Summary: In January, the City Council appointed members to serve on the current Downtown Tulare Property-Based Improvement District (PBID) Committee, with additional appointments made in May. Following several public meetings, further interest in serving on the committee was expressed by Adrian Herrera, a property owner in the district. Staff recommend that the City Council appoint Mr. Herrera to the PBID Committee to assist with outreach, discuss the proposed fee structure, and gather feedback from stakeholders.

[M. Miller]
Summary: Planning Commission Resolution No. 5485, which was adopted on June 10, 2024, approved the tentative subdivision map for the Mission Creek subdivision. This subdivision is situated on the southwest corner of Bardsley Avenue and Oakmore Street, covers approximately 39 acres, and will create a total of 255 single-family lots at full buildout.
To streamline the final map approval process, the Subdivider is seeking conditional approval and acceptance from the Council. This is subject to the receipt of the signed map, all fees, and other necessary items within 60 days. Such requests for conditional approval have been routinely accommodated.
Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.
Environmental Review: The tentative subdivision map for Mission Creek was approved by the Tulare Planning Commission on June 10, 2024 by Resolution 5485. A Mitigated Negative Declaration was prepared in support of the tentative map submittal, and the Planning Commission made the finding that there was no substantial evidence that the project would have a significant effect on the environment with the incorporated mitigation measures.
Conflict of Interest: Staff is not aware of any conflicts of interest.
Legal Review: The final map will be reviewed for compliance with applicable legal requirements prior to recordation.
Public Notice: This item does not require a public hearing and was noticed as a part of the agenda.

14.5 Liberty Hill Phase 1 Notice of Completion.
Recommended Action: Accept the required public works improvements for Phase 1 of the Liberty Hill subdivision located on the northwest corner of West Street and Bardsley Avenue, authorize the City Engineer to sign a Notice of Completion (NOC), and direct the City Clerk to file the NOC with the Tulare County Recorder’s Office. [M. Miller] Summary: On June 7, 2022, the City Council conditionally approved the final map for Phase 1 of the Liberty Hill Subdivision, which created 182 single-family residential lots as shown in the attached exhibit. The Subdivider, Century of Communities of California LLC., has completed construction of all required public works improvements in accordance with the approved plans and specifications for this subdivision.
Fiscal Impact & Funding Source(s): One year following Council’s acceptance of the public works improvements, the City will assume responsibility for their ongoing maintenance. The following funding sources will be impacted by the operations and maintenance costs associated with the additional City infrastructure:
• Fund 100 – General Fund – Electrical costs for roadway lighting and maintenance of street improvements.
• Fund 106 – Wastewater Fund – Operations and maintenance of sewer and wastewater treatment infrastructure.
• Fund 107 – Water Fund – Operations and maintenance of water supply and distribution infrastructure.
• Fund 195 – Surface Water Management Fund – Operations and maintenance of storm drain (i.e., surface water) infrastructure.
• Fund 200 – Landscaping & Lighting District Fund – Liberty Hill LMD assessments for maintenance of common lot landscaping, irrigation and parks improvements, drainage basin maintenance and regulatory compliance, and supplemental pavement management efforts on local streets within the district. • Fund 406 – Wastewater CIP Fund – Future replacement costs for sewer infrastructure when it reaches the end of its service life.
• Fund 407 – Water CIP Fund – Future replacement costs for water infrastructure when it reaches the end of its service life.
Environmental Review: The tentative subdivision map for Liberty Hill was approved by the Tulare Planning Commission on June 13, 2018, by Resolution No. 5288.
Legal Review: The City’s Notice of Completion template has been reviewed and approved as to form by the City Attorney.
Public Notice: This item does not require a public hearing and was noticed as a part of the agenda.
Alternative Action: 1) Approve with changes; 2) Deny - Not approving the NOC could prevent the issuance of Certificates of Occupancy for homes within Liberty Hill Phase 1, resulting in Tulare City Council Page 5 of 8
Agenda Memo - September 2, 2025
some home buyers being unable to occupy recently purchased homes; or 3) Table - A delay in the City accepting the improvements would delay some home buyers from occupying recently purchased homes.
14.6 Water Line Easement for CIP Project WT0055 – Hwy 99 Water Crossing.
Recommended Action: Accept a relocated Grant of Easement for water line purposes from Quest Equity, LLC, and authorize a Quitclaim Deed for a portion of a prior easement that will no longer be needed. Authorize the City Manager or his designee to sign the Certificate of Acceptance and Certificate of Conveyance for the same. [M. Miller] Summary: City CIP Project “WT0055 – Hwy 99 Water Crossing” will construct a water main crossing under Highway 99 between Prosperity Avenue and Cartmill Avenue as identified in the City’s Water Master Plan. The alignment selected for the crossing will start near the intersection of Washington Avenue and Gem Street on the west side of Highway 99, cross under Highway 99, and then extend east and north across property owned by Quest Equity, LLC (APN 166- 020-038) to a future point of connection in the Corvina Avenue alignment west of Retherford Street.
On March 19, 2024, the City Council accepted a water line easement from Quest Equity, LLC for the purposes of installing the water main across their property. Since that easement was recorded, Quest Equity, LLC has revised their development plans for the property. They are now requesting that a portion of the easement be relocated further east to avoid conflicts with the future development on their site. The City was able to accommodate the requested relocation in the design Project No. WT0055 and has no objection to Quest Equity LLC’s request to relocate the easement. Quest Equity, LLC has executed the Grant of Easement for the relocation of the water line easement, which can be recorded upon Council’s approval. It will be necessary for the City Manager to sign a Certificate of Acceptance that will be recorded along with the Grant of Easement.
Relocating the water line easement further east will result in an unused portion of the prior easement, which may hinder future development on the property owned by Quest Equity, LLC.
It is recommended that a Quitclaim Deed be executed to transfer ownership rights of this unused portion of the existing easement back to Quest Equity, LLC. A Certificate of Conveyance signed by the City Manager must be recorded alongside the Quitclaim Deed.
Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.
Environmental Review: The dedication or abandonment of water line easements does not require an environmental review.
Conflict of Interest: Staff is not aware of any conflicts of interest.
Legal Review: The standard formats used by staff for Grants of Easement, Quitclaim Deeds, Certificates of Acceptance, and Certificates of Conveyance have been reviewed and approved as to form by the City Attorney.
Public Notice: This item does not require a public hearing and was noticed as a part of the agenda.
Alternative Action: 1) Approve with changes - Staff would work to accommodate minor changes as directed by Council; 2) Deny - The design for CIP Project No. WT0055 is 90% complete. Denying the relocation of the water line easement would necessitate redesigning the Tulare City Council Page 6 of 8
Agenda Memo - September 2, 2025
water line in its original easement location, which would further delay the project. Additionally, the current placement of the water line easement could significantly impact future development of the Quest Equity LLC property; or 3) Table - The resulting delay could jeopardize the City’s ability to meet deadlines associated with federal earmark funding for the project.
14.7 2024-25 Transportation Development Act Claim.
Recommended Action: Adopt a resolution 1) concurring with the Tulare County Regional Transportation Authority’s claim of a portion of the City of Tulare’s Fiscal Year 2025 Transportation Development Act allocation in the amount of $1,118,207.49 in State Transit Assistance, $1,716,303.28 in Local Transportation Funds, and $165,680.85 in State of Good Repair Apportionment “SGR” funds, and 2) authorizing the City of Tulare’s claim of the remainder of $2,170,188.74 in Local Transportation Funds. [M. Miller] Summary: The Mills-Alquist-Deddeh Act (SB 325) was enacted by the California Legislature to improve existing public transportation services and encourage regional transportation coordination. Known as the Transportation Development Act (TDA) of 1971, this law provides funding to be allocated to transit and non-transit related purposes that comply with regional transportation plans.
TDA established two funding sources; the Local Transportation Fund (LTF), and the State Transit Assistance (STA) fund. Providing certain conditions are met, counties with a population under 500,000 (according to the 1970 federal census) may also use the LTF for local streets and roads, construction and maintenance. The STA funding can only be used for transportation planning and mass transportation purposes.
• LTF - Local Transportation Fund (LTF), is derived from a ¼ cent of the general sales tax collected statewide. The State Board of Equalization, based on sales tax collected in each county, returns the general sales tax revenues to each county’s LTF. Each county then apportions the LTF funds within the country based on population. • STA - The STA funds are appropriated by the legislature to the State Controller’s Office (SCO). The SCO then allocates the tax revenue, by formula, to planning agencies and other selected agencies. Statue requires that 50% of STA funds be allocated according to population and 50% be allocated according to transit operator revenues from the prior fiscal year. the Mills-Alquist-Deddeh Act ("Transportation Development Act" or "TDA"), Public Utilities Code Section 99200 et seq., makes certain retail sales tax revenues available to eligible claimants for public transportation projects and purposes.
For Fiscal Year 2025, the City of Tulare is allocated an estimated $1,118,207.49 in State Transit Assistance ("STA") funds and $3,886,492.02 in Local Transportation Funds ("LTF") and $165,680.85 in State of Good Repair “SGR” funds. The Tulare County Association of Governments (TCAG) is responsible for the allocation of TDA funds to eligible claimants within the Tulare County region. To distribute these funds, TCAG requires a resolution from each local agency submitting claims for TDA funding.
During Fiscal Year 2025, the City of Tulare was a member agency of the Tulare County Regional Transit Agency ("TCRTA"). The TCRTA Joint Powers Agreement provides that the member agencies may authorize TCRTA to submit claims for its members' allocated TDA funds if unanimously approved by the directors present and voting at a meeting. TCRTA has submitted a claim for a portion of the City’s TDA allocations in the amount of $1,118,207.49 in State Transit Assistance and $1,716,303.28 in Local Transportation Funds, and State of Good Repair Apportionment “SGR” $165,680.85 to support their operations that serve the City. Concurrence Tulare City Council Page 7 of 8
Agenda Memo - September 2, 2025
granted by City Council resolution is required for TCRTA to receive the portion of the City’s FY 2025 TDA allocation they have requested.
There will be a remaining balance in the City’s Fiscal Year 2025 allocation of Local Transportation Funds in the amount of $2,170,188.74. Authorization by City Council resolution is required to claim this balance of LTF funds. Staff anticipates bringing a future agenda item to Council to determine how to utilize these funds.
A copy of the draft resolution providing the Council’s direction regarding the distribution of the City’s Fiscal Year 2025 TDA funding allocation is attached.
Fiscal Impact & Funding Source(s): There is no immediate fiscal impact associated with this authorization. Upon successful claim and award of TDA funding, staff will return to the City Council for approval and appropriation of the funds.
Environmental Review: This action does not constitute a “project” pursuant to California Environmental Quality Act (CEQA).
Conflict of Interest: Staff is not aware of any conflicts of interest.
Legal Review: This item does not require legal review.
Public Notice: This item does not require a public hearing and was noticed as a part of the agenda.
Alternative Action: 1) Approve with changes; 2) Deny - Denial would result in the loss of TDA funding allocated to the City for Fiscal Year 2025; or 3) Table - Delay in the adoption of the subject resolution could jeopardize the RSTP funding allocation.
15. GENERAL BUSINESS - Comments related to General Business items are limited to three minutes per speaker, for a maximum of thirty minutes per item, unless otherwise extended by Council. For those that wish to provide public comment while viewing the meeting online, you may call (559) 366-1849.

15.1 First Reading of Ordinance to Change Council Meeting Time.
Recommended Action: Pass-to-print an ordinance repealing and replacing Section 1.16.010 (Time, place of regular meetings) of Chapter 1.16 (Council Meetings) of the Tulare Municipal Code to change the start time of regular City Council meetings to 5:30 p.m. [M. Mondell] Summary: Regular City Council meetings are currently scheduled to begin at 7:00 p.m., as established in Tulare Municipal Code Section 1.16.010. In recent years, meetings have frequently extended past 10:00 p.m., with some concluding near or after 11:00 p.m. These late hours, following full workdays for both staff and councilmembers, contribute to fatigue and reduced productivity, particularly during the later portions of meetings when critical decisions are often made.
To address these concerns and promote efficiency and well-being, on August 5, 2025, staff recommended that the Council consider an earlier start time. Following discussion, the Council directed that regular meetings begin at 5:30 p.m.
Pursuant to Section 14 of the City Charter, regular meeting times must be established by ordinance. The attached ordinance repeals and replaces Section 1.16.010 of the Tulare Tulare City Council Page 8 of 8
Agenda Memo - September 2, 2025
Municipal Code to reflect the new start time. Following its first reading, the ordinance is scheduled for adoption on September 16, 2025, with the revised start time taking effect 30 days thereafter.
Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.

Agenda Title: Conditional Final Map Acceptance – Mission Creek
RECOMMENDED ACTION
Conditionally approve the final map and subdivision improvement agreement for the Mission Creek subdivision for recordation, and accept all easements and dedications offered to the City, subject to receipt of the signed final map, all fees, and other required items prior to November 01, 2025.
SUMMARY

Agenda Title: Liberty Hill Phase 1 Notice of Completion
RECOMMENDED ACTION
Accept the required public works improvements for Phase 1 of the Liberty Hill subdivision located on the northwest corner of West Street and Bardsley Avenue, authorize the City Engineer to sign a Notice of Completion (NOC), and direct the City Clerk to file the NOC with the Tulare County Recorder’s Office.
SUMMARY
On June 7, 2022, the City Council conditionally approved the final map for Phase 1 of the Liberty Hill Subdivision, which created 182 single-family residential lots as shown in the attached exhibit. The Subdivider, Century of Communities of California LLC., has completed construction of all required public works improvements in accordance with the approved plans and specifications for this subdivision.
FISCAL IMPACT & FUNDING SOURCES
One year following Council’s acceptance of the public works improvements, the City will assume responsibility for their ongoing maintenance.
ENVIRONMENTAL REVIEW
The tentative subdivision map for Liberty Hill was approved by the Tulare Planning Commission on June 13, 2018, by Resolution No. 5288. A Mitigated Negative Declaration was prepared in support of the tentative map submittal, and the Planning Commission made the finding that there was no substantial evidence that the project would have a significant effect on the environment with the incorporated mitigation measures.

LEGAL REVIEW
The City’s Notice of Completion template has been reviewed and approved as to form by the City Attorney.
LEGAL REVIEW
This item does not require a public hearing and was noticed as a part of the agenda.
ALTERNATIVE ACTION
1. Approve with changes – No impact.
2. Deny – Not approving the NOC could prevent the issuance of Certificates of Occupancy for homes within Liberty Hill Phase 1, resulting in some home buyers being unable to occupy recently purchased homes.
3. Table – A delay in the City accepting the improvements would delay some home buyers from occupying recently purchased homes.

Agenda Title: Water Line Easement for CIP Project WT0055 – Hwy 99 Water Crossing
RECOMMENDED ACTION
Accept a relocated Grant of Easement for water line purposes from Quest Equity, LLC; authorize a Quitclaim Deed for a portion of a prior easement that will no longer be needed; and authorize the City Manager or designee to sign the Certificate of Acceptance and Certificate of Conveyance for the same.
SUMMARY
City CIP Project “WT0055 – Hwy 99 Water Crossing” will construct a water main crossing under Highway 99 between Prosperity Avenue and Cartmill Avenue as identified in the City’s Water Master Plan. The alignment selected for the crossing will start near the intersection of Washington Avenue and Gem Street on the west side of Highway 99, cross under Highway 99, and then extend east and north across property owned by Quest Equity, LLC (APN 166-020-038) to a future point of connection in the Corvina Avenue alignment west of Retherford Street.
FISCAL IMPACT & FUNDING SOURCES
There is no fiscal impact associated with this action.
ENVIRONMENTAL REVIEW
The dedication or abandonment of water line easements does not require an environmental review.
CONFLICT OF INTEREST
Staff is not aware of any conflicts of interest.
LEGAL REVIEW
The standard formats used by staff for Grants of Easement, Quitclaim Deeds, Certificates of Acceptance, and Certificates of Conveyance have been reviewed and approved as to form by the City Attorney.

LEGAL REVIEW
This item does not require a public hearing and was noticed as a part of the agenda.
ALTERNATIVE ACTION
1. Approve with changes – Staff would work to accommodate minor changes as directed by Council.
2. Deny – The design for CIP Project No. WT0055 is 90% complete. Denying the relocation of the water line easement would necessitate redesigning the water line in its original easement location, which would further delay the project. Additionally, the current placement of the water line easement could significantly impact future development of the Quest Equity LLC property.
3. Table – The resulting delay could jeopardize the City’s ability to meet deadlines associated with federal earmark funding for the project.

Agenda Title: Fiscal Year 2025 Transportation Development Act Claim
RECOMMENDED ACTION
Adopt a resolution 1) concurring with the Tulare County Regional Transportation Authority’s claim of a portion of the City of Tulare’s Fiscal Year 2025 Transportation Development Act allocation in the amount of $1,118,207.49 in State Transit Assistance, $1,716,303.28 in Local Transportation Funds, and $165,680.85 in State of Good Repair Apportionment “SGR” funds, and 2) authorizing the City of Tulare’s claim of the remainder of $2,170,188.74 in Local Transportation Funds.
SUMMARY
The Mills-Alquist-Deddeh Act (SB 325) was enacted by the California Legislature to improve existing public transportation services and encourage regional transportation coordination.
Statue requires that 50% of STA funds be allocated according to population and 50% be allocated according to transit operator revenues from the prior fiscal year. the Mills-AlquistDeddeh Act ("Transportation Development Act" or "TDA"), Public Utilities Code Section 99200 et seq., makes certain retail sales tax revenues available to eligible claimants for public transportation projects and purposes.

Agenda Title: First Reading of Ordinance to Change Council Meeting Time
RECOMMENDED ACTION
Pass-to-print an ordinance repealing and replacing Section 1.16.010 (Time, place of regular meetings) of Chapter 1.16 (Council Meetings) of the Tulare Municipal Code to change the start time of regular City Council meetings to 5:30 p.m.
SUMMARY
Regular City Council meetings are currently scheduled to begin at 7:00 p.m., as established in Tulare Municipal Code Section 1.16.010.
The attached ordinance repeals and replaces Section 1.16.010 of the Tulare Municipal Code to reflect the new start time. Following its first reading, the ordinance is scheduled for adoption on September 16, 2025, with the revised start time taking effect 30 days thereafter.
