[Submitted by: M. Hermann] At the September 20, 2022, regular meeting, an ordinance was introduced for consideration to amend Chapter 2.04 of the Tulare Municipal Code to be consistent with the adopted City of Tulare Boards, Commissions, and Committees Handbook in regard to residency requirements, allowing for those who live in the sphere of influence to be appointed to the Parks and Recreation Commission. Pursuant to Section 15 of the City’s Charter, the summary of the ordinance was published in the Tulare Advance Register-Visalia Times Delta, a daily newspaper of general circulation in the City of Tulare, on Tuesday, September 27, 2022. 4. Accept the monthly investment report for August 2022. [Submitted by: D. Ibanez] The investment report for August 2022 is submitted for Council review and acceptance.

Staff recommends Council accept the monthly investment report for August 2022.

5. Authorize the Mayor to execute a license, subject only to minor conforming or clarifying changes acceptable to the City Attorney and City Manager, to allow Correa Land Company LLC to maintain an existing decorative wrought iron and block wall fence within the City’s Walnut Avenue and Marion Street rights-of-way along a portion of their adjacent residential property. [Submitted by: M. Miller] Martin Correa, President and Owner of Correa Land Company LLC, has requested permission to maintain an existing decorative wrought iron and block wall fence which is located at the back of sidewalk along their property’s frontage of Walnut Avenue and Marion Street. The property is located at the northeast corner of Walnut Avenue and Marion Street, is zoned residential and is developed as a single-family residence. The existing fence was constructed by the Owner in an attempt to improve the residential property. The Engineering Division has reviewed the site and verified that the fence does not constitute a hazard to pedestrians or drivers within the City’s right-of-way. The attached license allows the Owner to maintain the existing fence at its current location within the right-of-way, but also requires:
a) The Owner shall maintain the fence and related facilities in an attractive and safe condition,
b) The Owner agrees to repair any damage to the public sidewalk resulting from the installation or maintenance of the fence,
c) The Owner shall remove said encroachments within 90 days of receipt of notice from the City should the Owner fail to comply with the conditions of the license, d) The Owner shall indemnify and hold harmless the City from any claims arising from performance of the work, fence location and design.

A draft of the proposed license and exhibits are attached. Staff recommends Council authorize the Mayor to execute a license, subject only to minor conforming or clarifying changes acceptable to the City Attorney and City Manager, to allow Correa Land Company LLC to maintain an existing decorative wrought iron and block wall fence within the City’s Walnut Avenue and Marion Street rights-of-way along a portion of their adjacent residential property.

6. Confirm Vice Mayor Sayre’s appointment of Ralph Cantu to the Committee on Aging with a term ending December 31, 2023. [Submitted by: M. Hermann] The City of Tulare has eight boards, commissions, and committees in addition to the City Council. From time to time, appointments and reappointments are necessary due to vacancies and expiring terms.

The Committee on Aging is a five-member committee responsible for advising the Community Services Department on matters of senior citizen interest including such areas as recreation, social and nutritional services. Members serve a four-year term and are appointed by the City Council. Meetings are held at 12:00 p.m., on the third Wednesday of the month at the Senior Community Center.

Tulare City Council Page 4
Agenda Memo – October 4, 2022
Currently, there is one vacancy on the Committee. Staff posted the notice of vacancy and received two applications from interested parties. The Committee members are appointed by Council seat, and Council Seat 2 (Vice Mayor Sayre) is responsible for appointment of this current vacancy. After reviewing both applications, Vice Mayor Sayre advised staff that she is appointing Ralph Cantu to fill the vacancy. This nomination is subject to Council approval. Staff recommends Council confirm Vice Mayor Sayre’s appointment of Ralph Cantu to the Committee on Aging with a term ending December 31, 2023.

7. Conditionally approve the final map for Hidden Ridge subdivision for recordation, and accept all easements and dedications offered to the City on the final map, subject to receipt of the signed final map, all fees, and other required items prior to December 4, 2022. [Submitted by: M. Miller] Planning Commission Resolution No. 4621 adopted on May 15, 2006 approved the tentative map for the Hidden Ridge subdivision located on the north side of Bardsley Avenue, approximately 2,300 feet east of Morrison Street. The overall subdivision comprises approximately 8.62 acres and consists of 32 lots to be developed in one phase. The map requires public utility easements, block wall easements, street dedications, and lots dedicated in fee to the City for landscaping, block wall, sidewalks and other public purposes. The subdivider is actively working to complete the final map. To expedite the final map approval process, the subdivider is requesting Council’s conditional approval and acceptance subject to receipt of the signed map, all fees, and other required items within 60-days. Such requests have routinely been accommodated.

A copy of Planning Commission Resolution No. 4621 and the draft final map is attached for reference. Staff recommends Council conditionally approve the final map for Hidden Ridge subdivision for recordation, and accept all easements and dedications offered to the City on the final map, subject to receipt of the signed final map, all fees, and other required items prior to December 4, 2022.

XIII. MAYOR/COUNCIL REPORTS OR ITEMS OF INTEREST – GC 54954.2(a)(3) [Time Estimate:
7:45-7:50 p.m.]
XIV. SCHEDULED PRESENTATIONS

1. Community and Economic Development Update. [Submitted by: T. Myers] [Time Estimate: 7:50-8:00 p.m.]
XV. GENERAL BUSINESS - Comments related to General Business items are limited to three minutes per speaker, for a maximum of 30 minutes per item, unless otherwise extended by the Council.

1. Authorize advance of cash in the amount not to exceed $1,500,000.00 to the Tulare County Regional Transit Authority (TCRTA); and authorize the mayor to sign the Cash Advance and Repayment Agreement. [Submitted by: D. Ibanez] [Time Estimate: 8:00-8:15 p.m.] The Tulare County Regional Transit Authority (TCRTA) was established on August 11, 2020, by Joint Powers Agreement (JPA) between the County of Tulare and cities of Dinuba, Exeter, Farmersville, Lindsay, Porterville, Tulare, Tulare City Council Page 5
Agenda Memo – October 4, 2022
and Woodlake. Its purpose is to own, operate, and administer a unified public transportation system with the jurisdictions of and on behalf of its member agencies.

In the formation of TCRTA, member agencies transferred to TCRTA transit-related assets and all transit-specific Transit Development Act (TDA) fund authority allocated to each member. However, transit funding is based on reimbursement from state and federal funding sources and the reassignment of only future funding has left TCRTA without any reserve of capital to cover its initial operational costs. Had transit services remained among TCRTA’s member agencies, each jurisdiction would have advanced its initial operating costs with non-transit reserves to assist with cash flow prior to TDA funding reimbursement.

In order to assist with the initial cash flow of the agency, TCRTA is requesting that its five largest member agencies contribute startup capital, in the form of a loan, approximately proportionate to their share of TCRTA’s annual budget. Member agencies are currently considering the following loan amounts, with the understanding that a decision not to provide initial capital to TCRTA would likely result in agency insolvency and the possible dissolution of the JPA.

The proposed Cash Advance and Repayment Agreement would advance up to $1,500,000 of City of Tulare LTF Fund dollars to TCRTA through the current 2022 calendar year to assist with cash flow needs. Repayment of borrowed funds, plus accrued annual interest at the Tulare County Treasury pooled rate would be remitted when there is a sufficient cash balance in the TCRTA fund to cover regular TCRTA cash flow needs, but no later than December 31, 2027.

Due to the timing of this request, and TCRTA’s urgent need for a cash advance, it is requested that the Board sign the Cash Advance and Repayment Agreement prior to the TCRTA Board. The Agreement would become effective upon final execution by the TCRTA Board. Staff recommends Council authorize advance of cash in the amount not to exceed $1,500,000.00 to the Tulare County Regional Transit Authority (TCRTA); and authorize the mayor to sign the Cash Advance and Repayment Agreement.

2. Receive an update on the Keep Tulare Beautiful project. [Submitted by: M.

Correa] [Time Estimate: 8:15-8:30 p.m.] On March 1, 2022, the City Manager created the Office of Safety, Compliance and Facilities which includes Facilities, Safety, Code Enforcement and Graffiti to start a new project called "Keep Tulare Beautiful". Part of our duties were to identify and make recommendations to the City Manager and City Council on projects, programs, grants and solutions to improve the City of Tulare. This Member Agency Requested Amount % Share
City of Porterville $1,600,000 32%
County of Tulare $1,500,000 30%
City of Tulare $1,500,000 30%
City of Dinuba $350,000 7%
City of Woodlake $50,000 1%
Tulare City Council Page 6
Agenda Memo – October 4, 2022
teams focus is on general safety, infrastructure / residential improvements (using our TMC), beautification and an increase of community involvement throughout the City.

The Team is working on a Survey (Pending approval) to gather community input, distributing it widely in English and Spanish, digitally and on paper. The Team also heard from a cross- section of community experts and organizational representatives including City of Fresno, City of Bakersfield, Keep America Beautiful Regional Office and Caltrans District 6 (opportunities of entering in to a delegated maintenance agreement to abate litter and graffiti).

Code Enforcement has been a vital part of this project by changing the enforcement approach to a more sensible and assertive approach and also bring property owners into compliance with the law. This is an important part of maintaining the appearance, functionality, and property values of a neighborhood. Staff recommends Council receive an update on the Keep Tulare Beautiful project.

3. Receive an update on the cooling center operations for the summer of 2022 and provide direction for future operations. [Submitted by: M. Ott] [Time Estimate:
8:30-8:45 p.m.] On April 19th 2022 the city was authorized to use the Prosperity Sports Park (PSP) as the primary location for the cooling and warming center when temperatures reached >103 degrees and <29 degrees. From June – September we operated the PSP cooling center for a total of 24 days based on the National Weather Service’s prediction of temperature at or above 103 degrees. Parks & Recreations (P&R) and Fire Department Personnel worked together to ensure the cooling center was opened and staffed with security.

Of the 24 days we operated the cooling centers, 8 days were actually recorded as 103- 104 degrees and just 4 days where above the 105-degree mark. The remaining days were below 103 degrees. We operated the cooling center from 3pm to 7pm as this is normally the hottest parts of the day. Other than the hired security personnel, there was only one citizen who attended the cooling center during the period of operation.

Operating cost for 24 days:

Security Guard - $2,958.45
P&R Personnel Cost - $1,040.00
Electricity - $912.00
Total cost - $4,910.45
Staff recommends Council provide direction to staff for future operations including the possibility of adjusting temperature ranges to mirror what other cities in California operate at, modifying cooling and heating center locations and times of operation.

IS PUBLIC HEARING REQUIRED: ☐Yes ☒No
BACKGROUND/EXPLANATION:

Martin Correa, President and Owner of Correa Land Company LLC, has requested permission to maintain an existing decorative wrought iron and block wall fence which is located at the back of sidewalk along their property’s frontage of Walnut Avenue and Marion Street.

AGENDA ITEM TRANSMITTAL SHEET
Submitting Department: Finance
For Council Meeting of: October 4, 2022
Documents Attached: ☐Ordinance ☐Resolution ☒Other ☐None

AGENDA ITEM:

Authorize advance of cash in the amount not to exceed $1,500,000.00 to the Tulare County Regional Transit Authority (TCRTA); and authorize the mayor to sign the Cash Advance and Repayment Agreement.

IS PUBLIC HEARING REQUIRED: ☐Yes ☒No
BACKGROUND/EXPLANATION:

The Tulare County Regional Transit Authority (TCRTA) was established on August 11, 2020, by Joint Powers Agreement (JPA) between the County of Tulare and cities of Dinuba, Exeter, Farmersville, Lindsay, Porterville, Tulare, and Woodlake.

Member Agency Requested Amount % Share
City of Porterville $1,600,000 32%
County of Tulare $1,500,000 30%
City of Tulare $1,500,000 30%
City of Dinuba $350,000 7%
City of Woodlake $50,000 1%
The proposed Cash Advance and Repayment Agreement would advance up to $1,500,000 of City of Tulare LTF Fund dollars to TCRTA through the current 2022 calendar year to assist with cash flow needs. Repayment of borrowed funds, plus accrued annual interest at the AGENDA ITEM: General Business 1
Tulare County Treasury pooled rate would be remitted when there is a sufficient cash balance in the TCRTA fund to cover regular TCRTA cash flow needs, but no later than December 31, 2027.

Due to the timing of this request, and TCRTA’s urgent need for a cash advance, it is requested that the Board sign the Cash Advance and Repayment Agreement prior to the TCRTA Board.

The Agreement would become effective upon final execution by the TCRTA Board.

Details of the repayment agreement are below:

A. The City has made or will make available up to $1,500,000 to TCRTA under the terms and conditions of this Agreement.

B. TCRTA Executive Director shall diligently monitor TCRTA's cash flow, including but not limited to, keeping daily records of such fund balance information. Such information shall be available, upon request, to the City Manager.

C. The Parties hereto desire for TCRTA Executive Director to have the flexibility to match TCRTA's need for funds to the amount of the request for such funds, up to the maximum amount of the available funds under this Agreement. To that end, from time to time as the need arises from the effective date of this Agreement up to and including December 31, 2022, TCRTA Executive Director may make a written request to the City Manager for a cash advance to TCRTA up to the maximum amount of the funds made available by the City under this Agreement. Such written request made on behalf of TCRTA may be transmitted by email to the City Manager.

D. The City Manager shall have the right to request information from TCRTA Executive Director with respect to TCRTA's need for the requested advance of funds and shall promptly either approve or disapprove TCRTA's request for an advance of funds up to the maximum amount of the City's available funds under this Agreement. Such approval or disapproval made by the City Manager may be transmitted by email to TCRTA Executive Director. If the City Manager informs TCRTA Executive Director of the City's approval of the requested advance, then the City shall make available to TCRTA 100 percent of the requested advance, up to the maximum amount of the City's available funds under this Agreement.

E. The City will electronically transfer its cash advance(s), upon written request of TCRTA Executive Director, to a TCRTA fund for the purposes of this Agreement.

F. TCRTA shall repay in full to the City the amount or amounts advanced by the City to TCRTA under this Agreement, plus accrued interest at the Annualized Rate, on the unpaid balance advanced by the City to TCRTA, until all such amounts are fully paid by TCRTA to the City, which shall in any event be at the earlier of:

V\/hen there is sufficient cash balance in TCRTA's fund to cover regular TCRTA cash flow needs, as determined by TCRTA Executive Director; or
December 31, 2027.

Interest on the unpaid balance will be calculated and invoiced at the end of every fiscal year based upon the Annualized Rate for that fiscal year and prorated as necessary.

To the extent any other Member Agency advances funds to TCRTA under a separate agreement, then the City and all other Member Agencies advancing funds shall be repaid simultaneously based on the principal amount advanced by each of them to TCRTA.

To avoid unnecessary amounts advanced by the City, TCRTA may repay a portion of any advance, subject to the terms and conditions of this Agreement, without affecting the TCRTA's right to request an advance under this Agreement, provided that such repayment complies with the foregoing provisions of this Section 111.F.

The principal amount of funds repaid by TCRTA to the City under the preceding Section 111.F shall be available to TCRTA, up to the maximum amount of the City's available funds under this Agreement, for an additional request or requests up to December 31, 2022, to be repaid according to the terms provided in this Agreement.

In addition to any other bank records to be kept and provided to the City under this Agreement, TCRTA Executive Director will prepare and provide quarterly financial reports, including cash flow projections, of TCRTA to the City Manager not later than thirty (30) days following the relevant quarter.

STAFF RECOMMENDATION:

Authorize advance of cash in the amount not to exceed $1,500,000.00 to the Tulare County Regional Transit Authority (TCRTA); and authorize the mayor to sign the Cash Advance and Repayment Agreement.

CITY ATTORNEY REVIEW/COMMENTS: ☐Yes ☒N/A
IS ADDITIONAL (NON-BUDGETED) FUNDING REQUIRED: ☒Yes ☐No ☐N/A Approving this request for the Tulare County Regional Transit Authority (TCRTA) would remove approved appropriated funding from Project #EN2016-12; project described as “Pavement Management System on South K Street between Olson Ave. and Paige Ave.

Includes ADA Concrete Work” until loan repayment or until another funding source is identified.

FUNDING SOURCE/ACCOUNT NUMBER:

Funding would come from the current fund balance of the LTF Account. Upon repayment of the loan, all monies should be re-deposited to the LTF fund and not the City’s General Fund.

Receive an update on the cooling center operations for the summer of 2022 and provide direction for future operations.

IS PUBLIC HEARING REQUIRED: ☐Yes ☒No
BACKGROUND/EXPLANATION:

On April 19th 2022 the city was authorized to use the Prosperity Sports Park (PSP) as the primary location for the cooling and warming center when temperatures reached >103 degrees and <29 degrees. From June – September we operated the PSP cooling center for a total of 24 days based on the National Weather Service’s prediction of temperature at or above 103 degrees. Parks & Recreations (P&R) and Fire Department Personnel worked together to ensure the cooling center was opened and staffed with security.

Of the 24 days we operated the cooling centers, 8 days were actually recorded as 103-104 degrees and just 4 days where above the 105-degree mark.
