Summary: On December 6, 2022, City Council approved the final map Fernjo Estates (Orchard 79) subdivision, which created 80 single-family residential lots, as shown in the attached exhibit. The overall subdivision comprises approximately 18.1 acres and consists of 80 lots.

The Subdivider, Orchard 79, LLC, a California Limited Liability Company, has completed construction of all required public works improvements in accordance with the approved plans and specifications for this subdivision.

Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.

Legal Review: Notice of Completion has been reviewed and approved as to form by the City Attorney.

Tulare City Council Page 3
Agenda Memo - October 17, 2023
Alternative Action: 1) Approve with changes - No impact; 2) Deny - Not approving the NOC would prevent residents from occupying their recently purchased homes; or 3) Table - A delay in the City accepting the improvements would prevent residents from occupying their recently purchased homes.

10.4 KCOK Ranch No. 3 Subdivision Notice of Completion.

Recommended Action: Accept the required public works improvements for KCOK Ranch No. 3 subdivision located east of Mooney Boulevard and north of Seminole Avenue as complete, authorize the City Engineer to sign a Notice of Completion (NOC), and direct the City Clerk to file the NOC with the Tulare County Recorder’s Office. [M. Miller]
Summary: On November 28, 2022, City Council approved the final map of KCOK Ranch No. 3 subdivision, which created 48 single-family residential lots, as shown in the attached exhibit. The overall subdivision comprises approximately 110 acres and consists of 355 lots to be developed in 9 phases.

The Subdivider, SFT Capital LP, a California limited partnership, has completed construction of all required public works improvements in accordance with the approved plans and specifications for this subdivision.

Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.

Legal Review: Notice of Completion has been reviewed and approved as to form by the City Attorney.

Alternative Action: 1) Approve with changes - No impact; 2) Deny - Not approving the NOC would prevent residents from occupying their recently purchased homes; or 3) Table - A delay in the City accepting the improvements would prevent residents from occupying their recently purchased homes.

10.5 Agreement for Sharing Cost of State Highway Electrical Facilities.

Recommended Action: Adopt a resolution approving an agreement with the State of California Department of Transportation for the allocation of operation and maintenance costs of electrical facilities associated with intersections of state highways and city roads and authorizing the Mayor and City Manager to execute same on behalf of the City. [M. Miller]
Summary: This agreement supersedes previous agreements for this purpose, the most recent of which was approved on April 17, 2001. The purpose of the agreement is to establish the means by which costs are allocated between the State and City for the operation and maintenance of traffic signals, roadway lighting and sign lighting associated with intersections of state highways and city roads.

Fiscal Impact & Funding Source(s): Cost sharing under the prior agreement has been an ongoing expense for the City and has been paid through the Street Division’s General Fund Operations budget. Costs will likely increase under the new agreement, Tulare City Council Page 4
Agenda Memo - October 17, 2023
as the State has audited their inventory of shared facilities and found that additional facilities have been installed since the prior agreement in 2001.

Legal Review: The subject agreement has been reviewed and approved as to form by the City Attorney.

Alternative Action: 1) Approve with changes - The cost share agreement is a standard form developed by the State. Any deviation from the State’s standard format would be subject to the review and approval of the Headquarters of the State Department of Transportation; 2) Deny - Not approving the agreement could open the City to potential litigation and/or penalties; or 3) Table - While a minor delay in the City adopting the Resolution and executing the cost share agreement would not likely cause an issue with the State, they are hoping to have the new agreement in place shortly.

10.6 Purchase of Ford Transit Cargo Van for the Police Department.

Recommended Action: Award the purchase of one new/unused 2024 Ford Transit Cargo Van to National Auto Fleet Group, of Watsonville, CA using Sourcewell Contract No. 091521-NAF in the amount of $63,946.97, which includes all fees, tax and shipping. [T. Whitfield]
Summary: The City is a member of Sourcewell, which is a national public service agency that provides for cooperative purchasing for government agencies. Through the Sourcewell Contract No. 091521-NAF, staff is requesting authorization to purchase one new/unused 2024 Ford Transit Cargo Van from National Auto Fleet Group, of Watsonville, CA in the amount of $63,946.97.

The proposed truck is a replacement unit and is as follows:

Replacement
Unit New Vehicle Cost Original Budget
PD Unit #377 2024 Ford Van $63,946.97 $80,000
The proposed cargo van will replace unit #377 which is a 2008 Chevrolet Suburban currently operated by the Police Department, Investigations Division as an evidence and forensic processing unit. This vehicle was requested for replacement in the FY 2023/24 Fleet Replacement budget in the amount of $80,000. The van will require additional outfitting, estimated to cost an additional $10,000. If the purchase is approved, unit #377 will be surplussed once the new unit is received.

The Sourcewell purchasing contract is available to agencies nationwide and is therefore very competitive and very limited. On October 9, 2023, National Auto Fleet Group notified staff that the ordering window for Ford Transit Cargo Vans was open.

This is the first opening we have seen for the cargo vans. The Fleet Superintendent made contact and was able to place an order for the Ford Cargo van. Due to the time constraints, the City Manager approved the issuance of a purchase order to secure the van. If the City Council does not approve this item, the build will be canceled, and we will have to wait for the next availability of cargo vans through the National Auto Fleet Group.

Tulare City Council Page 5
Agenda Memo - October 17, 2023
Fiscal Impact & Funding Source(s): Funding for the purchase of the vehicle will come from the Police Department, Investigations Division Fleet Replacement Funds (Fund 604). The requested budget for this truck was $80,000 which is sufficient to cover the cost of the van including upfitting.

Legal Review: This item does not require review by the City Attorney’s office.

Alternative Action: 1) Approve with changes; 2) Deny; or 3) Table. If not approved, the Police Department, Investigations Division will continue to use unit #377 until a new vehicle can be purchased.

10.7 Akers Street Irrevocable Offer of Dedication.

Recommended Action: Adopt a resolution accepting a portion of the Irrevocable Offer to dedicate real property along the Akers Street (also known as Gem Street) alignment south of Cartmill Avenue that was offered for dedication across Parcels 1, 7, and 8 of Parcel Map No. 5020 filed on December 31, 2010, in Book 51 or Parcel Maps at Page 26 in the Office of the Tulare County Recorder, from Robert W.

Wagner, Successor Trustee of Trust A of the Lanting family Trust and from Rutherford Investment Properties, LLC. Direct the City Clerk to cause a certified copy of the resolution accepting the Irrevocable Offer of Dedication to be recorded in the Office of the Tulare County Recorder and authorize the City Manager or his designee to sign a Certificate of Acceptance for the same. [M. Miller]
Summary: Parcel Map No. 5020 filed by Robert W. Wagner, Successor Trustee of Sub Trust A of the Lanting Family Trust and from Rutherford Investment Properties, LLC created 8 parcels along the west side of Retherford St. south of Cartmill Ave. An Irrevocable Offer of Dedication in favor of the City of Tulare was made along the Akers Street alignment frontage of Parcels 1, 7, and 8 of that map. A portion of the Irrevocable Offer along Parcels 1, 7, and 8 is necessary for the installation of wet and dry utilities and the construction of Akers Street.

Fiscal Impact & Funding Source(s): Until Akers Street is constructed, ongoing costs associated with weed control will be required along the Akers Street alignment.

Legal Review: Legal to review of the resolution prior to recordation.

Alternative Action: 1) Approve with changes would have minimal impact on construction costs and schedule; 2) Denying the acceptance of the Irrevocable Offer would have a significant impact on construction cost and schedule; or 3) Tabling the acceptance of the Irrevocable Offer could have a significant impact on construction costs and schedule.

11. GENERAL BUSINESS - Comments related to General Business items are limited to three minutes per speaker, for a maximum of 30 minutes per item, unless otherwise extended by the Council.

11.1 Women’s Clubhouse Repair Contracts. [Time Estimate: 7:55-8:25 p.m.] Recommended Action: Approve and authorize staff to enter into agreements for repairs to the Women’s Clubhouse including roof repair to be conducted by A+ Tulare City Council Page 6
Agenda Memo - October 17, 2023
Roofing in the amount of $2,400 and weatherization to be conducted by SANCO in the amount of $8,400. [M. Correa]
Summary: The Women’s Clubhouse, built in the late 1800’s, is located at 88 west Tulare Avenue and has not been utilized in eight years. To prolong the building’s life, some repairs are needed such as temporary roof repair, resealing of the building (windows/vents), capping off gas lines, disconnecting electric lines, and installing spark screen/rain cap at the chimney (bird/pest prevention).

Agenda Title: Agreement for Sharing Cost of State Highway Electrical Facilities

RECOMMENDED ACTION
Adopt a resolution approving an agreement with the State of California Department of Transportation for the allocation of operation and maintenance costs of electrical facilities associated with intersections of state highways and city roads and authorizing the Mayor and City Manager to execute same on behalf of the City.

SUMMARY
This agreement supersedes previous agreements for this purpose, the most recent of which was approved on April 17, 2001. The purpose of the agreement is to establish the means by which costs are allocated between the State and City for the operation and maintenance of traffic signals, roadway lighting and sign lighting associated with intersections of state highways and city roads.

FISCAL IMPACT & FUNDING SOURCE(S)
Cost sharing under the prior agreement has been an ongoing expense for the City and has been paid through the Street Division’s General Fund Operations budget. Costs will likely increase under the new agreement, as the State has audited their inventory of shared facilities and found that additional facilities have been installed since the prior agreement in 2001.

LEGAL REVIEW
The subject agreement has been reviewed and approved as to form by the City Attorney.

ALTERNATIVE ACTION

1. Approve with changes – The cost share agreement is a standard form developed by the State. Any deviation from the State’s standard format would be subject to the review and approval of the Headquarters of the State Department of Transportation.

2. Deny – Not approving the agreement could open the City to potential litigation and/or penalties.

3. Table – While a minor delay in the City adopting the Resolution and executing the cost share agreement would not likely cause an issue with the State, they are hoping to have the new agreement in place shortly.

Agenda Title: Purchase of Ford Transit Cargo Van for the Police Department

RECOMMENDED ACTION
Award the purchase of one new/unused 2024 Ford Transit Cargo Van to National Auto Fleet Group, of Watsonville, CA using Sourcewell Contract No. 091521-NAF in the amount of $63,946.97, which includes all fees, tax and shipping.

SUMMARY
The City is a member of Sourcewell, which is a national public service agency that provides for cooperative purchasing for government agencies.

FISCAL IMPACT & FUNDING SOURCE(S)
Funding for the purchase of the vehicle will come from the Police Department, Investigations Division Fleet Replacement Funds (Fund 604). The requested budget for this truck was $80,000 which is sufficient to cover the cost of the van including upfitting.
