Agenda Title: Pet Accommodations at the Tulare Homeless Shelter

RECOMMENDED ACTION
Provide direction to staff regarding pet accommodations to be incorporated into the design of the Tulare Homeless Shelter facility.

SUMMARY
Design of the Tulare Homeless Shelter facility is currently underway. The original conceptual plan for the facility as shown in attached Exhibit A included a small number of dog kennels to accommodate the pets of individuals being housed at the facility. Through experience gained operating the Temporary Encampment Facility, staff has learned that prevalence of dog ownership amongst the homeless community is far higher than anticipated. The Temporary Encampment Facility currently has a population of just under 200 individuals, with a corresponding population of dogs kept as pets at around 100.

The Tulare Homeless Shelter is being designed to house up to 400 individuals. It is strongly recommended that no pets of any kind be allowed inside the Shelter’s living quarters for reasons of hygiene and liability concerns. This raises questions regarding what level and form of pet accommodations the City should provide at the facility. If the percentage of pet ownership observed in the temporary encampment populations proves to be representative of the population to be served by the Shelter, the City would potentially be faced with providing accommodation for approximately 200 dogs. The space required to adequately accommodate that number of animals would significantly impact the design of the Shelter facility. The attached Exhibit B shows the dog kennel layout for the original conceptual plan, which provides for 34 kennels. Exhibit C provides an option for relocating and significantly enlarging the kennel facilities to the area originally planned for a full-size basketball/fitness court. With the larger area, and by using double-stacked kennels, up to 228 kennels could be provided through this option. A half-court basketball court could be located on the area planned for kennels on the original conceptual plan. Before moving forward any further in the design of the facility, staff and the design architect need direction from Council regarding the level of accommodations that should be provided.

When considering whether to make accommodations for pets, it’s important to understand the primary reasons for pet ownership among the homeless population. As with the overall population, many within the homeless community keep pets for companionship and emotional support. The other factors most frequently cited are those of personal protection and protection of property. Dogs can alert individuals to the presence of others who could pose a threat when living on the streets or in an encampment. However, that very drive to protect is one of major reasons for discouraging, or at least tightly controlling, the presence of dogs in a communal living setting. In the more secure setting of the Tulare Homeless Shelter, which will be Item #: 15.2

monitored by on-site staff and security cameras, the protection aspects of dog ownership would not be necessary or desirable.

For any degree of pet accommodation, the following concerns should be considered:
• Population Control – Spay/Neuter requirements.
• Veterinary Care/Vaccination Requirements – Denser animal populations would require greater efforts to prevent spread of disease. Per Chapter 6.12.120 of the Tulare Municipal Code, (A) every dog meeting the minimum age requirements to receive a rabies vaccination shall receive a rabies vaccine approved by the California State Department of Health Services, and (B) every person who owns or comes to own an unvaccinated dog over four months of age shall have 30 calendar days from the date the animal was obtained to comply with the provisions of this chapter. A vaccination program with some degree of veterinary care provided to animals at the shelter would be needed.
• Vector Control/Sanitation – Pest control services would be required to prevent flea/tick infestations. Per Chapter 6.12.160 of the Tulare Municipal Code, enclosures or surroundings where domestic animals are kept must be maintained in a sanitary condition.
• Injury prevention – Access restrictions, leash rules, etc. would need to be imposed to protect both individuals and animals housed at the shelter. • Licensing Requirements – Per Chapter 6.12.100 of the Tulare Municipal Code, every dog meeting the minimum age requirements to receive a rabies vaccination shall be subject to a dog license fee, due and payable by its owner or custodian within 30 days of the acquisition of the dog, or entry into the city.

There are a range of options for Council consideration regarding the level of pet accommodation to be provided at the shelter. It is recommended that some limitations be placed on the number of pets, as it does not appear feasible to incorporate facilities for an unlimited number of pets.

FISCAL IMPACT & FUNDING SOURCE(S)
Providing accommodation for pets at the Tulare Homeless Shelter would have associated costs, both in construction and operation of the facilities.

Agenda Title: Weed Abatement Update

RECOMMENDED ACTION
Receive a report on the weed abatement process that the City of Tulare Fire Department (TFD) is conducting to reduce the possibility of vegetation fires in Tulare.

SUMMARY
The intent of this staff report is to provide an update of this years weed abatement processes for parcels of 1 acre or more within the City limits. TFD has started this year’s process early by sending out pre-notification post cards on the March 15th informing parcel owners that weed abatement enforcement would start on May 1st. TFD sent a total of 132 postcards to the registered owners of 162 parcels. Of the 132 post cards, TFD had to take corrective measures and updated 70 parcels to the new owners on file with Tulare County. TFD is hopeful the updates will yield positive results in parcel owners taking care of their weed abatement issues internally.

In previous years, TFD would send reminders on April 1st, giving parcel owners 30 days to comply with abatement regulations. This year, staff provided an extra 15 days for owners to be notified. With the help of Mother Nature and the storms in February and March, this extra 15 days is much needed.

Since May 1st, the Fire Prevention and Inspection section has provided notices of violation (NOV’s) to 29 owners. These owners now have 10 days to clear their parcel(s). After those 10 days, TFD will contract a discing service company to abate the parcel as needed and send a bill for those services.

TFD’s goal is to have all 162 parcels abated by July 1st each year. The main hold-up in previous years was getting contractors lined up to provide the discing services. Staff has worked to secure more discing companies to assist in this venture. The QR code on the notification post card provides a list of contractors that parcel owners can utilize if they wish.

TFD will also remain vigilant as the weather turns warmer. As in previous years, small to medium vegetation fires around the City can pop up any time. TFD members are consistently honing their skills to mitigate and manage these emergencies safely, efficiently, and quickly.

FISCAL IMPACT & FUNDING SOURCE(S)
Funding for the abatement of properties falls under 001-4230-2142.

Study Session on Community Choice Aggregation (CCA) Program Dear Council,
I would like to request your support in agendizing a discussion on the possibility of having a council study session in the next couple of council meetings in June/July on the topic of Community Choice Aggregation (CCA's).

CCA's allow local cities to form a JPA to procure power on behalf of their residential, businesses, commercial and local government accounts from an alternative power supplier while still receiving transmission, distribution service and cusotmer billing from existing utility providers.

There are about 25 CCA's throughout California that have been in exsitence for a number of years that have been successful in proving reliable and affordable power in their communities.

There is also a working group of a number of Tulare, Kings, Fresno and Kern counties city council members who have been discussing the consideration of establishing a CCA in the region.

I beleive this would be a worthy discussion to have to understand if a local Tulare county based CCA would benefit our cities and other local governments in the area by reducing rates to our local residents and businnesses.

I appreciate your consideration of the request.
