7.1 The fine is absurd. The owners appeared to make a good faith effort to comply with the STR ordinance, misinterpreting the ordinance by 1 day. They never rented the property short term. They were given 14 days to comply by first class mail with no prior warning, even though people are often out of town and not receiving mail for 2 weeks or more. The corrected the listing once they were aware of the problem. There is no evidence that the owners willfully tried to evade the STR ordinance. I am aware of multiple much more serious STR violations with no apparent consequence to the owners. The STR ordinance contains the (unfortunate) clause that there is no duty to enforce. I have seen multiple cases where this clause has been abused but this is clearly a case that called for discretion on the part of the enforcers and a much less heavy-handed approach. I urge the Council to revoke the fine and to apologize to the owners for the way they were treated.
