BACKGROUND:
The City received a request from NV5 to vacate a portion of Foothill Drive between Bullion Avenue and Split Rock Avenue. This item is an ancillary application to the Reset Hotel project, which is currently under construction as of the time of this Staff Report. This action would vacate a segment of Foothill Drive, a public road easement, that is located between two parcels owned by the proprietors of the Reset Hotel.
On March 26th, 2024 the City Council adopted Resolution 24-02, “A Resolution of the City Council of the City of Twentynine Palms, California, giving notice of the City Council's intention to vacate Foothill Drive
from the easterly boundary of Bullion Avenue to the westerly boundary of Split Rock Avenue shown on Parcel Map 20360, a length of 813.36’, and fixing the time and place for Public Hearing thereon." The Public Hearing was set for this Council meeting, on April 23, 2024. The City Clerk published the notice of the Public Hearing two successive weeks before the Public Hearing. The notice was also posted on Foothill Drive two weeks before the Public Hearing.
Pursuant to the Streets and Highways Code, the following is the procedure to vacate the requested street:
"8324. (a) At the hearing, the legislative body shall hear the evidence offered by persons interested.
(b) If the legislative body finds, from all the evidence submitted, that the street, highway, or public service easement described in the notice of hearing or petition is unnecessary for present or prospective public use, the legislative body may adopt a Resolution vacating the street, highway, or public service easement."
"8325. (a) The clerk shall cause a certified copy of the Resolution of vacation, attested by the clerk under seal, to be recorded without acknowledgment, certificate of acknowledgment, or further proof in the office of the recorder of the county in which the property is located. (b) Upon such recordation, the vacation is complete."
Once the City Council adopts the Resolution vacating the road easement, the City Clerk will record the Resolution of vacation. After the Resolution is recorded, the road easement shall no longer constitute a right-of-way over that portion hereinabove described property.
Currently, there is an existing water main within the Foothill Drive Road easement. Staff has contacted the Twentynine Palms Water District regarding their water main. The Water District has requested that a permanent easement for water utility access and service rights remain over their water main. The attached Resolution vacating Foothill Drive reserves from the vacation of the easement, all rights to construct, maintain, operate, remove, and renew all existing public utilities, including the water district's facility.

ATTACHMENTS:
• Policy No. 1
• Sample Policy No.1 Update
BACKGROUND:
The City's current policy on waiving fees dates back to September of 1989. It does not place a limit on the amount of days that any qualified organization can request to rent city facilities without being charged a rental fee. Over the past two decades, the Recreation Department has permitted one free (one day) rental to all qualified organizations per calendar year. The language in the original policy should be updated and reflect currently practiced procedures for approval. This topic recently became the issue of public discussion due to an organization requesting a fee waiver for a multi-day event and rental of the community center gymnasium.
ENVIRONMENTAL:

ALTERNATIVES:
The City Council could choose to keep the current policy in place.
FISCAL IMPACT:
Fee waivers for facility rentals should be limited in order to recapture hard costs associated with wear and tear, janitorial supplies, basic maintenance and staffing.

BACKGROUND:
Proposed Project:
The current Public Works Department procedure for "Roadway Flooded" advanced warning is loading type 2 barricades (A frame) with yellow flashing lights and "Flooded" signs attached on to a stake bed truck, travel to flooded roadways, and place signs on edge of roadway. Flooded roads and future forecasts are then monitored to determine when to return and remove the warning signs. This procedure can be dangerous, we have experienced near misses from traffic and our vehicles and staff members during the placement and removal of signs in the past.
Our City is 58 square miles. Staff members could mobilize to identify "hotspots", assess the known flooding areas and through the Bluetooth app, activate the LED illuminated signs which have enhanced visibility and include a sign that indicates "WHEN FLASHING". This procedure would substantially reduce response time, reduce the risk of Staff exiting vehicles on roadways during storm conditions, eliminate the situation where barricades are displaced by wind or hit by vehicles as they are placed near the road edge.
Public Works Staff members have discussed extensively how to improve the current protocol. They are enthusiastic about the benefits the LED illuminated signs would bring to their flood warning response protocol and their safety. Public Works Staff will install the signs at the listed locations. (see attached).
Background of Grant Source provided by CIRA:
CIRA is a collaborative group of public agencies providing excellent risk financing programs. We provide innovative and evolving risk management solutions. We support our mission through conservative fiscal management, proactive claims management, and the implementation of cost-effective loss prevention programs. Our excellent loss history, coupled with sound fiscal planning, results in significant savings to members.
CIRA was formed in 2021 by the joining of two existing joint power authorities, the Public Agency Risk Sharing Authority of California (PARSAC) and the Redwood Empire Municipal Insurance Fund (REMIF), with a total of 50 members that has grown to 53 members over the last few years. CIRA offers its members two pooled programs, workers’ compensation and general liability, and group insurance programs ranging from property to cyber.
As Twentynine Palms was a member of PARSAC before the merger, it also has funds in the form of flexible spending funds. This fund receives its funds from the allocation of past workers’ compensation, liability, property equity, and ERMA dividends. Funds are returned to members in the same ratio they were collected (i.e., premium, payroll, or retrospective premium adjustment formula). Members may use their flexible spending funds for any public purpose, including but not limited to, developing safety programs and policies, training, attending professional development conferences, equipment purchases, ADA improvements, offsetting rate increases, assessments, or premium payments, etc., including all CIRA programs. However, funds may not be used to pay salary, benefits, or claims-related expenses.
Twentynine Palms currently has $142,365.35 available in its flexible spending.

FLEXIBLE SPENDING FUND PLAN
WHEREAS, the Public Agency Risk Sharing Authority of California (PARSAC) participates in the Employment Risk Management Authority (ERMA) for Employment Practices Liability coverage; and
WHEREAS, PARSAC participated in the California Affiliated Risk Management Authority (CARMA) for excess General Liability coverage from July 1, 1993 to June 30, 2009; and
WHEREAS, ERMA and CARMA are both risk sharing authorities and return surplus equity to its members from time to time as excess dividends; and WHEREAS, PARSAC has received ERMA and CARMA dividends of $7,957,405 through June 30, 2020; and

WHEREAS, designated equity funds will not transfer to CIRA after the merger; and WHEREAS, the Board of Directors has sole discretion in determining the best use of designated equity funds.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of PARSAC that a Flexible Spending Fund plan shall be adopted per the following:
1. Designated equity funds shall be returned to members in the same ratio in which they were collected, i.e. premium, payroll or retrospective premium adjustment formula.
2. Each current member may be allocated its pro rata share of designated equity funds in a flexible spending fund account, or as dividends, in the Board’s discretion.
3. Funds identified through the liability or workers’ compensation programs’ retrospective premium allocation formula may also be allocated to the members’ flexible spending fund, or returned as dividends, at the discretion of the Board.
4. 9. If designated equity funds are returned as dividends to members, they shall not be returned to a withdrawn member until all years in which the withdrawn member participated in PARSAC are closed. If a withdrawn member has a deficit balance in any Program Year, the withdrawn member’s designated equity shall be used to offset all deficits before any funds are returned.
Effective Date. This Resolution shall become effective upon approval by two-thirds of the Board of Directors present and voting.
