Agenda Memo - July 16, 2024

6.2 Approval of City Council Meeting Minutes.

Recommended Action: Approve the minutes of the special and/or regular meeting of July 2, 2024. [M. Hermann]

6.3 Second Reading and Adoption of Ordinance 2024-04.

Recommended Action: Adopt Ordinance 2024-04 approving Zone Amendment No. 751, pre-zoning the subject property to the R-1-4 (Small-lot Residential) zoning designation. [S. Sopp]
Summary: This is a request by N and M Tulare LLC. to annex into the City limits and subdivide approximately 39.26-acres into a 255-lot single-family residential subdivision.

The subject parcel is currently outside of the City limits and is currently subject to the County’s zoning designation. The applicant is proposing to pre-zone the subject property to the R-1-4 (Small-lot Residential) and zoning designation to become effective upon annexation into the City limits.

The subject property is currently subject to the zoning designation established by the County of Tulare. Upon annexation, the project proponents are proposing to establish the underlying zoning designation as R-1-4 (Small-lot Residential). The proposed R-1- 4 zoning designation is consistent with the existing Low Density Residential land use designation.

On July 2, 2024, the ordinance was introduced and passed-to-print by Council. Pursuant to Section 15 of the City’s Charter, the ordinance is being presented to Council for the second reading and adoption.

Fiscal Impact & Funding Source(s): The proposed action will not have any immediate financial impact. As future development occurs, payment of entitlement, building permit, development impact fees, etc. will be required. It is recommended that future action be taken to amend the City’s development impact fee program to add longer term infrastructure improvements specifically related to traffic to the program.

Legal Review: This item does not require legal review.

Alternative Action: 1) Approve with changes; 2) Deny; or 3) Table.

6.4 Motorola Service Agreement.

Recommended Action: Approve a contract with Motorola Solutions in an amount not to exceed $161,705.21 for maintenance and advance replacement of Motorola Radio equipment. [F. Ynclan]
Summary: The Tulare Police Department uses Motorola for all radio-related equipment.

This includes all five dispatch radios, four conventional Radio Frequency (RF) sites, on site infrastructure, security services, and preventive maintenance. The existing equipment and infrastructure has exceeded its warranty. The current service-related contract expires July 18, 2024.

Motorola Solutions offers a tailored service contract not only to provide maintenance to the radio system but will also provide system upgrades when the equipment needs to Tulare City Council Page 3 of 7
Agenda Memo - July 16, 2024
be replaced. This contract will also provide security update services on the Radio System, annual preventive maintenance, and site infrastructure response. The current radio system is aging, and updates and replacement are anticipated.

Fiscal Impact & Funding Source(s): The service contract is for the period of July 1, 2024 to June 30, 2026 to be paid annually. Below in the annual cost of the service agreement.
2024/2025 Total $72,812.66
2025/2026 Total $88,892.55
Funding Source 001-4220-2015
Legal Review: The attached contract was reviewed by the City Attorney. There were no issues reported.

Alternative Action: 1) Approve with changes; 2) Deny; or 3) Table. Potential consequences if not approved are loss of radio communication which is essential. Much of the radio equipment is aging with some showing signs of replacement. The city would need to purchase new equipment when the existing older equipment fails. There could possibly be an extended delay due to not having a contract with Motorola to respond.

This would significantly impact the service we provide to the city and be a significant safety issue for the officers. The Tulare Police Department is a PSAP for the City of Tulare and there would be potential for the 911’s service calls to be negatively impacted with reduced or no radio capabilities.

6.5 Capital Improvements Project Dashboard for July 2024.

Recommended Action: Accept the Capital Improvements Project Dashboard for July 2024. [M. Miller]
Summary: On December 16, 2014, the Tulare City Council adopted the Tulare Project Management System Program Policy (TPMS). The goal of the TPMS is to help the City accomplish significant projects on time, within budget, and in accordance with each project’s clearly defined scope. The TPMS utilizes a systematic approach to project management with the following goals:
• Establish consistency in how projects are managed,
• Create department 5-year project plans,
• Improve pre-planning and preparation,
• Identify and implement management policies and procedures, • Improve project cost tracking and project delivery,
• Formalize and improve project reporting, and
• Review and evaluate project successes or failures upon completion in order to improve on future projects.

Pursuant to the City Council’s request, staff provides quarterly Capital Improvement Project Dashboards for all major capital projects that fall under City Council’s purview.

The dashboard provides a visual summary of the overall progress of the projects so that City Council is aware of their status. The dashboards identify the project number, project Tulare City Council Page 4 of 7
Agenda Memo - July 16, 2024
title, project phase, project manager, start date, end date, budget, expenditures/encumbrances, and special notes regarding the status and/or issues affecting the project.

The attached Capital Improvements Project Dashboard reflects the quarterly status of active projects as of April 2024. The dashboard uses a color metric for the completion status graphic (pie chart) that reflects the phase each project is in. BLUE shading indicates that the project is in the Design phase, GREEN shading indicates that the project is in the Environmental or Right-of-Way Acquisition phase, and ORANGE shading indicates that the project is in the Construction or Implementation phase.

Fiscal Impact & Funding Source(s): Receipt and approval of the Capital Improvement Project Dashboard will not result in any fiscal impact.

Legal Review: This item does not require legal review.

Alternative Action: 1) Approve with changes; 2) Deny; or 3) Table.

7. PUBLIC HEARING - Comments related to Public Hearing items are limited to three minutes per speaker, for a maximum of thirty minutes per item, unless otherwise extended by Council. For those that wish to provide public comment while viewing the meeting online, you may call (559) 366-1849.

Please note that there will be approximately a 20-second delay in broadcast for viewers. When calling in, mute the device used for viewing the meeting. [Time Estimate: 7:40 p.m.]

7.1 Landscape Maintenance Assessments for Fiscal Year 2024-25.

Recommended Action: Adopt a resolution confirming diagram and landscape maintenance assessments and levying assessments for fiscal year 2024-25; and authorize the City Manager to execute a Compliance Certification and Hold Harmless Statement in connection thereto. [M. Miller]
Summary: Each year, City Council is required to set landscape maintenance assessments for the upcoming fiscal year. On June 18, 2024, Council adopted Resolution of Intention 2024-32 setting July 16, 2024, as the public hearing date to adopt landscape maintenance assessments for fiscal year 2024-25 and directing the City Engineer to file the required Engineers Report with the City Clerk.

The public hearing will allow for property owners within each of the twenty-eight landscape districts to comment on the proposed Fiscal Year 24-25 assessment for their district. The proposed assessments compare to the prior fiscal year as follows:
• seven districts are proposed to decrease,
• ten districts are proposed to increase,
• eight districts would experience no change from the prior year, • two districts will be assessed for the first time, and • one district has not yet completed any improvements requiring maintenance, and therefore does not have any proposed assessments.

For the ten districts that would experience an increase in assessment, none of the proposed assessments exceed the rate approved by property owners at the time of their formation, accounting for CPI adjustments where allowed. Therefore, with regard to Tulare City Council Page 5 of 7
Agenda Memo - July 16, 2024
Proposition 218 requirements, they do not constitute an assessment increase that would trigger the need for property owner approval by ballot.

Due to its size, electronic copies of the Engineers Report will be made available to councilmembers through the City Clerk’s Office. A Compliance Certification and Hold Harmless Statement is required to be signed by the City Manager upon approval of the Council and submitted to the County in conjunction with the assessments.

Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.

Legal Review: This item does not require legal review.

Alternative Action: 1) Approve with changes - Staff will make any requested revisions to the draft Resolution Levying Assessments; 2) Deny - Not an option. Adoption of a Resolution is a legally required step in accordance with the Landscaping and Lighting Act of 1972 for establishing assessments for the coming fiscal year; or 3) Table - Assessments for the coming fiscal year must be adopted by Council and provided to the Tulare County Tax Collector’s office by August 12. Tabling this item until the next available Council meeting date (August 6, 2024) would not allow sufficient time for City staff to complete and submit the required documentation to the County by the August 12, 2024 deadline.

7.2 Cottonwood 3 Subdivision.

Recommended Action: Pass to print an ordinance approving Zone Amendment No. 752 to change the existing zoning designation from R-1-6 (Single-family Residential, 6,000 sq. ft. minimum lot area) to R-1-5 (Single-family Residential, 5,000 sq. ft. minimum lota area; and adopt a resolution to adopt the initial study / mitigated negative declaration prepared for the Cottonwood 3 Tentative Subdivision Map and Zone Amendment No. 752. [S. Sopp]
Summary: This is a request by NFDI LLC to subdivide approximately 13.31-acres and establish an 86-lot single-family residential subdivision. The subject parcel is within the existing City limit boundary. The proposed project is located southeast of the Mooney Blvd. and Foster Dr. ultimate alignments.

Zone Amendment
The subject property is currently designated Low Density Residential within the City adopted 2035 General Plan. The subject property is currently zoned R-1-6 (Singlefamily Residential 6,000 sq. ft. minimum lot area). The applicant is requesting to change the existing zoning to R-1-5 (Single-family Residential, 5,000 sq. ft. minimum lot area) zoning designation. The proposed R-1-5 zoning designation is consistent with the existing Low Density Residential land use designation.

Tentative Subdivision Map
If approved, the recommended actions would enable the applicant to subdivide the project site into an 86-lot single family residential subdivision. The proposed subdivision would have entry access from an existing point at Tahoe Avenue. Paving for an Tulare City Council Page 6 of 7
Agenda Memo - July 16, 2024
emergency vehicle access will also be required to be provided to attach the existing Mooney Blvd. alignment to the ultimate alignment of Foster Dr. The applicant would be required to extend all necessary utilities including water, sewer, electrical, and stormwater connections. Stormwater would be directed to a temporary stormwater basin to be provided to the north of the project site with stormwater ultimately being directed to a regional basin located to the northeast of the project site at Levin Avenue in the future as development occurs.

An approximately 0.39-acre park will be provided in order to serve the development.

The project would develop all interior streets, including curb, gutter, and sidewalk. The development will also extend Foster Dr. and provide paving. Curb, gutter, sidewalk, landscaping, and a block wall will be required along both the Foster Dr. and Mooney Blvd. frontages. An in-lieu fee will be collected for pavement improvements along Mooney Blvd.

Environmental
An Initial Study/Mitigated Negative Declaration was prepared for this project for public review pursuant to provisions of the Public Resources Code, State of California, Section 21000 to 21177 of the California Environmental Quality Act (CEQA). The City of Tulare was the lead agency on the preparation of the Initial Study/Mitigated Negative Declaration. A notice of Public Hearing for the project, and the Notice of Intent to Adopt the Mitigated Negative Declaration was published on May 21, 2024.

Two comment letters were received during the public review period of the circulated CEQA document. Comment letters were provided by the San Joaquin Valley Air Pollution Control District and an adjacent property owner. That property owner referenced a prior approval for the Cottonwood Subdivision that required the realignment of Mooney Blvd. and Foster Dr. and requested that this project be held to the same requirement (see attached).

Staff would note that the prior Cottonwood Tentative Subdivision Map approval is expired and is no longer valid. With the expiration of the map, any prior conditions of approval are no longer valid. In addition, the applicant completed a traffic impact study which analyzed the impacts of the development of the proposed subdivision and determined that the existing intersections could function above the City’s level of service requirements without completing the full realignment requirements as requested by the comment letter received.

No changes to the CEQA document were required as a result of the comments provided.

Planning Commission
On June 24, 2024, the Planning Commission voted 4-0 (one vacancy) to approve the Cottonwood 3 TSM and recommend that the City Council approve Zone Amendment No. 752.

Fiscal Impact & Funding Source(s): As development occurs, payment of entitlement, building permit, development impact fees, etc. will be required.

Agenda Title: Second Reading and Adoption of Ordinance 2024-04

RECOMMENDED ACTION
Adopt Ordinance 2024-04 approving Zone Amendment No. 751, pre-zoning the subject property to the R-1-4 (Small-lot Residential) zoning designation.

SUMMARY
This is a request by N and M Tulare LLC. to annex into the City limits and subdivide approximately 39.26-acres into a 255-lot single-family residential subdivision.

The proposed R-1-4 zoning designation is consistent with the existing Low Density Residential land use designation.

On July 2, 2024, the ordinance was introduced and passed-to-print by Council. Pursuant to Section 15 of the City’s Charter, the ordinance is being presented to Council for the second reading and adoption.

FISCAL IMPACT & FUNDING SOURCE(S)
The proposed action will not have any immediate financial impact. As future development occurs, payment of entitlement, building permit, development impact fees, etc. will be required.

It is recommended that future action be taken to amend the City’s development impact fee program to add longer term infrastructure improvements specifically related to traffic to the program.

AMENDING THE ZONING MAP OF THE CITY BEING A PART OF THE SECTION

10.04.04 OF SAID CODE ZONE AMENDMENT NO. 751
WHEREAS, the Council of the City of Tulare finds that this application is necessary to achieve the objectives of the Zoning Title prescribed in Section 10.04.02 of the Tulare City Code; and

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Tulare as follows:

SECTION 1. The Zoning Map of the City of Tulare as referred to in Section

10.24.05 of the City Code of the City of Tulare, and as enacted, being made a part of the Zoning title of said Code in Section 10.04.04; thereof, a property portion of said map, being attached hereto, is hereby amended as follows:

PRE-ZONING approximately 39.26-acres of property to the R-1-4 (Small-lot Residential) zone district to become effective upon annexation into the City limits and is located on the southwest corner of Bardsley Avenue and Oakmore Street as set forth more specifically on said map.

SECTION 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed.

Agenda Title: Motorola Service Agreement

RECOMMENDED ACTION
Approve a contract with Motorola Solutions in an amount not to exceed $161,705.21 for maintenance and advance replacement of Motorola Radio equipment.

SUMMARY
The Tulare Police Department uses Motorola for all radio-related equipment. This includes all five dispatch radios, four conventional Radio Frequency (RF) sites, on site infrastructure, security services, and preventive maintenance. The existing equipment and infrastructure has exceeded its warranty. The current service-related contract expires July 18, 2024.

Motorola Solutions offers a tailored service contract not only to provide maintenance to the radio system but will also provide system upgrades when the equipment needs to be replaced.

This contract will also provide security update services on the Radio System, annual preventive maintenance, and site infrastructure response. The current radio system is aging, and updates and replacement are anticipated.

FISCAL IMPACT & FUNDING SOURCES
The service contract is for the period of July 1, 2024 to June 30, 2026 to be paid annually.

Below in the annual cost of the service agreement.
2024/2025 Total $72,812.66
2025/2026 Total $88,892.55

LEGAL REVIEW
The attached contract was reviewed by the City Attorney. There were no issues reported.

ALTERNATIVE ACTION

1. Approve with changes

2. Deny

3. Table

Agenda Title: Capital Improvements Project Dashboard for July 2024

RECOMMENDED ACTION
Accept the Capital Improvements Project Dashboard for July 2024.

SUMMARY
On December 16, 2014, the Tulare City Council adopted the Tulare Project Management System Program Policy (TPMS).

The dashboards identify the project number, project title, project phase, project manager, start date, end date, budget, expenditures/encumbrances, and special notes regarding the status and/or issues affecting the project.

FISCAL IMPACT & FUNDING SOURCE(S)
Receipt and approval of the Capital Improvement Project Dashboard will not result in any fiscal impact.

Meeting: City Council
Date: July 16, 2024

Submitted by: Michael Miller, City Engineer
Agenda Title: Landscape Maintenance Assessments for Fiscal Year 2024-25

RECOMMENDED ACTION
Adopt a resolution confirming diagram and landscape maintenance assessments and levying assessments for fiscal year 2024-25; and authorize the City Manager to execute a Compliance Certification and Hold Harmless Statement in connection thereto.

SUMMARY
Each year, City Council is required to set landscape maintenance assessments for the upcoming fiscal year.

Therefore, with regard to Proposition 218 requirements, they do not constitute an assessment increase that would trigger the need for property owner approval by ballot.

Due to its size, electronic copies of the Engineers Report will be made available to councilmembers through the City Clerk’s Office. A Compliance Certification and Hold Harmless Statement is required to be signed by the City Manager upon approval of the Council and submitted to the County in conjunction with the assessments.

FISCAL IMPACT & FUNDING SOURCE(S)
There is no fiscal impact associated with this action.

LEGAL REVIEW
This item does not require legal review.

ALTERNATIVE ACTION

1. Approve with changes – Staff will make any requested revisions to the draft Resolution Levying Assessments.

2. Deny – Not an option. Adoption of a Resolution is a legally required step in accordance with the Landscaping and Lighting Act of 1972 for establishing assessments for the coming fiscal year.

3. Table – Assessments for the coming fiscal year must be adopted by Council and provided to the Tulare County Tax Collector’s office by August 12. Tabling this item until the next available Council meeting date (August 6, 2024) would not allow sufficient time for City staff to complete and submit the required documentation to the County by the August 12, 2024 deadline.

Staff Report
Meeting: City Council
Date: July 16, 2024
Department: Community Development - Planning
Submitted by: Steven Sopp, Principal Planner
Agenda Title: Cottonwood 3 Subdivision

RECOMMENDED ACTION
Pass to print an ordinance approving Zone Amendment No. 752.

SUMMARY
This is a request by NFDI LLC to subdivide approximately 13.31-acres and establish an 86-lot single-family residential subdivision. The subject parcel is within the existing City limit boundary. The proposed project is located southeast of the Mooney Blvd. and Foster Dr. ultimate alignments.

Zone Amendment
The subject property is currently designated Low Density Residential within the City adopted 2035 General Plan. The subject property is currently zoned R-1-6 (Single-family Residential 6,000 sq. ft. minimum lot area). The applicant is requesting to change the existing zoning to R1-5 (Single-family Residential, 5,000 sq. ft. minimum lot area) zoning designation.

Paving for an emergency vehicle access will also be required to be provided to attach the existing Mooney Blvd. alignment to the ultimate alignment of Foster Dr.

FISCAL IMPACT & FUNDING SOURCE(S)
As development occurs, payment of entitlement, building permit, development impact fees, etc. will be required.
