BACKGROUND:

In January 2025, the City Council awarded a contract for construction management services with Parsons Transportation Group for the Split Rock Avenue Bridge Project, in the amount of $929,755.10.

The Project includes constructing the Split Rock Avenue Bridge and the San Bernardino County Flood Control District's Channel. Parsons will provide the construction management activities for both the Split Rock Avenue Bridge and the San Bernardino County Flood Control District's Channel, including inspection and materials testing.

Last summer, the San Bernardino County Flood Control District indicated that the Split Rock Bridge and the Flood Control Districts' channel which was originally packaged to be constructed as one contract needed to be phased or staggered due to recent permitting requirements from the State Regional Water Quality Control Board (State Board) and design revisions to the channel. Now, it is necessary to construct the project as two separate projects, the Bridge construction and the Channel construction.

Though these recent changes do not affect the contract with Parsons, they do require additional work from the Dokken, the design engineering firm.

The purpose of this item is to request Amendment No. 4 to the City’s Agreement with Dokken Engineering for engineering, environmental, (due to recent changes with the Flood Control District) and construction support services for the Split Rock Avenue Bridge project. This amendment is requested to Page 21 of 50 address the costs and time associated with comments from San Bernardino Flood Control District (SBCFCD) providing new direction on the design of the Twentynine Palms Channel (subsequent to their approval of the channel design in October 2022), along with updated requirements from the State Regional Water Quality Control Board (State Board) for Waste Discharge Requirements (WDR) permitting for work within waters of the State.

All elements of the design of this project were based on preliminary channel design provided by SBCFCD dated October 30, 2019. Permits were assembled based on the Colorado River Basin of the Regional Water Quality Control Board (CRBRWQCB) determination that the Twentynine Palms Channel was considered non-jurisdictional (not Waters of the United States), requiring only a Lake and Streambed Alteration permit from the California Department of Fish and Wildlife (CDFW section 1602 permit).

Recently, the State implemented a new State Waters permitting system. This change in Statewide Policy requires permitting through RWQCBs regardless of whether waters of the US are present. The permitting process requires applications to obtain Waste Discharge Requirements (WDRs) to ensure preservation of water quality and to mitigate for loss of waters, both temporary and permanent.

ENVIRONMENTAL:

The amendment includes tasks to provide permit applications for the Bridge and the Channel to obtain Waste Discharge Requirements (WDRs) to ensure preservation of water quality and to mitigate for loss of waters, both temporary and permanent.

ALTERNATIVES:

The City Council could choose not to approve the amendment.

FISCAL IMPACT:

The proposed contract Amendment #4, attached, is $325,000. The Amendment includes many tasks that qualify for reimbursement through the already programmed funds for anticipated work performed during construction. These costs will come from both the Caltrans Bridge Program and the Flood Control District agreement previously approved with the City.

The City's agreement with Caltrans indicates that they will reimburse the City for 88.53% of the construction management cost for the bridge. The City is required to match with the remaining 11.47%.

The City's agreement with San Bernardino County Transportation Authority (SBCTA) indicates that SBCTA will reimburse the City with Measure I Major Local Highway funds ($315,585).

For the Channel portion of the project, The City's agreement with San Bernardino County Flood Control District (SBCFCD) indicates that they will reimburse the City 100% for construction management services.

However, included in the costs for amendment #4 are Dokken's required services for tasks that are required prior to construction, such as obtaining the necessary permits from the CRBRWQCB. It is anticipated that the Amendment cost of $325,000, not related to the construction phase of the project, is estimated to be $91,000. It is recommended to initially utilize local Measure I funds for this amount.

Staff will contact SBCTA to amend the agreement with the City for the Bridge Project, to increase the Measure Local Highway Program Funds which is currently $315,585, for construction related services, for this proposed pre-construction related cost.

RE: Split Rock Avenue Bridge
Federal Aid Project Number: NBIL (533), STIP 209-5000-3189 Amendment No. 4 Request: Budget Adjustment for Project Split and Channel Redesign Dear Mr. Pedersen,
The purpose of this letter is to request Amendment No. 4 to the City’s Agreement with Dokken Engineering for engineering, environmental, and construction support services for the Split Rock Avenue Bridge project. This amendment is requested to address the costs and time associated with comments from San Bernardino Flood Control District (SBCFCD) providing new direction on the design of the Twentynine Palms Channel (subsequent to their approval of the channel design in October 2022), along with updated requirements from the State Regional Water Quality Control Board (State Board) for Waste Discharge Requirements (WDR) permitting for work within waters of the State. All elements of the design of this project were based on preliminary channel design provided by SBCFCD dated October 30, 2019. Permits were assembled based on the State Board’s determination that the Twentynine Palms Channel was considered non jurisdictional (not Waters of the United States), requiring only a Lake and Streambed Alteration permit from the California Department of Fish and Wildlife (CDFW section 1602 permit).

In 2018, Dokken coordinated with the Colorado River Basin of the Regional Water Quality Control Board (CRBRWQCB) regarding the Twentynine Palms Channel. During email correspondence, the CRBRWQCB stated that since the channel did not contain any waters of the US, RWQCB permitting was not required. The CRBRWQCB instructed that all applicable MS4 programs still be followed.

Since that previously provided direction, all RWQCB throughout the State have implemented a new State Waters permitting system. This change in Statewide Policy requires permitting through RWQCBs regardless of whether waters of the US are present. The permitting process requires applications to obtain Waste Discharge Requirements (WDRs) to ensure preservation of water quality and to mitigate for loss of waters, both temporary and permanent.

On August 1, 2024, Dokken Engineering and the City of 29Palms met with representatives from the State Board. In this meeting, the State Board determined that WDR permitting would be required for the project. SBCFCD provided direction to split the original project into two separate projects to expedite the SBCFCD Encroachment Permit approval for the construction of the Split Rock Avenue Bridge and approach roadway improvements: The 1st project will construct the Split Rock Avenue Bridge and approach roadway improvements, along with channel grading directly below the proposed Split Rock Avenue Bridge. The 2nd project will construct the Twentynine Palms channel from approximately 400 feet upstream of the bridge (from the existing Donnel Basin exit) to approximately

Page 23 of 50 ends

Split Rock Avenue Bridge Project – Federal Aid Project Number: NBIL (533) Amendment No. 4 Request: Budget Adjustment and Time Extension 2 300 feet downstream of the bridge. As the original project need will be split into two separate projects, two separate SBCFCD Encroachment Permit, and two separate WDR permits are required to facilitate project phasing.

Dokken Engineering submitted updated Plans and supporting Bridge Design Hydraulics Study on July 12, 2024 to address all outstanding SBCFCD comments on the project design elements. New leadership at SBCFCD requested that all grouted rock slope protection be ¼ Ton size, revising their previous direction and approval of three separate rock sizes. Upon further review of the design hydraulics, Dokken Engineering determined that ¼ Ton grouted rock slope protection would be inadequate to support the interim water discharge velocities coming out of the existing Donnell Basin, and provided backup calculations and design methodology to SBCFCD for review. The City and Dokken Engineering met with SBCFCD on 12/18/2024 to discuss the channel rock slope protection.

During this meeting, SBCFCD directed the Project Team to revise the previously directed steep channel grading coming from the existing Donnell Basin to a roughly 10% gradient reduce water discharge velocities and allow for all ¼ ton grouted rock slope protection.

This amendment is needed to accommodate for the added project management and administration needs as well as engineering and environmental permitting services resulting from these changes in project requirements and design direction. Following is a description of the services necessary to complete the project, with the addition of scope to accommodate Bidding Support and Construction Support for the Advertisement and Construction of the separated projects. This assumes a time extension through December 2025, with advertisement for construction anticipated in February 2025.

The outline is consistent with the contract task numbering. Information is provided only for new and amended tasks.

CONTRACT TASK BUDGET
TASK 1 – PROJECT MANAGEMENT $ 19,000
After Dokken and the City submitted the Final PS&E Package (including a Caltransapproved PS&E Certification), SBCFCD and the State Board required new design direction beyond the original contract scope to obtain final permits for construction.

These changes require Dokken to reevaluate the project design, estimate, and specifications, and split the design package into two separate projects.

Unfortunately, due to circumstances outside of Dokken’s control, there has been scope changes to the project that have caused the level of project management to increase.

The budget adjustment includes resources necessary for additional meetings, coordination, administering the contract, and general project management. The budget adjustment accounts for the extra effort required to manage and administer the design meetings and changes for this amendment scope.

TASK 6.C – BRIDGE DESIGN HYDRAULICS REPORT $ 25,000
After Dokken and the City submitted the Final PS&E Package (including a Caltransapproved PS&E Certification), SBCFCD required new design direction beyond the original contract scope to obtain final permits for construction. These changes require Dokken to reevaluate the project design, estimate, and specifications, and split the design package into two separate projects.

Split Rock Avenue Bridge Project – Federal Aid Project Number: NBIL (533) Amendment No. 4 Request: Budget Adjustment and Time Extension 3 CONTRACT TASK BUDGET
This budget adjustment accounts for updating and reevaluating the hydraulic modeling, summarizing new recommendations for channel gradient, scour, and cutoff walls. The report will incorporate SBCFCD’s requested changes and will be submitted with written responses to SBCFCD comments.

TASK 10.6 – PREPARE WATER DISCHARGE REQUIREMENT (WDR)

APPLICATIONS
$ 23,000
After Dokken and the City submitted the Final PS&E Package (including a Caltransapproved PS&E Certification), SBCFCD and the State Board required new design direction beyond the original contract scope to obtain final permits for construction.

These changes require Dokken to reevaluate the project design, estimate, and specifications, and reevaluate the State Waters permitting system.

As the project will be split into two separate projects (and therefore, two separate California Environmental Quality Act [CEQA] projects), two WDR applications are required, one for the low water crossing replacement and one for the channel improvements. The scope of the original agreement did not include obtaining WDR permits, as this requirement was not in effect at contract origination.

This budget adjustment accounts for preparing and obtaining the required WDR permits. Dokken will prepare both WDR applications and submit to the City and SBCFCD for review and comment. Once approved, Dokken will submit the applications to the CRBRWQCB and coordinate with staff regarding questions or revisions to the applications. Dokken will review all provided WDR’s to ensure they do not contain mistakes and that proposed stipulations are implementable. The City will be responsible for all WDR application fees and mitigation costs.

TASK 13.B – FINAL ROADWAY DESIGN $ 27,000
After Dokken and the City submitted the Final PS&E Package (including a Caltransapproved PS&E Certification), SBCFCD required new design direction beyond the original contract scope to obtain final permits for construction. These changes require Dokken to reevaluate the project design, estimate, and specifications, and split the design package into two separate projects.

This budget adjustment will allow for the previously unanticipated changes to be included into two separate projects (one for the construction of the Split Rock Avenue Bridge and approach roadway improvements, and one for the new design of the Twentynine Palms Channel) for Final Plans submittals.

TASK 13.C – FINAL QUANTITIES AND ESTIMATE $ 2,000
After Dokken and the City submitted the Final PS&E Package (including a Caltransapproved PS&E Certification), SBCFCD required new design direction beyond the original contract scope to obtain final permits for construction. These changes require Dokken to reevaluate the project design, estimate, and specifications, and split the design package into two separate projects.

STAFF REPORT
TO: City Council
FROM: Public Works Superintendent
FOR MEETING: Feb 11 2025
SUBJECT: Acquisition of Water Truck.

RECOMMENDATION:

The City Council approve the purchase of a 2015 Ford F-750 Water Truck in the amount of $48,393.75.

ATTACHMENTS:

BACKGROUND:

The Public Works Department is requesting that the City Council approve the purchase of a 2000Gal. water truck. The acquisition would replace the 22-year-old water truck that has been in service at Public Works since 2010. The purpose of this request is a result of exhausted efforts to overcome failing powerplant C7 caterpillar engine (Known in industry for design issues). In the process of achieving CARB compliance research, replacing this vehicle with a 2014 model year or newer would extend the cities longevity in compliance dramatically.

Public Works Staff obtained three quotes, selecting the lowest, most responsible vendor.

The purpose of this vehicle is broad in scope from emergency response to routine maintenance. This vehicle is present on most Public Works projects which makes it critical to many tasks performed routinely throughout the year. The importance of this asset in storm recovery and routine maintenance has to do with dust abatement as required by state regulatory agencies such as AQMD and EPA. This being said, it is the strong opinion of Public Works Staff that the City Council approve the purchase of the replacement of this integral asset to our operation.

ENVIRONMENTAL:

None.

ALTERNATIVES: Page 31 of 50
The City Council could choose not to approve the purchase of this unit.

FISCAL IMPACT:

This unit would be funded through Gas Tax funding. The funds have already been committed in the budget for FY 2024-25.

The City received a total of seven (7) applications, and one was not eligible as the applicant lives out of city limits. BACKGROUND:

Food insecurity is an issue facing families throughout Southern California. Community Learning and Equipping Project, Inc. (CLEP) is a Twentynine Palms-based organization dedicated to serving our community's most vulnerable residents. CLEP focuses on elevating Twentynine Palms through building community, education, and, for those in significant need, food distribution. In furtherance of this mission, CLEP created the HOPE Project. "The Hope Project instituted “Feed the Need,” an initiative aimed to combat food insecurity in the City of Twentynine Palms. Feed The Need distributes essential food items to underserved families and individuals every Tuesday at 4751 Adobe Road. This effort has been totally funded by charitable donations from the “Sanctuary Church.”
The monthly cost for the program averages $3500.00 per month. Cost breakdown is:

1. Fuel Cost - $400.00

2. Delivery Fee - $400.00

3. Vehicle maintenance - $500.00

4. Food procurement $1,200.00

5. Supplies - $400.00

6. Electric - $400.00

Page 47 of 50 ends

7. Driver meal stipends - $200
To sustain and expand our effort, we request funding to help cover the operational costs of the Feed the Need program.

Feed the Need currently serves on average 768 – 960 families monthly. As the cost of food continues to rise, more families need our support. We don’t want to start turning people away due to a shortage of supplies.

The Hope Project’s mission is to uplift and empower families and individuals in need. We ask the City of Twentynine Palms to help us accomplish this mission.

Sincerely,
Dr. Sylvester Cullum Business Administrator The Hope Project" (Source: 2025-01-17 29 Palms CLEP, Inc. Feed the Need Funding Request) Due to the rising costs of feeding Twentynine Palms' most vulnerable residents, the significant number of families being served by The Hope Project's Feed the Need program, and CLEP's inability to continue funding the Feed the Need program at current levels, Mayor Bilderain requested this funding proposal be brought to the City Council for consideration.

ENVIRONMENTAL:

None.

ALTERNATIVES:

This item is being brought to the City Council ahead of the typical community grant window due to the urgency surrounding CLEP's inability to continue funding the Hope Project's Feed the Need program and the number of families currently being fed (769-960). The City Council could consider (i) taking no action, (ii) temporarily funding CLEP's Feed the Need until a formal funding request is heard alongside other non-profits, or (iii) funding CLEP's Feed the Need program on a longer-term basis.

FISCAL IMPACT:

The financial impact will be a function of the volume and duration of allocated funds.
