item for public comment.

Written comment received from:

Monty Cleeves (2) Stacy Jeremias
Verbal comment received from:

Lauren Cleeves
Mayor Henderson closed public comment.

Dan Wilkins, Public Works Director/Town Engineer and Jessica Thompson, Senior Civil Engineer addressed public comment questions.
Staff was aware of scoring metrics for grant applications, but not aware of how many other competing applications.
TDLT was interested in unique structure design and formed a bridge committee and had more of a role in the bridge design process as 75% funding partner. Contractor must have experience in similar bridge construction.

Trail section J is essential despite its high cost. Council can have future discussions of cost savings if needed, and Measure R is important due to lack of grant funds.
Don’t want to lose opportunity to provide alternative transportation options.

The staff recommendation was moved by Council Member Klovstad, seconded by Council Member Zabriskie, and adopted with the following vote:

Ayes: Council Member Polivy, Vice Mayor Romack, Mayor Henderson, Council Member Klovstad, Council Member Zabriskie.

Noes: none.

Absent: none.

Abstained: none.

The motion passed unanimously.

7.2 STAFF REPORT – Building Reach Code Consideration Process Update.

Recommended Action: 1) Receive an update from staff on the proposed building reach code consideration process; and 2) Direct staff to initiate a request for proposals for a reach code consultant to facilitate the building reach code consideration process.

Sara Sherburne, Sustainability Program Analyst, presented from the staff report (presentation is on file with the Town Clerk).

Council Discussion:
Truckee is interested in considering reach codes ahead of the California energy code update because we have an idea of what the 2022 update will bring and statewide reach code teams encouraged staff to do it in conjunction with South Lake Tahoe to use same resources. It is its final updating stages and consultants know what is in the code.
Truckee is in a unique climate with unique occupancy patterns and doesn’t fit in general allowances and prescriptive measures, so this is an opportunity to develop a reach code specific to Truckee.
Staff has been having conversations with South Lake Tahoe, but timing did not allow for a joint request for proposal (RFP). If the same consultant is selected, we could do a joint process. We do have some joint stakeholders, but not all and stakeholder and community input process is critical.
The state is mainly focused on new housing in code update, and reach could also address existing structures.
Cost effectiveness includes both the cost of carbon and savings for consumers. Council passed greenhouse gas emission reduction targets in 2017, but project is proposed now because there is more support at this time. Could potentially need stricter requirements to meet goals in a shorter timeframe if we wait to implement.
Staff foresees $40,000 in budget covering everything. The RFP includes consultant supporting transition and training. Permit costs may go up and will be assessed.
Building department is close to fully staffed. Project would be led by Assistant to the Town Manager Department but there would be involvement with the Chief Building Official and Community Development Director. Project may impact future DocuSign Envelope ID: 8BBF97C2-75F4-4119-B12B-309CF935B344

capacity, but this is in the workplan.
If adopted as an amendment to the energy code, requirements would be mandatory. If Council wanted, could add aspirational standards that aren’t binding to Title 15 Municipal Code.
Not planned to be a Brown Act committee, but would be if Council wishes to direct the composition of the committee. Plan to have a broad range of stakeholders. Building Department is getting caught up but is not there yet. Impact on department will depend on the specific changes to the code.

Mayor Henderson called for a brief recess at 7:07 pm.

Meeting resumed at 7:18 pm.

Council Direction:
This is an opportunity to be a leader in mountain communities and is an RFP to investigate a suite of options, not a natural gas ban. Need a consultant for education to cut down on misinformation. Affordability must be a discussion along with incentives and unintended impacts to the community and the grid.
