City Council Staff Report
March 11, 2025

From: Christopher Fisher, Municipal Services Director
Prepared by: James Governale, Administrative Analyst
Agendized by: Reagan M. Wilson, City Manager

1. ACTION RECOMMENDED:

Motion: Discussion and potential direction to staff regarding specific voting privileges for an Ex-officio member of the SRWA Board

2. DISCUSSION OF ISSUE:

The Stanislaus Regional Water Authority (SRWA) Board has discussed a proposed Fourth Amendment to the Joint Exercise of Powers Agreement (JEPA) between the Cities of Turlock and Ceres. The amendment aims to introduce an Ex-officio member with limited voting privileges to resolve tie votes on the SRWA Board. The Board has tabled the amendment for further discussion and consideration at a future meeting.

Background on Amendments to the JEPA
The SRWA was established on September 27, 2011, by the Cities of Ceres, Modesto, and Turlock to construct and maintain the Regional Surface Water Supply Project. SRWA now delivers treated Surface Water from the Tuolumne River to Ceres and Turlock to supplement our groundwater supply.

The JEPA has been amended three times previously:
• 2015 (First Amendment): Allowed voluntary withdrawal, updated voting structure, and made housekeeping changes.
• 2015 (Second Amendment): Adjusted voting rules after Modesto withdrew as a Participant in the JEPA.
• 2018 (Third Amendment): Defined alternate Directors’ roles and addressed long- term debt financing concerns.

Current Issue
Currently, the SRWA Board consists of four Directors—two from Turlock and two from Ceres—making 2-2 tie votes possible. This structure has posed challenges in resolving contentious issues efficiently.

The SRWA Board has previously expressed interest in modifying the language regarding the appointment of an Ex-officio member—an elected or appointed representative from an agency with an interest in the Authority’s purpose and operations. If approved, this Ex- officio member would have a tie-breaking vote to ensure effective governance and prevent decision-making delays.

Because the Board meets only once a month—on the third Thursday—any unresolved tie could postpone decisions for at least another month. This further emphasizes the need for a mechanism to prevent voting deadlocks.

Page 207 of 291 ends

Agenda Staff Report
3/11/2025

A change like this requires a Fourth Amendment to the Joint Exercise of Powers Agreement (JEPA) between Turlock and Ceres.

Key Points of the Proposed Fourth Amendment
• Establishes one Ex-officio member with specific voting privileges on the SRWA Board. Previously, the Ex-officio member served only in an advisory capacity without voting rights.
• The Ex-officio member must be an elected or appointed official from an agency with an interest in SRWA operations.
• The Ex-officio member will only vote in the event of a tie among Directors. • Ensures the Ex-officio will maintain consistent meeting attendance and preparedness for tie-breaking decisions.
• This member would be selected by majority vote of the SRWA Board.

Recent Board Meetings
• December 6, 2024: Staff prepared the proposed amendment for discussion at the SRWA Board meeting. The Board tabled the item for further discussion. • January 16, 2024: Meeting was cancelled.
• February 20, 2025: Staff reintroduced the amendment for discussion. The Board decided to table the amendment again, and asked that each City in the JPA consider the question. The agenda item that was tabled is attached to this staff report in it's entirety for Council's review.

Conclusion
The proposed Fourth Amendment is intended to improve the decision-making process for the SRWA Board by adding a tie-breaking mechanism when needed. The Board has discussed this amendment at two meetings but has decided to table the item for further consideration before taking a formal vote.

Looking ahead, the Board will revisit the proposal at a future meeting. If approved, it will then come before Turlock and Ceres for final authorization.

3. BASIS OF RECOMMENDATION:

Staff is not expressly making a recommendation at this time.

A. The SRWA Board is composed of four (4) members: two (2) from the Turlock City Council and two (2) from the Ceres City Council.

B. The SRWA Board has previously expressed interest in expanding the role of the already-allowable Ex-officio member to give them voting privileges in the event of a tie.

4. FISCAL IMPACT / BUDGET AMENDMENT:

The amendment does not result in additional financial obligations for the City of Turlock or

the SRWA.

5. STAFF RECOMMENDATION:

Recommend approval.

6. CITY MANAGER COMMENTS:

Recommend approval.

7. ENVIRONMENTAL DETERMINATION:

Neither this discussion and direction topic nor the proposed Amendment is not subject to the provisions of the California Environmental Quality Act (CEQA) in accordance with Section 15378(b)(5) of the CEQA guidelines. This action consists of “organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment” and therefore is not considered a project.

8. ALTERNATIVES:

Provide staff direction on how to proceed.

Page 209 of 291 ends

From: Christopher Fisher, General Manager
Prepared by: James Governale, Administrative Analyst (City of Turlock)

1. ACTION RECOMMENDED:

Motion: Approving of an Amendment to the Joint Exercise of Powers Agreement between the Cities of Ceres and Turlock for the Stanislaus Regional Water Authority and directing the General Manager to submit the amendment to the Cities of Turlock and Ceres for approval and execution

2. DISCUSSION OF ISSUE:

Staff propose the Board of Directors’ review and approval of an amendment to the Joint Exercise of Powers Agreement (JEPA) between the Cities of Turlock and Ceres.

History
On September 27, 2011, the Cities of Ceres, Modesto, and Turlock executed an agreement to form the Stanislaus Regional Water Authority (SRWA) as a Joint Powers Authority (JPA). The goal was to "pursue the development and implementation of the Regional Surface Water Supply Project, which will provide a new supply of treated surface water to customers of the Cities to help meet existing and future water needs, improve drinking water quality, and aid the sustainable management of the groundwater basin" (Recital A of the Design-Build Contract with CH2M Hill Engineers, Inc., City of Turlock Contract 2021-094).

On November 20, 2015, the Board approved the first amendment to the JEPA, which allowed a participant to voluntarily withdraw from the SRWA, updated the voting structure of the Board, and implemented other housekeeping changes.

On December 15, 2015, the Board approved the second amendment to the JEPA to update the voting structure following the withdrawal of the City of Modesto.

The third amendment to the JEPA was executed on July 1, 2018 with a goal to:
• Provide for alternate Directors and clarify how the Directors and their alternates function on the Governing Board.
• Address concerns over the SRWA’s ability to secure long-term debt.

Current Information
The SRWA Board has expressed its desire to appoint one Ex-officio member “who is an elected or appointed representative of an agency with any an interest in the purpose and operation of the Authority, and who shall be granted the power to vote Item 7A

on a duly agendized matter before the Governing Board only when required to break a deadlock caused by a tie vote by the Directors. The permanent Ex -officio member shall regularly attend Governing Board meetings and be prepared when necessary to vote on any matter that results in a tie vote” (text from the Amendment, paragraph 3).

To implement this change, a fourth amendment must be approved by City of Turlock and the City of Ceres.

Staff recommends approval of this fourth amendment to the Joint Exercise of Powers Agreement between the Cities of Turlock and Ceres.

3. FISCAL IMPACT/BUDGET AMENDMENT:

The amendment does not result in additional financial obligations for the SRWA.

4. GENERAL MANAGER’S COMMENTS:

The General Manager recommends approval of this action.

5. ENVIRONMENTAL DETERMINATION:

This action is not subject to the provisions of the California Environmental Quality Act (CEQA) in accordance with Section 15378(b)(5) of the CEQA guidelines. This action consists of “organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment” and therefore is not considered a project.

6. ALTERNATIVES:

The Board could elect to not approve the agreement or direct the General Manager to submit it to the Cities of Turlock and Ceres . This approach is not recommended, as this action is presented as a result of feedback given by the Board.

AMENDMENT TO THE JOINT EXERCISE OF POWERS AGREEMENT

BETWEEN THE CITIES OF CERES AND TURLOCK

FOR THE PURPOSE OF CREATING A JOINT POWERS

AUTHORITY RESPONSIBLE FOR DECISIONS IN CERTAIN MATTERS

PERTAINING TO THE MUNICIPAL AND INDUSTRIAL WATER SUPPLY

PROGRAMS FOR THE AFOREMENTIONED PUBLIC ENTITIES DATED
DECEMBER 15, 2015, TO PROVIDE FOR THE APPOINTMENT OF A

PERMANENT EX-OFFICIO GOVERNING BOARD MEMBER

This “Amendment” to the Joint Exercise of Powers Agreement Between the Cities of Ceres and Turlock for the Purpose of Creating a Joint Powers Authority Responsible for Decisions in Certain Matters Pertaining to the Municipal and Industrial Water Supply Programs for the Aforementioned Public Entities dated December 15, 2015 (“Agreement”) is made by and between the City of Ceres and the City of Turlock and shall be effective on the date of the last signature shown below.

1. Recitals. The Governing Board of the Authority has determined that it is possible that the Board could deadlock in a 2-2 vote on matters that come before it for approval, and thus has determined that authorizing a representative from an agency interested in the Authority’s purpose and operation to vote on a matter only in the event of a tie vote would be beneficial for ensuring the most efficient governance of the Authority’s business. For these reasons, the Governing Board has recommended that the City Councils of Ceres and Turlock agree to amend the Agreement as provided below.

2. Definition U on page 3 of the Agreement is hereby amended and replaced in full as follows:

U. “Ex-officio” means a non-voting member of the Governing Board appointed by the Directors of the Governing Board to serve in an advisory capacity, except that the Governing Board shall appoint one Ex-officio member from an agency interested in the Authority’s affairs who shall be a designated officer and have the powers provided in Section A of Article V of this Agreement.

3. Section A of Article V on page 5 of the Agreement is hereby amended and replaced in full as follows:

A. Governing Board: The Authority shall be administered by a Governing Board which shall be comprised of the following: Through December 31, 2015, one (1) member from each City Council of each City which is a Participant. Effective January 1, 2016, two (2) members from each City Council of each City which is a participant. Within 60 days after the execution of this Agreement by the Participants, each Participant shall designate its Governing Board member (Director) and an alternate. Each Director of the Governing Board shall have one vote which shall be equal in weight to the vote of each other Director. The Mayor of 3 of 5

each Participant may be a Director in lieu of a City Council person and termination of a Director's status as a Councilmember or Mayor shall constitute automatic termination of that person's Directorship on the Authority's Governing Board. The appointing City may appoint a new Director or alternate Director immediately upon the occurrence of any vacancy in that party's representation, or the alternate Director appointed pursuant to this Article V may serve until a new Director is appointed. Each City shall appoint one alternate Director to serve the Authority during the absence of any regular Director from any meeting of the Authority, and that Director's alternate shall be entitled to participate in all respects as a regular Director of the Authority. Effective January 1, 2016, the current alternate shall become a voting member of the Board and the alternate position shall be eliminated.

The Governing Board may have Ex-officio members as the Governing Board shall from time-to-time designate. Each Ex-officio member shall serve in a non-voting, advisory capacity. Notwithstanding the forgoing, the Directors of the Governing Board shall appoint one permanent Ex-officio member who is an elected or appointed representative of an agency with any interest in the purpose and operation of the Authority, and who shall be granted the power to vote on a duly agendized matter before the Governing Board only when required to break a deadlock caused by a tie vote by the Directors. The permanent Ex-officio member shall regularly attend Governing Board meetings and be prepared when necessary to vote on any matter that results in a tie vote.

4. Section D of Article V on page 6 of the Agreement would be amended and replaced in full as follows:

D. Officers: The Governing Board shall select a Chair and a Vice Chair from among the Directors serving by appointment of the Participants. It shall then appoint a General Manager, a Secretary and any other officers as determined necessary by the Governing Board. The Chair shall preside at all Authority meetings. The Vice Chair shall act in place of the Chair at meetings should the Chair be absent. All officers shall serve at the pleasure of the Board.

5. Effect on Agreement. Except as specifically amended herein, all of the terms of the Agreement shall remain unchanged, valid and in full effect. This Amendment shall take effect immediately upon its approval by the City Councils of Ceres and Turlock and its full execution by the authorized representatives of the two Cities.

IN WITNESS WHEREOF, the Participants’ authorized representatives have executed this Amendment, to be made effective as of the date that the last authorized representative signs below.

City Council Staff Report
March 11, 2025

From: Jessie Dhami, Human Relations Director
Prepared by: Jessie Dhami, Human Relations Director
Agendized by: Reagan M. Wilson, City Manager

1. ACTION RECOMMENDED:

Resolution: Approving the salary range for Police Chief from 42.1 to 43.6 and amending the Management Salary Schedule effective February 25, 2025 through June 30, 2025 (Dhami)

2. DISCUSSION OF ISSUE:

On February 11, 2025, the City Council approved a Tentative Agreement to conclude labor negotiations for Fiscal Year 2024-2025 with Turlock Management Association Public Safety (TMAPS). As a result, a seven percent (7%) salary increase took effect retroactively to July 1, 2024, for TMAPS’ police management personnel. The recent increase for TMAPS’ police management personnel created salary compaction issues between the Police Captain and Police Chief.

Prior to the TMAPS agreement, the base salary difference between the Police Captain and Police Chief was approximately 27%. However, after the 7% base salary increase for the Police Captain, the new difference in base salary range has been reduced to approximately

18.6%.

To restore a base salary differential between Police Captain and Police Chief, staff recommends adjusting the Police Chief’s base salary range from:

Current Range: 42.1 ($15,018 - $18,255 monthly)
Proposed Range: 43.6 ($16,166 - $19,651 monthly)

The Police Chief is designated as Management for labor relations purposes and is considered exempt under the Fair Labor Standards Act (FLSA).

3. BASIS OF RECOMMENDATION:

The recent 7% base salary increase for the Police Captain has significantly reduced the salary spread between the Police Captain and the Police Chief, creating a compaction issue that must be addressed.

To maintain equity and ensure competitive salaries for key leadership positions, staff recommends the City Council approve the proposed salary range adjustment for the Police Chief.

City Council approval is required for any new and/or updated salary ranges.

4. FISCAL IMPACT / BUDGET AMENDMENT:

The fiscal impact of this amendment is $7,396 to salary and various benefit expense account numbers in 110-20-210 "General Fund, Police Field Operations" from February 25,

Page 215 of 291 ends

Agenda Staff Report
3/11/2025

2025 through June 30, 2025. The entire cost of this amendment for a full fiscal year is $22,188. No augmentation is needed in FY 2024-2025 due to salary savings resulting from vacancies.

5. STAFF RECOMMENDATION:

Recommend approval.

6. CITY MANAGER COMMENTS:

Recommend approval.

City Council Staff Report
March 11, 2025

From: Jessie Dhami, Human Relations Director
Prepared by: Jessie Dhami, Human Relations Director
Agendized by: Reagan M. Wilson, City Manager

1. ACTION RECOMMENDED:

Resolution: Approving the salary range for Deputy City Manager from 41.1 to 42.5 and amending the Management Salary Schedule effective February 25, 2025, and appropriate $6,276 to various salary and benefit account numbers 110-10-102 "General Fund, Administration, City Manager" and 501-10-130 "Information Technology, Administration, Information Tech-Operations" from February 25, 2025, through June 30, 2025.

The recent increase in TMAPS’ police management personnel created salary compaction issues between the Police Captain and Police Chief, and also the Deputy City Manager.

Prior to the TMAPS agreement, the base salary difference between the Police Captain and Police Chief was approximately 27%. However, after the 7% base salary increase for the Police Captain, the new difference in salary range has been reduced to approximately

18.6%.

To maintain a base salary differential between Deputy City Manager, Police Chief and Police Captain, ensuring internal equity within the management salary structure, staff recommends adjusting the Deputy City Manager’s salary range from:

Current Range: 41.1 ($14,302 - $17,385 monthly)
Proposed Range: 42.5 ($15,320 - $18,623 monthly)

The Deputy City Manager is designated as Management for labor relations purposes and is considered exempt under the Fair Labor Standards Act (FLSA).

3. BASIS OF RECOMMENDATION:

The recent 7% base salary increase for the Police Captain has significantly reduced the salary spread between the Police Captain and the Police Chief, thus creating compaction issues between the Deputy City Manager, Police Chief and Police Captain that must be addressed.

To maintain equity and ensure competitive salaries for key leadership positions, staff recommends the City Council approve the proposed salary range adjustment for the Deputy City Manager.

Agenda Staff Report

City Council approval is required for any new and/or updated salary ranges.

4. FISCAL IMPACT / BUDGET AMENDMENT:

The entire cost of this amendment for a full fiscal year is $18,828.

City Council Staff Report
March 11, 2025

From: Jessie Dhami, Human Relations Director
Prepared by: Jessie Dhami, Human Relations Director
Agendized by: Reagan M. Wilson, City Manager

1. ACTION RECOMMENDED:

Approving the salary range for City Manager from 44.3 to 45.7 and amending the Management Salary Schedule effective February 25, 2025, and appropriate $6,960 to salary and various benefit account numbers in 110-10-102 "General Fund, Administration, City Manager" from February 25, 2025, through June 30, 2025.

The recent increase for TMAPS’ police management personnel created salary compaction issues between the Police Captain, Police Chief and the City Manager.

Prior to the TMAPS agreement, the base salary difference between the Police Captain and Police Chief was approximately 27%. However, after the 7% base salary increase for the Police Captain, the new difference in salary range has been reduced to approximately

18.6%.

To maintain a base salary differential between the Police Chief and City Manager, within the management salary structure, and ensure internal equity, staff recommends adjusting the City Manager’s salary range from:

Current Range: 44.3 ($16,723 - $20,328 monthly)
Proposed Range: 45.7 ($17,913 - $21,774 monthly)

The City Manager is designated as Management for labor relations purposes and is considered exempt under the Fair Labor Standards Act (FLSA).

3. BASIS OF RECOMMENDATION:

The recent 7% base salary increase for the Police Captain has significantly reduced the salary spread between the Police Captain and the Police Chief, thus creating a compaction issue between the Police Chief and City Manager that must be addressed.

To maintain equity and ensure competitive salaries for key leadership positions, staff recommends the City Council approve the proposed salary range adjustment for the City Manager.

City Council approval is required for any new and/or updated salary ranges.

In an effort to retain Chief Hedden’s services and provide further leadership and stability to the City’s Police Department, the City seeks to extend Chief Hedden’s employment agreement through March 10, 2030.

The proposed First Amended and Restated Employment Agreement places Chief Hedden at step 5 of the Management salary schedule (Range 43.6), which currently equates to a base salary of Nineteen Thousand, Six Hundred and Fifty One Dollars ($19,651) per month provides further incentive pay for Police Officers Standards and Training (POST) Certifications, and provides holiday “in-lieu” time offered to other Directors within the City service.

3. BASIS OF RECOMMENDATION:

The City seeks to extend the employment contract of Chief Hedden through March 10, 2030. In so doing, the City will ensure the retention of Chief Hedden beyond the expiration date of his original employment agreement which is set to expire on or about February 15, 2027. Retaining Chief Hedden will provide the City with leadership and stability within the City of Turlock Police Department.

4. FISCAL IMPACT / BUDGET AMENDMENT:

The fiscal impact of this amendment is $12,432 to salary and various benefit expense account numbers in 110-20-210 "General Fund, Police Field Operations" from March 11, 2025 through June 30, 2025. The entire cost of this amendment for a full fiscal year is $22,188. No augmentation is needed in FY 2024-2025 due to salary savings resulting from vacancies.

During the month of February, members of the Turlock PD Command Staff covered two Team Works Summits (Emotional Intelligence and How to be a Team Player) during their weekly Command Staff Meetings. This was made possible with the City of Turlock’s partnership with LeaderGov.

On February 7th, the Street Crimes Unit officially hit the streets. This dynamic and proactive unit is focused on street-level crimes and gang-related investigations. Stay tuned to see what they encounter!
On February 10th, we swore in two outstanding officers: Officer Suarez and Officer Tavares. Both recently graduated from the police academy, but they’re no strangers to Turlock PD. Before becoming officers, they each served in different roles within our department, and we’re proud to have them continue their careers with us! Officer Suarez was recognized for her athleticism in the academy. While she didn’t receive the physical fitness award, her hard work and determination were clear, and we’re so proud of her accomplishments!
Officer Tavares excelled academically, achieving an impressive 97.8% across all categories, and was honored with the “10-11” award, which is selected by his peers to recognize the officer they’d want as their “back-up.” On February 19th, our annual Community Academy began! Thirteen eager members of the Turlock community have been meeting once a week to learn about how the Turlock Police Department functions. For eight weeks, members from various units will present and answer questions about their roles. Additionally, participants have the opportunity to hit the streets with patrol officers during a ride-along as part of the program.

CITY MANAGER’S MONTHLY UPDATE
This month, we are pleased to share that our two new fire engines have arrived. They are currently being outfitted with new equipment and we anticipate them going into service next month. We appreciate all the hard work that has gone into preparing these engines, ensuring they are ready to serve our community effectively.

TURLOCK FIRE DEPARTMENT
February 2025
CHIEF’S

MESSAGE
Additionally, we took time to recognize the crews who responded to a recent CPR call, where Francisca Neves (16 years old) played a critical role in assisting her father during a cardiac event. Her quick actions in performing CPR until Engine 33 arrived were instrumental in giving him the best possible chance of survival. We also want to recognize the outstanding efforts of Captain Sean Burdick, Engineer James Lazette, and Firefighter Kurt Seeberger who provided exceptional patient care upon arrival. Moments like these highlight the importance of CPR training and the life-saving impact that early intervention can have.

Business Retention and Expansion (BRE) is a critical component of economic development. The primary focus of BRE initiatives is to support existing businesses within the City.

Existing businesses contribute significantly to job creation and economic stability. By helping them grow, communities can sustain economic health and reduce the risk of business closures.

During the months of January 2025 and February 2025, City of Turlock Economic Development Department staff met with 30 local businesses.

Workforce development within economic
development refers to a set of strategies and activities designed to enhance the skills, knowledge, and
capabilities of the local labor force to meet current and future economic and industry needs.

It is an important element of economic development
because a well-trained and adaptable workforce is vital for attracting and retaining businesses, fostering
innovation, and driving economic growth.

The City recently partnered with Fresno State - Parent University to offer no-cost virtual courses to all Turlock residents (of all ages). Upon completion of each 4 week course, participants will receive a certificate from Fresno State University. There were 103 registrations for the first session that started in October 2024, 30 registrations in November 2024, and 130 registered for February 2025.

Attraction strategies within economic development are designed to draw new businesses, industries, and investments to a region. These strategies typically involve a combination of marketing, incentives, infrastructure development, and partnership-building to create a compelling case for businesses to relocate or expand.

The WISP (Westside Industrial Specific Plan) is a key asset to our Turlock community, fostering a thriving industrial ecosystem that supports local businesses, creates jobs, and strengthens Turlock’s economy.

Through smart planning and strategic growth, this area continues to drive innovation, sustainability, and opportunity—all while reinforcing a circular economy that benefits our entire city.

We’re proud to showcase the vision behind this development and excited for what’s ahead! 6 Attraction

Supporting start-ups and entrepreneurs is a strategic investment within economic development.

Innovation can drive new ideas, technologies, and create the “Spark” of a new business to open up, resulting in job creation, and adding more value to the local economy. One of the ways that the City of Turlock supports start-ups and entrepreneurs is by providing no-cost business workshops and implement business development programs. Business workshops take place within the City of Turlock monthly, and have different topics and strategies presented by different guest speakers. 7 Business Workshops
The City of Turlock’s newly launched Small Business
Development and Assistance Program provides
strategic consulting and business development
strategies to elevate Turlock small businesses. The
businesses eligible to participate must be Turlock
businesses that have a business license with the City of Turlock, operate out of a commercial location in
Turlock, have no more than 50 employees, and not be
part of a franchise or corporate chain.

The business development program is limited to 100
businesses and will provide up to $3,500 (while funds
last) for online business ads through Google Search
Ads and Meta (Facebook/Instagram) Ads.

Planning Projects
_____________________________________

• In February, the Planning Division received an application (MDP 25-05) requesting approval for a mobile truck washing business to operate within an existing 16,000-square-foot warehouse located at 420 and 430 N. Kilroy Road. The new tenant will manage wastewater from off-site washing operations by directing it to an on-site holding tank, where sediment will be allowed to settle before the remaining water is treated and discharged into the drain.

All trucks associated to the business will be parked inside the warehouse, with no vehicle washing conducted on-site.

• The Planning Division coordinated and hosted 4 Predevelopment meetings in February.
