7. Discussion Items

7.1 Gray’s Crossing PJ’s Events 2023 Temporary Use Permit Appeal (Planning Application 2023-00000021).

Recommended Action: That the Town Council adopt Resolution 2023-20 thereby taking the following actions: (1) Uphold the decision of the Planning Commission in approving the Gray’s Crossing PJ’s Events 2023 Temporary Use Permit based on the recommended findings and subject to the recommended conditions of approval; (2) Deny the appeal of the Planning Commission’s decision to apply Conditions of Approval No. 7 and 8 on the basis that the conditions are required to make the findings to approve the Temporary Use Permit; and (3) Determine the project categorically exempt from CEQA per Section 15304(e) (Minor Alterations to Land).

Yumie Dahn, Senior Planner, presented from the staff report (on file with the Town Clerk).

Council Discussion:

 Temporary use permits are typically handled internally. Because this particular temporary use permit received a lot of public comment, it was brought to the Planning Commission.  Appellant has modified his request regarding the number of private events from 14 private events to one private event with amplified music until 10:00 p.m.

Town Council Meeting April 25, 2023 Page 3 of 6
 It is not unusual to renew a temporary use permits year after year for certain events, however, it is not typical to renew the permit for this type of event year after year.  A permanent land use permit would still require the appellant to attenuate the sound.  There are 87 parking spaces onsite.

Mayor Romack opened the item for public comment.

Written comment received from:

Alexander Dalal Anant Ahuja Chris Ottenweller Jae Kim Mike Brown Tracy Ward

Verbal comment received from:

David Grey Robin Hensley Mike Brown Mike Rogers
Tom Blide Bobbie Speck Heidi Blide Cat Newell

Mayor Romack closed public comment.

Council Direction:

 Revise Condition No. 6 of the Conditions of Approval to allow one private event with amplified music until 10:00 p.m.
 Delete the first sentence from Condition No. 7 of the Conditions of Approval that reads, “No future Temporary Use Permits for private events will be approved at this location.”
 Remove Condition 18 from the Conditions of Approval regarding shuttle service.  Allow up to 10 community events with amplified music until 8:00 p.m.

The staff recommendation, including Council Direction above, was moved by Vice Mayor Polivy, seconded by Council Member Klovstad, and adopted with the following vote:

Ayes: Council Member Klovstad, Vice Mayor Polivy, Mayor Romack, Council Member Zabriskie, and Council Member Henderson.

Noes: None.

Absent: None.

Abstained: None.

The motion passed unanimously.

7.2 Lease to Locals Program Review and Guidelines Update.

Recommended Action: That Council: (1) Receive an update from Town Staff and Placemate on the Lease to Locals Program; and (2) Approve the recommended Lease to Locals Program Guidelines updates.

Lynn Baumgartner, Program Analyst II, and consultant Chase Jarvin, Placemate, presented from the staff report (on file with the Town Clerk).

Colin Frolich, Placemate, spoke on behalf of the project.

Council Discussion:

 If multiple rooms are available to rent in a single house, the rooms need to be rented within 30 days of each other.
o The tenants can sign separate leases, but they need to apply for the program at the same time.
o If one tenant moves out early, the homeowner can rent to another qualifying tenant to finish out the term of the lease and will not need to reapply to the program.

 There has not been much of a slowdown in the supply of houses. Demand is still high.  Total contract price with Placemate will come back to Council as a separate item. Currently, Placemate is not spending any money on marketing and has stayed within budgeted contract amount.
 The reason for the difference between the number of qualified/interested homeowners versus the number of non-qualified/not interested homeowners is due to the homeowners not being ready to make a decision.
 It’s not because the incentive isn’t high enough.
 The average incentive per bedroom is based on the size of the property. The subsidy is based on per person.

Mayor Romack opened the item for public comment.

Seeing none, Mayor Romack closed public comment.

Council Direction:

 Revise Section 5.2 Income Qualification, paragraph 2, to replace “for a household of 1” with “for single person income” to specify whether Average Median Income is for single person income or for multi-person income.

The staff recommendation, including Council Direction above, was moved by Council Member Henderson, seconded by Vice Mayor Polivy, and adopted with the following vote:

Ayes: Council Member Klovstad, Vice Mayor Polivy, Mayor Romack, Council Member Zabriskie, and Council Member Henderson.
