BACKGROUND:

On June 5, 2018, California voters passed Proposition 68 (Prop 68) by 57.6%, which is also known as the Natural Resources Bond or the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act of 2018. The $4.1 billion in bond proceeds fund projects related to drought, water, parks, climate, coastal protection, and outdoor access.

On April 3, 2024, the Finance Director was contacted by Sergey Fomin, an Auditor with the California Department of Finance, Office of State Audits and Evaluations (OSAE), to inform her that his department would be conducting an audit of two Prop 68 grants awarded to the City by the California Natural Resources Agency (CNRA). The two grants selected were as follows:

1. N86720-0: $2,000,000 for the Project Phoenix Cultural Center and Joshua Tree Visitor Center.

The project was completed in June 2022. The project elements included a gift shop, entry lobby, exhibit hall, an office, a break room, and two restrooms.

2. TG8729-0: $901,850 for Phase 1 of the City’s Flood Control Channel Trail between Split Rock Avenue and Adobe Road. The project was completed in April 2024. The project elements included approximately 2,000 linear feet of Class 1 trail with two trailheads, benches, trash receptacles, and desert landscaping.

The objective of this audit was twofold: to determine whether the City's claimed grant expenditures were in compliance with the grant agreements' requirements and to determine whether grant deliverables were completed by the City as required in the grant agreements.

Page 5 of 114 ends

The risk assessment procedures included an evaluation of the City's key internal controls to determine whether they were properly designed, implemented and operating effectively; however, no opinion was expressed on the effectiveness of the City's internal controls. The evaluation focused on key processes including review and approval of grant expenditures, procurement procedures, project monitoring, and reporting requirements.

In September 2024, the California Department of Finance, Office of State Audits and Evaluations, issued its final report dated September 23, 2024, noting there were no audit findings with regards to the two grants audited. The results provided by the California Department of Finance (OSAE) are as follows:
"Based on the procedures performed and evidence gathered, we obtained reasonable assurance the claimed grant expenditures, excluding any CNRA adjustments, complied with the grant agreements’ requirements.

Additionally, we obtained reasonable assurance the grant deliverables were completed as required in the grant agreements."
For more information regarding the audit objectives and audit procedures, please refer to the attached Prop 68 Grant Audit Report.

1 BACKGROUND, SCOPE,

METHODOLOGY, AND RESULTS

BACKGROUND
California voters approved the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access For All Act of 2018 (Proposition 68). The $4.1 billion in bond proceeds fund projects related to drought, water, parks, climate, coastal protection, and outdoor access for all.1
The City of Twentynine Palms, located in the Morongo Basin area of San Bernardino County, serves as a gateway community to the Joshua Tree National Park, Marine Air Ground Task Force Training Command, Marine Corps Air Ground Combat Center, the Mojave National Preserve, Amboy Crater, Route 66, and other desert destinations. 2 The
California Natural Resources Agency (CNRA) awarded the City two Proposition 68 grants as follows:
• Grant Agreement N86720-0: $2,000,000 was awarded through CNRA’s Cultural, Community, and Natural Resources Program (CCNR) for the Project Phoenix Cultural Center and Joshua Tree Visitor Center. The project was to build a visitor center for Joshua Tree National Park and a cultural center for the Twentynine Palms and San Manuel Bands of Mission Indians to protect, restore, and enhance California’s cultural, community, and natural resources.
3 Two amendments were executed to extend the project
performance period, revise the project scope, revise the project cost estimate, and amend special provisions for the release of final retention. This project is complete.
• Grant Agreement TG8729-0: $901,850 was awarded through CNRA’s Recreational Trails and Greenways Grant Program (RTG) for the Twentynine Palms Flood Control Channel Trail Development. The grant funds were used to construct non-motorized recreational infrastructure development and enhancements that promote new or alternate access to parks, waterways, outdoor recreational pursuits, and forested or other natural environments to encourage health-related active transportation and opportunities for Californians to reconnect with nature.
4 Five amendments were executed to
extend the project performance period and to amend the project scope and cost estimate to better align with the project elements. This project is complete.

Page 11 of 114 ends

3 Upon receipt, CNRA reviewed the claims and made adjustments for ineligible costs. Our audit did not include an evaluation of the validity of adjustments, including ineligible costs, identified by CNRA.

The City’s management is responsible for ensuring accurate financial reporting and compliance with applicable laws, regulations, and grant requirements. CNRA is responsible for the state-level administration of the bond program.

METHODOLOGY
To plan the audit, we gained an understanding of the grants and respective bond program, and identified relevant criteria, by interviewing CNRA and City personnel, reviewing the grant agreements and amendments, CCNR and RTG guidelines, and applicable state laws and regulations.

We conducted a risk assessment, including evaluating whether the City’s key internal controls significant to our audit objectives were properly designed, implemented, and operating effectively. Key internal controls evaluated focused on key processes related to the review and approval of grant expenditures, project expenditure accounting, payment request preparation, contract procurement, and the monitoring of project deliverables and reporting requirements. Our assessment included conducting interviews with City personnel, observing processes, and testing transactions related to grant expenditures, contract procurement, and project deliverables.

Additionally, we assessed the reliability of general ledger reports generated by the City’s accounting system, AccuFund. To assess the reliability of data generated by this system, we interviewed City staff, reviewed existing information, performed data testing, and traced expenditures to and from source documents. We determined the data were sufficiently reliable to address the audit objectives.

Based on the results of our planning, we developed specific methods for gathering evidence to obtain reasonable assurance to address the audit objectives. Our methods are detailed in the Table of Methodologies.

Page 12 of 114 ends

4 Table of Methodologies
Audit Objective Methods
Objective 1:

To determine
whether the City’s
claimed grant
expenditures were in
compliance with the
grant agreements’
requirements.
• Selected items from the significant and/or high-risk
expenditure task categories to verify compliance with
grant requirements as follows:
o Grant Agreement N86720-0: Selected from three
reimbursement claims from the most quantitatively
significant expenditures within the Rough Carpentry,
Plumbing: Site and Building, and Construction
Management task categories.
o Grant Agreement TG8729-0: Selected one
reimbursement claim from the most quantitatively
significant expenditures within the Building Elements
task category, specifically the Concrete Bike Path
and Wire Fencing subtasks.
• Determined if selected expenditures were allowable,
grant-related, incurred within the grant period, and
supported by accounting records, by reviewing grant
agreements and amendments, CCNR and RTG
guidelines, general ledger reports, the expenditure
tracking spreadsheet, construction and consultant
contracts, vendor invoices, bid documents, and daily
inspection reports, and comparing to relevant criteria. • Evaluated whether other revenue sources or similar grants existed and whether they were used to reimburse
expenditures claimed under the grant agreements by
reviewing the City’s reimbursement claims to CNRA,
vendor invoices, and general ledger reports to identify possible duplicate payments.
• Determined whether the City complied with procurement requirements:
o Selected one construction contractor and
interviewed City personnel, reviewed bid
advertisements, bid packages, date and time
stamped bid envelopes, bid results, City Council
meeting minutes, and the construction contract, and
compared to relevant criteria.
o Selected one consultant contractor and interviewed
City personnel, reviewed the Request for Proposals
(RFP), proposal packages, the evaluation and
ranking of RFP, evaluation results, City Council
meeting minutes, and the consultant contract, and
compared to relevant criteria.

Page 13 of 114 ends

5 Audit Objective Methods
Objective 2:

To determine
whether the grant
deliverables were
completed as
required in the grant
agreements.
• Selected deliverables that were deemed significant
because the deliverables were critical to achieving the grants’ purposes as follows:
o Grant Agreement N86720-0: Determined whether
the City completed the Project Phoenix Cultural
Center and Joshua Tree Visitor Center by reviewing
the Certification of Completion form and Notice of
Completion report, conducting a site visit, and
comparing to the grant requirements.
o Grant Agreement TG8729-0: Determined whether
the City completed the Flood Control Channel Trail
Development as required by reviewing the
Certification of Completion form and Notice of
Completion report, conducting a site visit, and
comparing to the grant requirements.
o For both grants, determined whether reporting
requirements were met by reviewing the content and
timing of the Certification of Completion forms and
Notice of Completion reports, and comparing to
relevant criteria.

We conducted this performance audit in accordance with generally accepted government auditing standards. Those standards require that we plan and perform the audit to obtain sufficient, appropriate evidence to provide a reasonable basis for our findings and conclusions based on our audit objectives. We believe the evidence obtained provides a reasonable basis for our findings and conclusions based on our audit objectives.

RESULTS
Based on the procedures performed and evidence gathered, we obtained reasonable assurance the claimed grant expenditures, excluding any CNRA adjustments, complied with the grant agreements’ requirements. Additionally, we obtained reasonable assurance the grant deliverables were completed as required in the grant agreements.

City Council - Regular Meeting
September 10, 2024
Councilmember Scott commented that the review of these event fees is a great idea.

Councilmember Wright asked if there were currently any regulations on the types of live entertainment allowed in the City. Director Gardner mentioned that the Development Code does not define specifically the types so that needs to be addressed as well.

Susan Peplow sent an email to be read for the record, and asked Eric Menendez to read her comment. She spoke in favor of waiving fees.

Eric Menendez, Twentynine Palms, commented that he thinks it’s a good thing to clean up the Code and the fees should be reduced.

Caitlin Gill, Twentynine Palms, spoke in favor of reducing or waiving the entertainment fees.

Ted Quinn, Joshua Tree, spoke about "Open Mic" nights and agrees that reducing fees would be beneficial to the community.

Jenelle Angeles, Twentynine Palms, spoke in favor of waiving fees.

Graham Kolbeins, Twentynine Palms, sent an email to be read into the record, expressing his strong opposition to the proposed city policy that would require venues to obtain costly entertainment permits for hosting live music, drag performances, and other forms of entertainment.

Karen Harper, Twentynine Palms, mentioned that she owns a business and occasionally they have entertainment out in the parking lot, so does this mean that she will have to pay to get a permit? Director Gardner commented that this is what we are looking at tonight, on whether or not to change the current policy.

Carl Rice, no address given, spoke in favor of waiving fees.

Councilmember Klink mentioned that he would not vote on high fees. He would suggest that the policy indicates no fees, however, for big events, the Fire Department needs to be involved and that's when fees should come in effect.

Councilmember Wright commented that his biggest concern is when we start to identify certain types of entertainment, that everyone is complying with those restrictions. He agrees that the fees are too high and should be reviewed.

9. Self-Help Housing Project Status Update.

RECOMMENDATION: The City Council receive and file as this is an update only.

Councilmember Scott commented on the funding of this project.

Veno Nathraj, Twentynine Palms, commented that he loves the project but had one question. He asked if the 1500 hours that were mentioned by the City Manager that the prospective owner would have to put in to build the home could be waived? City Manager James mentioned that the 1500-hour requirement is set by the Federal Government. As for waiving the fees, City Manager James mentioned that this is something that would have to be looked at.

Pauline Pisano, Flamingo Heights, commented that she would like to encourage the City to reach out to the artists in the community to help out with the build of these homes. She also believes that there is federal funding to assist with this project.

BACKGROUND:

Page 41 of 114 ends

In June of 2023, the City Council approved $40,000 in funds to purchase a new vehicle for the Code Enforcement Department, however after requesting quotes from several sources, the amount approved is not sufficient to cover the cost of a new vehicle. The City of Twentynine Palms followed Purchasing Policy, Section 3.01.170 - Cooperative Purchasing Agreements. Subject to approval of the City Manager or the City Council pursuant to the dollar approval limits as provided in Section 3.01.090 or Section 3.01.100, the City may attach to the formal bidding process or engage in cooperative purchasing agreements with any of the following agencies: any County government within California, or any city within such counties, the State of California or the Federal Government.

In obtaining the quotes from the State of California government vendor, the City was informed that no 2023/2024 vehicles were available for purchase and that the only available options were the 2025 vehicles which impacted the pricing significantly. Accordingly, at the May 28, 2024 City Council meeting, another $10,000 was authorized for the purchase of the vehicle as of the next Fiscal Year (July 1, 2024). Unfortunately, the vehicles that were quoted were no longer available. The latest quotes that the City has received were listed at a minimum of $51,530.

Currently the Code Enforcement Department has one vehicle, a 2011 Ford Ranger (small truck) 4 x 4 with 95,000+ miles on it to be shared by two Code Enforcement Officers which is not efficient and at times not reliable when trying to attend to the City's current needs. The new vehicle would enable both officers to attend to the current volume of calls received by Code Enforcement as well as reduce the amounts of trips when collecting trash/debris from illegal dump sites which have increased significantly in comparison to previous years.

The latest bid requests consist of bids from Jessup Auto Plaza, I-10 Toyota, and Ken Grody Ford. All quotes with detailed specifications of the vehicles and detailed cost breakdown are attached to this Staff Report. The basic information for a quick overview comparison is on the table below. Staff recommends the purchase of the 2025 GM Silverado based on the vehicle specifications and the most responsible bidder and lowest quoted price.

Provider Vehicle Specs Color Quoted Price
Jessup Auto Plaza 2025 GM Silverado White $51,150.48
I-10 Toyota 2024 Tundra SR5 White $54,423.00
I-10 Toyota 2025 Tundra SR5 White $57,258.00
Ken Grody Ford F-150 Supercrew White $51,530.00
ENVIRONMENTAL:

Not applicable.

ALTERNATIVES:

The City Council could choose not to approve the additional amount needed for the purchase of the vehicle or decide not to move forward with purchasing a new truck at this time.

FISCAL IMPACT:

If City Council approves, the budget for the purchase of this vehicle will be increased from $50,000 to $55,000, and the additional funds will be incorporated into the General Capital Projects Fund mid-year adjustments for FY 2024-25. The entire purchase will be funded under the General Capital Projects Fund.

BACKGROUND:

As Council is aware, the Animal Shelter is in need of repairs to ensure the safety of the public, animals and Staff.

While we are working to develop a new Animal Shelter facility, we must maintain the existing shelter. In 2022, the Council provided funds to repair the existing facility. The project before you tonight (Project) addresses one of the major needs identified by Staff during the 2022 repair assessment.

The Palms N Paws Animal Shelter has seventy-six (76) dog kennels. Forty-five (45) kennels are on the "stray" dog side of the shelter and thirty-one (31) kennels on the "adopt" side of the shelter. The individual dog kennel gates on both sides of the shelter are 20 years old and are showing significant age. The current kennel gates and saddles (metal support structures providing mounting points for gates and latch mechanisms to the block structure) were installed by Public Works years ago and have been repaired numerous times. Currently, thirteen (13) saddles have failed, and many more saddles are nearing failure. When these saddles fail and the gates fail, the number of animals the shelter is able to house decreases. Given the recent high number of dogs coming into the shelter, decreasing available housing units due to non-functioning kennel gates is detrimental to animal welfare and Staff morale.

Page 59 of 114 ends

In 2022, Staff researched options for improved kennel gates. Staff found a unique product made from HDPE resin and aluminum from Gator Kennels. The Gator product is offered at a significantly lower cost than competing products. Staff contacted multiple references provided by the vendor and received positive reviews. To ensure the Gator gates could withstand the demands from our facility, we acquired samples of the product and installed a test gate in November 2022. Since November 2022, the Gator gate has performed above expectations, giving us confidence in this product. The product is manufactured in the USA by Gator Kennels and includes a 3-year parts and labor warranty. Gator Kennels also maintains a parts website offering all components of the gates, frames, latches, hinges, and posts for retail sale.

The proposed Project would replace all existing gates and saddles with the durable Gator Kennel gate system and add fourteen (14) additional freestanding Gator kennels in the adopt side of the current shelter. These freestanding kennels will allow us to remove the "dungeon" kennels located in the stray side of the shelter.

Removing the dungeon kennels will positively impacting animal welfare. In order to save cost, all installation will be done by City Staff and volunteers.

The Project will not only solve a current problem, the new gates and kennels will improve the appearance of the shelter. Improving the shelter appearance creates a more comfortable and inviting environment for animal adoption. This Project will reduce stress on Staff, allowing Staff to no longer worry about animals escaping the kennels, or a lack of capacity to handle animals safely.

Kennel Care
Here are some things to avoid:
• The use of cleansing products containing Chlorides, Bromides, Iodides, and Thiocyanates can discolor and prematurely corrode the kennel (specically the hardware). Some of these chemicals are also harmful to the animals housed in the kennels and if not rinsed correctly, can cause chemical burns! • Animal hair should be removed. Hair can hold unwanted bacteria, urine, and molds. This increases the smell and promotes disease.
• Do not use steel-wool pads on any surface as you will scratch o any protective nish and possibly
damage the kennel itself.

Sanitizing:
• Sanitizing is often a second step to caring for the kennels. This step kills o unwanted bacteria, molds
or viruses. Sanitizing can be done as often as needed to discourage diseases. High-tra c areas can be
sanitized daily. We found one of the easiest ways to sanitize your kennels is to use a misting machine.

This machine can use any sanitizing chemical and dispenses it in a ne mist to cover all surfaces. Since you are using a ne mist, dogs can be placed back in the kennel faster and you are not wasting as much chemical product by having it run down the drain.

We found some of the best cleansers to use on the kennels is:

Dawn® Dish soap or Scrubbing Bubbles®!
Professional cleansers such as Wysiwash® can be used - just be sure to rinse! These steps should prolong the life of the kennels:
• Any cleansing agent you do use should be thoroughly rinsed and NOT allowed to ‘air-dry’. • Clean o
urine as soon as possible.
• Let the kennels dry between use. This not only helps protect the kennel - but it reduces the potential for bacteria or mold cross-contamination.

Why we like Dawn® Dish Soap:
• Dawn® Dish soap was developed specically to break down oils.

Dogs secrete oils through their skin - and rub it all over the kennels. • This oil attracts dirt, hair, and grime. by breaking down the oils, the grime has nothing to stick to. • Dawn® Dish soap is less irritating to skin and eyes than other chemicals! Why we like Scrubbing Bubbles®:
• Scrubbing Bubbles® was developed specically clean HDPE and Aluminum - the very same materials we built your kennels from!

BACKGROUND:

The County of San Bernardino invites applicants to apply for Community Development Block Grant funds (CDBG) each year, which are to be used within the City of Twentynine Palms.

For Fiscal Year 2024/2025, the City submitted an application that focused on the design, construction and rehabilitation of ADA-compliant concrete parking spaces and path of travel, located at the Parks & Recreation parking lot, which will provide a safe and accessible route for residents visiting Luckie Park.

The 2025/2026 application requests an additional $145,000 to complete Phase 2, which involves the removal of the remaining (22 non-ADA) asphalt parking spaces, replacing them with concrete, which will complete the entire parking area. The engineer's estimate for the entire project is approximately $230,000.

The City currently has $172,357 in CDBG funds allocated for Fiscal Year 2024/25 for phase 1 (ADA). The additional funds will allow the City to complete the entire parking lot project. Any funds remaining after the project completion are eligible for transfer to future CDBG construction projects.

The CDBG application submission deadline is Tuesday, October 29, 2024.

7 The second phase of the project must be funded to provide a safe, usable area for the city residents. Waiting to fund in the future will cause additional safety issues.

No 2025 No
The non-ADA portion is needed due to safety concerns for the residents. The area has not seen any improvement or maintenance during the past decade, due to the lack of funding and resources available to address the issue.

No No 2026
The current condition of the non-ADA portion of the project is extremely poor. It is unsafe for the residents to use due to its age and degradation, making it difficult to navigate safely. The asphalt is severely cracked, separated with uneven slopes and raised areas throughout.

The residents of the city are highly likely to experience an injury while utilizing the non-ADA portion of the parking lot. This will cause injury, pain and stress. The city will be held liable for damages.

BACKGROUND:

Completed in 2019, Freedom Plaza has helped transform a previously sleepy section of main street retail into an increasingly vibrant Downtown. Home to the National Park’s West Entrance Visitor Center and adjacent to a number of vibrant local restaurants and businesses, Freedom Plaza hosts weekly farmer’s markets, festivals, and the City’s long-revered Pioneer Days. In addition to being a valued community hub, Freedom Plaza is the city’s only full-sized gymnasium.

Page 97 of 114 ends

At 10,320 square feet, the gymnasium offers City youth a safe place to play, practice, and compete while escaping harsh summers and cold winters. In addition to the gymnasium, Freedom Plaza offers an outdoor stage and a 1,385 square foot fully functional commercial kitchen. This commercial kitchen currently serves as the classroom for both Copper Mountain College and Morongo Basin Unified School District’s culinary programs.

As a cost and space saving measure, the restrooms serving both the gymnasium and commercial kitchen are accessed through an outside hallway. At night or during inclement weather, leaving the safety and comfort of gym or kitchen is both an inconvenience and a safety risk. Individuals with no connection to youth sports or the culinary program have complete access to the restrooms and drinking fountain. The layout of the facility makes it impossible to monitor who is in the hallway, who has entered the restrooms, and if those individuals who entered the restrooms have left the restrooms.

During the September 10, 2024, Council meeting, Mayor Bilderain and Councilmember Mintz instructed City Staff to identify opportunities to improve youths’ ability to safely use the restrooms.

DISCUSSION:

After reviewing the structural layout of the building, Staff determined the most appropriate and costeffective way to secure restroom access is to install locking doors on either end of the hallway. Placing locking doors on the north and east hallway entrances would:

1. Restrict access to the restrooms. Once locked, the hallway doors would prevent unknown individuals from accessing the restrooms. The only way to access the restrooms would be to walk through the commercial kitchen or walk past the gymnasium’s front desk.

2. Youth using the gym would no longer have to leave the gym and walk outside to access the restrooms.

Instead, youth would exit the double doors located on the northeast gym wall, walk through the nowsecure hallway and into the restrooms. Youth would retrace their steps to return to the gym.

3. Help prevent illegal activity within the restrooms.

4. Reduce the likelihood of vandalism in the restrooms.

One locking door would be installed at the north entrance of the hallway. The door would be mounted flush with the exterior building and would match the exterior doors located on the south side of the National Park Visitor Center. The second locking door would be located on the east entrance of the hallway. This door would match the north hallway doors and would also be mounted flush with the building.

Original building plans intended to have the hallways enclosed.

From a structural standpoint, the north and southeast hallway entrances are ready to receive the doors.

Electrical power is located within the existing walls, so installation of the doors should be straight forward. Staff worked with the City's Building and Safety Department and determined adding the two hallway doors would not impede emergency egress and therefore have no effect on the building's total allowed occupancy. Staff will need to purchase and install an emergency exit sign letting building occupants know they can exit to the north or east once in the hallway.

Depending on the availability of the doors and the contractor to install the doors, Public Works anticipates having the doors installed within 90 days of Council approval.
