6 Staff Report
Meeting: City Council
Date: March 3, 2025
Department: Engineering Services - Engineering
Submitted by: Michael Miller, City Engineer
Agenda Title: Utility Undergrounding Requirements for the Farrar Estates Subdivision
RECOMMENDED ACTION
Consider a request by Woodside 06N, LP for an exception to the requirements to underground existing overhead utilities along the Morrison Street frontage of the Farrar Estates subdivision.
SUMMARY
The Farrar Estates subdivision is located along the west side of Morrison Street north of Tulare Avenue.
The Developer is Woodside 06N, LP (Woodside Homes). In accordance with Chapter 8.24.500(M) of the Municipal Code, the Developer was conditionally required to underground existing overhead utilities along the project’s frontage on the west side of Morrison Street. Along this frontage, there are two locations where electrical service is provided from existing aboveground poles to properties located along the east side of Morrison Street. There is a subsection to the aforementioned chapter of the Municipal Code which states: “The above requirements do not apply to utility lines which do not provide service to the area being subdivided or to electric distribution and transmission lines with a capacity in excess of 66 kV.” Staff’s interpretation of this exception is that it would not apply to the existing poles providing service to properties on the east side of Morrison Street, as these poles are also an integral part of the distribution system serving the Farrar Estates subdivision.
Woodside Homes has been working with SCE to complete the design of the Morrison Street undergrounding, during which time it was determined that eliminating all aboveground poles and undergrounding the services to the east side properties would require the installation of new aboveground poles and guywires on the east side of Morrison Street. This would require the acquisition of new utility easements from the associated property owners. Thus far, efforts to negotiate with property owners to obtain those easements have been unsuccessful and have reached a standstill. The resulting delay is preventing Woodside Homes from completing the undergrounding of utilities along their project frontage and is jeopardizing their ability to energize homes under construction in the Farrar Estates subdivision.
Woodside Homes is requesting that the City grant an exception to the requirement to fully underground utilities along the Farrar Estates frontage, or otherwise provide some form of relief that would allow them to proceed with the development without further delay to their project. Some potential options providing varying degrees of relief that Council could consider include:
Option 1 (least restrictive): City allows two aboveground service poles to be located on the west side of Morrison Street along the Farrar Estates subdivision frontage. These poles would provide overhead electrical service to properties on the east side of Morrison Street as currently exists. Other than these two poles which would be located within the landscaping area behind back of sidewalk, all other utilities along Morrison Street would be placed underground. The Developer would also install conduit under Morrison Street at the service crossing locations to facilitate future undergrounding of overhead lines on the east side.
Option 2: City and Woodside Homes enter into a development agreement that allows for completion of the undergrounding along Morrison Street with two aboveground service poles as a temporary measure, with the City agreeing to assist Woodside Homes with obtaining required SCE easements from property owners on the east side, including potential use of its imminent domain powers. Woodside Homes would be required to cover all costs associated with the City’s acquisition of the easements. Once the Item #: 9.2
General Business
easements were obtained, Woodside Homes would be required to install underground service to the east side of Morrison Street and remove the temporary aboveground service poles. The development agreement would require Woodside Homes to provide security to guarantee completion of the undergrounding improvements. Council could place additional restrictions on either building permit issuance or certificates of occupancy to further secure performance of the work.
Option 3: City and Woodside Homes enter into a development agreement that allows for completion of the undergrounding along Morrison Street with two aboveground service poles as a temporary measure.
The agreement would remain in effect for a specified time period, during which Woodside Homes would be responsible to complete the acquisition of necessary easements from property owners on the east side, install underground service to the east side of Morrison Street, and remove the temporary aboveground service poles. The development agreement would require Woodside Homes to provide security to guarantee completion of the undergrounding improvements. Council could place additional restrictions on either building permit issuance or certificates of occupancy to further secure performance of the work. It should be noted that Woodside Homes has attempted to obtain easements from property owners on the east side of Morrison Street without success.
Council may choose to approve another option or deny any form relief to the statutory requirements to underground utilities along the Farrar Estates frontage of Morrison Street.
FISCAL IMPACT & FUNDING SOURCE(S)
Depending on Council direction, some costs associated with the undergrounding of service lines to properties located on the east side of Morrison Street could get shifted to the City.
LEGAL REVIEW
Any development agreement resulting from Council direction would be reviewed and approved as to form by the City Attorney.
ALTERNATIVE ACTION
1. Approve with changes
2. Deny – Denial of the Developer’s request to grant an exception to utility undergrounding requirements, or some other degree of temporary relief, would significantly impact the continued construction and occupation of homes within the Farrar Estates subdivision.
3. Table – A delay in the City’s decision to grant an exception to utility undergrounding requirements, or some other degree of temporary relief, would begin to affect the continued construction and occupation of homes within the Farrar Estates subdivision in a matter of weeks.
