Bidders must provide pricing for every bid item.

The estimated quantities for unit price items are for purposes of comparing bids only and the City makes no representation that the actual quantities of work performed will not vary from the estimates.

In case of discrepancy between the unit price and the line-item cost set forth for a unit price item, the line item cost, calculated at the unit price multiplied by the estimated quantity, shall prevail, and shall be utilized as the basis for determining the lowest responsive, responsible bidder. However, if the amount set forth as a unit price is ambiguous, unintelligible or uncertain for any cause, or is omitted, or is the same amount as the entry in the “Line Item Cost” column, then the amount set forth in the “Line Item Cost” column for the item shall prevail and shall be divided by the estimated quantity for the item and the price thus obtained shall be the unit price. If any of the above discrepancies exist, the City may recalculate the bid price on the basis of the unit price and the bidder agrees to be bound by such recalculation. Final payment for unit price items shall be determined by the City from measured quantities of work performed.

In case of discrepancy between the written price and the numerical price, the written price shall prevail.

The undersigned agrees that this Bid Form constitutes a firm offer to the City which cannot be withdrawn for the number of calendar days from the bid opening stated in the Notice Inviting Bids from the bid opening, or until a Contract for the Work is fully executed by the City and a third party, whichever is earlier.

The Contract Time shall commence on the date stated in the City’s Notice to Proceed or as stated above. In no case shall the Contractor commence construction prior to the date stated in the City’s Notice to Proceed, or before providing the required bonds and evidence of insurance.

Bidder certifies that it is licensed in accordance with the California law providing for the registration of Contractors, License No. _________, Expiration Date _______, class of license _____. If the bidder is a joint venture, each member of the joint venture must include the above information.

The undersigned acknowledges receipt, understanding and full consideration of the following addenda to the Contract Documents.

requirements, it shall provide coverage at least as broad as specified for the underlying coverages. Any such coverage provided under an umbrella liability policy shall include a drop-down provision providing primary coverage above a maximum $25,000 self-insured retention for liability not covered by primary but covered by the umbrella. Coverage shall be applicable to CITY for injury to employees of CONTRACTOR, subcontractors or others involved in the Work. The scope of coverage provided is subject to approval of CITY following receipt of proof of insurance as required herein. Limits are subject to review but in no event less than per occurrence. (c) Deductibles and Self-Insured Retention. If CONTRACTOR’s existing coverage includes a deductible or self-insured retention, the deductible or self-insured retention must be declared to the CITY. At that time, the CITY shall review options with the CONTRACTOR, which may include reduction or elimination of the deductible or self-insured retention, substitution of other coverage, or the CONTRACTOR to procure a bond guaranteeing payment of losses and related investigations, claim administration and defense expenses or other solutions. Any deductibles in excess of ten percent (10%) or self-insured retention must be approved by the City Manager.
(d) Other Insurance Provisions. The general liability, business auto liability, and any necessary umbrella liability policies are to contain, or be endorsed to contain, the following provisions:
(1) General liability and umbrella policies shall cover the CITY, its officers, officials, employees, agents, and volunteers are to be covered as insureds or additional insureds as respects: liability arising out of activities performed by or on behalf of the CONTRACTOR; products and completed operations of the CONTRACTOR; premises owned, occupied or used by the CONTRACTOR; or automobiles owned, leased, hired or borrowed by the CONTRACTOR. The coverage shall contain no special limitations on the scope of protection afforded to the CITY, its officers, officials, employees, agents, or volunteers. Endorsementsincluding the additional insured shall be identified on standard ISO endorsement number CG 20 10, attached to an ISO-CGL policy with an edition prior to 1992, or other form as expressly approved by CITY, and which does not limit the scope of coverage for the additional insured to vicarious liability or to the additional insured's supervision of a given project. In no event shall the CONTRACTOR use an additional insured endorsement with an edition date of 1992 or later, absent express written authorization by CITY. CONTRACTOR also agrees to require all CONTRACTORs and subcontractors to do likewise.
(2) For any claims related to this project, the CONTRACTOR's insurance coverage shall be primary insurance asrespect to the CITY, its officers, officials, employees,

agents, and volunteers. Any insurance or self-insurance maintained by the CITY, its officers, officials, employees, agents, or volunteers shall be excess of the CONTRACTOR's insurance and shall not contribute with it. (3) Any failure to comply with reporting or other provisions of the policies including breaches of warranties shall not affect coverage provided to the CITY, its officers, officials, employees, agents, or volunteers.
(4) The CONTRACTOR's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability, and there shall be no cross-liability exclusions that preclude coverage for suits between CONTRACTOR and CITY or between CITY and any other insured. CONTRACTOR expressly waives any claim against CITY for any covered act or event, and CONTRACTOR's insurance policy shall not prevent such waiver. The limits of insurance required herein shall in no way limit the liability of the party providing the insurance. In addition, if the coverage or limits available to CONTRACTOR exceed that required by this Agreement, and the loss incurred by the additional insured exceeds the amount required by this Agreement, it is the parties' intent that all such additional coverage and limits available will apply irrespective of the specific coverage or limits required herein. (5) No liability insurance coverage provided to comply with this Agreement shall prohibit CONTRACTOR, or CONTRACTOR’s employees, or agents, from waiving the right of subrogation prior to a loss. CONTRACTOR agrees to waive subrogation rights against CITY regardless of the applicability of any insurance proceeds, and to require all CONTRACTORs and subcontractors to do likewise. (6) All insurance coverage and limits provided by CONTRACTOR and available or applicable to this Agreement are intended to apply to the full extent of the policies.

Nothing contained in this Agreement or any other agreement relating to the CITY or its operations limits the application of such insurance coverage. (7) The CITY reserves the right at any time during the term of the contract to change the amounts and types of insurance required by giving the CONTRACTOR ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the CONTRACTOR, the CITY will negotiate additional compensation proportional to the increased benefit to CITY. (8) For purposes of applying insurance coverage only, this Agreement will be deemed to have been executed immediately upon any party hereto taking any steps that can be deemed to be in furtherance of or towards performance of this Agreement. (9) CONTRACTOR acknowledges and agrees that any actual or alleged failure on the part of CITY to inform CONTRACTOR of non-compliance with any insurance requirement in no way imposes any additional obligations on CITY nor does it waive any rights hereunder in this or any other regard. (10)None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to CITY and approved of in writing.

Page 549 of 630 ends

- 42 -
(11)No liability policy shall contain any provision or definition that would serve to eliminate so-called “third party action over” claims, including any exclusion for bodily injury to an employee of the insured or of any CONTRACTOR or subcontractor.
(12)All coverage types and limits required are subject to approval, modification, and additional requirements by the CITY, as the need arises. CONTRACTOR shall not make any reductions in scope of coverage (e.g. elimination of contractual liability or reduction of discovery period) that may affect CITY’s protection without CITY’s prior written consent.
(13)The provisions of any workers’ compensation or similar act will not limit the obligations of CONTRACTOR under this Agreement. CONTRACTOR expressly agrees not to use any statutory immunity defenses under such laws with respect to CITY, its employees, officials, and agents.
(14)Requirements of specific coverage features or limits contained in this section are not intended as limitations on coverage, limits, or other requirements nor as a waiver of any coverage normally provided by any given policy. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue, and is not intended by any party or insured to be limiting or all-inclusive. (15)CONTRACTOR agrees to be responsible for ensuring that no contract used by any party involved in any way with the project reserves the right to charge CITY or CONTRACTOR for the cost of additional insurance coverage required by this Agreement. Any such provisions are to be deleted with reference to CITY. It is not the intent of CITY to reimburse any third party for the cost of complying with these requirements. There shall be no recourse against CITY for payment of premiums or other amounts with respect thereto.
(e) Acceptability of Insurers. Insurance is to be placed with insurers authorized and admitted to do business in California and with a current A.M. Best's rating of A or better and a financial size of VII or greater, unless otherwise acceptable to the CITY.
(f) Verification of Coverage and Notice of Cancellation. (1) CONTRACTOR shall immediately furnish to CITY certificates of insurance or endorsements, satisfactory to CITY, evidencing the insurance coverage above required prior to the commencement of performance of services hereunder. These certificates or endorsements shall provide that such insurance is the minimum, is in no way limited by any provision herein, and allows for the application of all coverage available to the additional insureds. Further, the certificates or endorsements shall require thirty (30) days written notice to additional insured CITY prior to any termination, suspension, cancellation, or non-renewal, or the reduction of available coverage, or any change in the terms of coverage. CONTRACTOR agrees to require its insurer to modify such certificates to delete any exculpatory wording stating that failure of the insurer to mail written notice of cancellation imposes no obligation, or that any party will “endeavor” (as opposed to being required) to comply with the requirements of the certificate. (2) CONTRACTOR agrees that if CONTRACTOR commences work under this Agreement without first providing CITY copies of the required insurance certificates or endorsements, that CONTRACTOR doesso at its own and sole risk. In the event CONTRACTOR'sinsurance is not

Page 550 of 630 ends

- 43 -
acceptable to CITY or copies of insurance certificates or endorsements are not provided, CITY shall have no obligations to compensate CONTRACTOR for such work unless CONTRACTOR possesses a notice to proceed from CITY for this work.
(3) Within sixty (60) days of the commencement of this Agreement, CONTRACTOR shall furnish certified copies of the actual policies and endorsements. Failure to submit such policies shall constitute a material breach of this Agreement entitling CITY to any and all remedies at law or in equity, including summary termination of this Agreement. If proof of any insurance required under this Agreement is not delivered as required or if such insurance is canceled at any time and no replacement coverage is provided, CITY shall have the right but not the duty to obtain any insurance it deems necessary to protect its interests under this Agreement, express or implied, in any way relating to CITY. Any premium for such coverage shall be charged to and promptly paid by CONTRACTOR or, at CITY's option, may be deducted from sums due to CONTRACTOR.
(4) In the event of the premature termination of this Agreement for any reason, CONTRACTOR agreesto maintain the required insurance coverage until CITY provides written authorization to terminate the coverage following a review and determination that all liability posed under this Agreement as to the party providing the insurance has been eliminated. (5) Except as outlined in Section 10(b) (3) above, CONTRACTOR will renew the required coverage annually as long as CITY, or its employees or agents face an exposure from operations of any type pursuant to this Agreement. This obligation applies whether or not the agreement is canceled or terminated for any reason. Termination of this obligation is not effective until CITY executes a written statement to that effect. (6) CONTRACTOR shall provide proof that policies of insurance required herein expiring during the term of this Agreement have been renewed or replaced with other policies providing at least the same coverage. Proof that such coverage has been ordered shall be submitted prior to expiration. A coverage binder or letter from CONTRACTOR’s insurance agent to this effect is acceptable. A certificate of insurance and/or additional insured endorsement as required in these specifications applicable to the renewing or new coverage must be provided to CITY within five days of the expiration of the coverages.
(g) Notice of Claim or Loss. CONTRACTOR agrees to provide immediate notice to CITY of any claim or loss likely to involve CITY or its employees or agents which exceeds $2,500 or is likely to exceed that amount arising out of the work performed under this Agreement. CITY assumes no obligation or liability by such notice, but has the right (but not the duty) to monitor the handling of any such claim or claims if they are likely to involve CITY.
(h) Sub-Contractor Insurance Requirements. CONTRACTOR agrees to require that all parties, including but not limited to Sub-Contractors and additional CONTRACTORS or professional services with whom CONTRACTOR enters into contracts or whom CONTRACTOR hires pursuant to or in any way related to the performance of this Agreement, provide the insurance coverage required here, at a minimum.

CONTRACTOR agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this Section.

CONTRACTOR acknowledges and agreesthat upon request, all agreements with Sub-Contractors and others engaged in the project contemplated by this Agreement will be submitted to CITY for review.

CONTRACTOR agrees and acknowledges that such contracts may require modification as to the insurance requirements necessary to properly protect CITY.

BACKGROUND:

The County of San Bernardino invites applicants to apply for Community Development Block Grant funds (CDBG) each year, which are to be used within the City of Twentynine Palms.

For Fiscal Year 2025/2026, the City applied for and received a total of $156,048 in CDBG funds to complete Phase 2 of the parking lot rehabilitation project located at 74362 Joe Davis Drive. For Fiscal Year 2026/2027, the City is intending to submit an application that focuses on the design and construction of ADA-compliant pedestrian pathways that will travers from Utah Trail to encircle the children's playground areas within Luckie Park. Other improvements will include updated lighting and sidewalks. City Staff will request $200,000 to complete this project, based on the engineer's estimate.

ORDINANCE NO. XXX

AN ORDINANCE OF THE CITY COUNCIL OF THE OF THE CITY OF TWENTYNINE PALMS, CALIFORNIA, AMENDING TITLE 18, C H A P T E R 1 8 . 0 1 OF THE CITY OF TWENTYNINE PALMS MUNICIPAL CODE BY THE ADDITION OF CHAPTERS 18.01.090, 18.01.100, 18.01.110, 18.01.120, 1 8.01.130 A N D 1 8 . 0 1 . 1 4 0 AMENDING CHAPTERS 1 8.01.010, 1 8.01.020, 1 8.01.030,

18.01.040, 18.01.050, 18.01.060, 18.01.070, A N D 18.01.080, , ADOPTING AS MODIFIED THE 2025 EDITION OF THE CALIFORNIA BUILDING CODE VOLUMS 1, 2 INCLUDING THE APPENDIX AND STANDARDS, THE 2025 EDITION OF THE CALIFORNIA ELECTRICAL CODE, THE 2025 EDITION OF THE CALIFORNIA PLUMBING CODE, THE 2025 EDITION OF THE CALIFORNIA MECHANICAL CODE, THE 2025 EDITION OF THE CALIFORNIA GREEN BUILDING CODE, THE 2025 EDITION OF THE CALIFORNIA RESIDENTIAL CODE, THE 2025 EDITION CALIFORNIA ENERGY CODE, THE 2025 EDITION OF THE CALIFORNIA FIRE CODE, THE 2025 EDITION OF THE

CALIFORNIA WILDLAND URBAN INTERFACE CODE, AND ADOPTING OTHER REGULATIONS RELATING TO BUILDING REQUIREMENTS.

The City Council of the City of Twentynine Palms, California does ordain as follows:

SECTION 1. Findings
A. Government Code Sections 50022.1et seq., provide that ordinances and codes of the federal, state or any agency of either of them may be adopted by reference, provided that prior to such adoption by reference a noticed public hearing has been held.

B. Pursuant to Section 17958.5 of the Health and Safety Code of the State of California, The City Council of the City of Twentynine Palms hereby finds that the amendments of the building standards contained in the California Building Code, volumes 1, 2, 2025 Edition are necessary due to:

1. Local Climatic Conditions:
a. The City is subject to extremely strong winds, commonly known as "Santa Ana Winds" which can reach speeds in excess of ninety (90) miles per hour. Extensive damage frequently accompanies these winds, such as blowing sand and debris, downed power lines, fallen trees, overturned vehicles and structural damage to buildings. These conditions result in increased demand for fire services, blocked or delayed emergency vehicle access and impaired water supplies and building emergency systems. b. During the summer months, the Santa Ana Winds may produce periods of extremely low humidity, thereby reducing the fuels moisture and increasing the possibility and severity of fire from dry vegetation and other common combustibles. c. During the summer months, much of the City experiences prolonged periods of temperatures in excess of one hundred degrees Fahrenheit (l00°F). When coupled with

Page 572 of 630 ends

sustained severe Santa Ana Winds, an increase in the threat from rapidly moving wildfires exists.
d. During the winter months, heavy rains routinely cause damage to roadways rendering them completely impassible, or with limited access, sometimes for extended periods. e. During winter months, heavy snow and ice conditions exist in the mountain areas resulting in increased demand for fire services and limiting or delaying emergency vehicle access. In some cases, emergency vehicle access roads are completely impassible, or have limited access, sometimes for extended periods.

2. Local Geological Conditions:
a. The City is subject to moderately strong to severe shaking and surface ruptures resulting from known earthquake faults located within or near the City. These local earthquake faults have the potential to cause severe personal and property damage, utility interruptions, fire hazards and hazardous materials releases. Additionally, significant roadway, bridge structure, water supply and communications systems are subject to failure, thereby causing a detriment to emergency services response. b. Unstable slopes in several areas throughout the City have experienced soil movement as a result of heavy or soaking rains, resulting in damage to roadways, structures and utilities.
c. Some desert areas of the City have limited aquifers, exceptionally deep aquifers or aquifers providing only brackish or contaminated water supplies. These limits, or in some cases eliminates, water supplies available for firefighting purposes.

3. Local Topographical Conditions:
a. The City encompasses an area with limited access routes connecting valley, mountain and desert areas. This distance, combined with these limited access routes, results in delays in the reallocation of resources to emergency scenes. b. The topography of the City is exceptionally diverse, ranging from relatively flat desert and valley areas, to foothill areas, and canyon areas. This results in some areas that are inaccessible to radio communications, which hampers emergency response capabilities. c. The diverse topography of the City results in many areas having limited, unreliable or unavailable water supplies available for firefighting purposes.

C. Copies of these codes and standards were filed with the office of the City Clerk fifteen (15) days prior to the noticed hearing.

Page 573 of 630 ends

D. A noticed public hearing has been held by the City Council, at which time all interested persons had the opportunity to appear and be heard on the matter of adopting by reference the current editions of certain model codes, as follows:

1. California Building Code, 2025 Edition, volumes 1,2 with Appendices.

2. California Residential Code, 2025 Edition with Appendices.

3. California Mechanical Code, 2025 Edition with Appendix and Standards

4. California Plumbing Code, 2025 Edition with Appendix H.

5. California Electrical Code, 2025 Edition.

6. California Green Building Code, 2025 Edition.

7. California Energy Code, 2025 Edition.

8. California Wildland, Urban Interface Code, 2025 Edition.

9. California Historic Building Code, 2025 Edition

10. California Fire Code, 2025 Edition.

11. California Administration Code, 2025 Edition.

12. The 2024 International Property Maintenance Code.

E. Pursuant to section 17958.5 of the Health and Safety Code of the State of California, The City Council of the City of Twentynine palms hereby finds that the amendments of the building standards contained in the California Building Code, volumes 1, 2, 2022 Edition are necessary due to past earthquakes (Landers 1992) and the inherent run off problems incurred with severe thunderstorm activity and flooding due to the City’s desert location. (Ord. 273, 10-25-2016; amd. Ord. 289, 11-12-2019)

All drainage facilities shall be designed to convey waters to the nearest practicable street, storm drain, or natural watercourse or drainage way approved by the Building Official or other appropriate governmental agency provided that the discharge of such waters at that location will not create or increase a hazard to life or property. Erosion of the ground in the area of discharge shall be prevented by installation of non-erosive down drains or other devices. Desilting basins, filter barriers, or other methods, as approved by the Building Official, shall be utilized to remove sediments from surface waters before such waters are allowed to enter streets, storm drains, or natural watercourses. If the drainage device discharges onto natural ground, riprap, or a similar energy dissipater may be required.

Building pads shall have a minimum drainage gradient of ( 2) percent toward an approved drainage facility or a public street unless otherwise directed by the Building Official. A lesser slope may be approved by the Building Official for sites graded in relatively flat terrain, or where special drainage provisions are made, when the Building Official finds such modification will not result in a hazard to life or property.

SECTION J110. Erosion Control
Section Jll0.1.1. Slopes
The faces of cut and fill slopes shall be prepared and maintained to control against erosion. This control may consist of effective planting. The protection for the slopes shall be installed as soon as practicable and prior to calling for final approval. Where cut slopes are not subject to erosion due to the erosion resistant character of the materials, such protection may be omitted.

Section Jll0.1.2.2. Wind Erosion Control Plans Required A written wind erosion control plan shall be submitted to the Building Official for approval prior to the issuance of a grading permit. This plan shall employ the use of one or more of the following measures:

Grading of tracts in small phases to minimize the amount of bare ground exposed at any one time.

The requirement to have water trucks on site and that they be used on a regular basis; The use of approved chemical additives to water stabilize the soil crust.

The use of hydro seeding.

The Building Official may at any time during or after grading has taken place require additional erosion measures be implemented if the measures contained in the wind erosion control plan are not achieving the desired result of preventing wind erosion of the soil."

Page 579 of 630 ends

Section Jll0.2.3. Water Erosion Control Plans Required
A written water erosion control plan shall be submitted to the Building Official for approval for any grading performed. Water erosion control measures shall be required to be in place during this time period for all active grading projects and, if the Building Official deems it appropriate, any previously graded projects.

A new Section J112 is hereby added to Appendix.

standards; and
WHEREAS, the 2025 California Building Standards Code, contained in the California Code of Regulations, Title 24, parts 1-12, incorporate public health, life safety, and general welfare standards used in the design and construction of buildings in California. The California codes incorporate the latest national standards for construction, including the 2024 International Building Code, the 2024 International Residential Code, the International Fire Code, the 2024 National Electrical Code, the 2024 Uniform Plumbing Code, the 2024 Uniform Mechanical Code and the California Green Building Standards Code; and

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TWENTYNINE PALMS, CALIFORNIA HEREBY RESOLVES, FINDS AND DETERMINES AS FOLLOWS:

SECTION 1. The City Council hereby specifically finds that all of the facts set forth in the recitals of this Resolution are true and correct.

A. The City is subject to extremely strong winds, commonly known as "Santa Ana Winds" which can reach speeds in excess of 90 miles per hour.

B. During the summer months, the Santa Ana Winds may produce periods of extremely low humidity, thereby reducing the fuels moisture and increasing the possibility and severity of fire from dry vegetation and other common

Page 589 of 630 ends

combustibles.

C. During the summer months, much of the City experiences prolonged periods of temperatures in excess of 100°F. When coupled with sustained severe Santa Ana Winds, an increase in the threat from rapidly moving wildfires exists.

LOCAL GEOLOGICAL CONDITIONS:

A. The Town is subject to moderately strong to severe shaking and surface ruptures resulting from known earthquake faults located within or near the City.

LOCAL TOPOGRAPHICAL CONDITIONS:

A. The City encompasses an area with limited access routes connecting areas developed with street and utility infrastructure from underdeveloped areas.

C. The diverse topography of the City, combined with numerous areas of lacking infrastructure, results in many areas having limited, and unreliable or unavailable water supplies available for firefighting purposes.

B. Pursuant to Section 17958.5 of the Health and Safety Code of the State of California, The City Council of the City of Twentynine Palms hereby finds that the amendments of the building standards contained in the California Building Code, Volumes 1, 2, 2025 Edition are necessary do to past earthquakes (Landers 1992) and the inherent run off problems incurred with severe thunderstorm activity and flooding due to the Cities desert location.

C. Copies of these codes and standards are on file with the Building Official fifteen days prior to the noticed hearing. Location is at 6136 Adobe Road.

BACKGROUND:

The City-owned building located at 73484 Twentynine Palms Highway has historically served as the home of the Twentynine Palms Chamber of Commerce Visitors' Center and Art Gallery. The City leased the building to the Chamber of Commerce, who operated the visitors' center with two part-time employees, supplemented by a third part-time position funded by the City. Staff believes this version of a visitors' center opened in 1995.

In January 2019, TBID staff began working in the current building. Prior to TBID moving into the space, the Public Arts Advisory Committee’s (PAAC) "Art in Public Places" quarterly exhibit program was well-established along the western interior wall. The 29 Palms Farmers Market was also taking place on Saturdays in the building’s rear parking lot. In 2022, the Farmers Market moved to Freedom Plaza.

Shortly after the TBID Director established an office in the building, TBID renovated the space. The revocations included new flooring, painting, updated displays, and expanded public-facing informational resources.

In the Summer of 2019, the Chamber of Commerce moved out. In the absence of the Chamber's leadership, the TBID assumed responsibility for the visitors' center operations. The TBID Board agreed to run the visitors' center temporarily, until it was relocated to Freedom Plaza as part of a planned multi-agency visitors' center partnership between the National Park Service, BLM, JTNPA, and the TBID.

When the multi-agency concept did not move forward, the only visitors' center that opened at Freedom Plaza, was solely focused on the Joshua Tree National Park. Since the building space within the Freedom Plaza complex is leased to the National Park Service (a Federal organization), NPS is prohibited from promoting any single business.

Page 595 of 630 ends

Since that time — 2020 through present — the TBID has continued to operate the City’s visitors' center on a temporary, year-to-year basis, employing one part-time assistant to support operations, which continued to be offered seven days a week. In January 2025, public hours were reduced again to reflect staffing constraints, (Mon-Sat).

Today, the visitors' center provides maps and printed brochures, digital and static displays featuring local businesses and area points of interest, access to restrooms and Wi-Fi, shaded outdoor picnic amenities at Bucklin Park, and ongoing gallery programming through PAAC’s Art in Public Places exhibits. The building also provides office space to the Desert Trail newspaper (leased at $500/month).

The TBID was created to market Twentynine Palms, develop partnerships, execute advertising and media strategies, and drive overnight visitation — not to operate a visitors' center facility. The continued responsibility of staffing and operating a City-owned visitors' center has placed an increasing administrative and operational burden on the TBID Director, reducing capacity for core tourism marketing responsibilities.

The TBID Director is the sole full-time staff member of the tourism district and is responsible for developing and executing the City’s annual tourism marketing plan and budget; managing paid advertising, PR, digital media, and content development; maintaining partnership development with regional, state, and national tourism organizations; supporting the Sponsorship and Event Grant Program; and serving as the primary liaison to industry partners, event producers, media, and the lodging sector. Operating a City visitors' center is not part of the TBID’s intended core scope of work, and absorbing day-to-day visitor services has reduced capacity for these core strategic functions.

After meeting with the City Council TBID subcommittee, the following options were identified and explored. City Staff is seeking direction from the City Council on future Visitors' Center operations. The following are potential options:

1. Continue operations in the current space (73484 Twentynine Palms Highway).

2. Close the Visitors' Center (73484 Twentynine Palms Highway).

3. Move Visitors' Center operations to Freedom Plaza within the JTNP Visitor Center space (Not a legally feasible option).

4. Move Visitors' Center operations to Freedom Plaza and locate said operations in a connex-style mobile office (1).

5. Move Visitors' Center operations to the Freedom Plaza Gymnasium front lobby roll-up desk area.

Based on the totality of circumstances (proximity to the JTNP Visitors' Center, limited TBID and City revenues, 73484 utilities, etc.), Staff recommends moving the Visitors' Center operations to the Freedom Plaza Gymnasium front lobby roll-up desk area.
(1) A connex-style mobile office is anticipated to cost $150,000 to $250,000 to purchase, install, and run all required utilities. This expense does not include monthly utilities.

ENVIRONMENTAL:

N/A
ALTERNATIVES:

The alternatives are contemplated above.

FISCAL IMPACT:

Closure of the 73484 Twentynine Palms Highway building as a visitors' center and leasing the building to a private business has the potential to produce approximately $1,500 dollars per month in additional rental income for a total monthly rental income of $2,000 per month. These are only estimates and have not been competitively bid out.

BACKGROUND:

City Council Policy No. 1, Waiver of City Fees for Facility Rentals, was last updated on May 14, 2024. The policy outlines which organizations are eligible for fee waivers, the required qualifications, and the limits of such waivers.

Since adoption, the City has tracked lost revenue associated with fee waivers and identified opportunities to clarify policy language and strengthen administrative procedures.

Members of the Finance Committee met with Staff to review the policy. The Committee recommended the following amendments:

Policy No. 1 (Fee Waiver Policy)
 Limit waived facility rentals to one (1) City-owned facility per calendar year (previously three). Page 599 of 630  Nonprofits must be registered and in good standing.
 Fee waivers will not be granted to entities or individuals convicted of crimes against the City or involved in pending litigation with the City.
 Fiscal sponsorships are not permitted; the nonprofit requesting the waiver must be the entity conducting the event.

Facility Rental Rules & Regulations
 Staff reserves the right to make adjustments to policy language as it relates to need.  Operational updates for all rentals, including deposits, cancellation policies, insurance, and other event requirements.

These amendments are designed to reduce lost revenue, clarify eligibility, standardize administrative procedures, and ensure that City facilities are used in a manner consistent with City priorities.

ENVIRONMENTAL:

None.

ALTERNATIVES:

The City Council may:

1. Approve the proposed amendments as recommended by the Finance Committee.

2. Modify the amendments and direct Staff to return with revisions.

3. Maintain existing policies with no changes.

FISCAL IMPACT:

Fee Waiver Policy: Expected positive impact on revenue by limiting free rentals from three days to one day per year and prohibiting fiscal sponsorships, reducing lost revenue compared to the previous policy.

Facility Rental Rules: Positive/neutral; clearer deposit and cancellation policies reduce risk of revenue loss from late cancellations and ensure compliance with insurance and operational requirements.

BACKGROUND:

The City of Twentynine Palms (City) and Twentynine Palms Water District (District) are collaborating their efforts to address the potential impacts to the shallow groundwater aquifers from septic systems within city limits.

For several years, the City and District have been completing tasks outlined in the Salt and Nutrient Management Plan (SNMP), collaboratively prepared, as required by the Colorado River Basin Regional Water Quality Control Board (Water Board). The plan was prepared in 2014 and later approved in 2019. Through this plan, they are undertaking measures to increase monitoring of the groundwater and to limit potential water quality impacts to groundwater that may arise from the septic systems in the region.

Residents of the City and the unincorporated areas rely solely on groundwater for their daily needs. This community pulls from four different underground basins (aquifers) that also overlap with neighboring districts. With no centralized sewer throughout the community, commercial and residential lots rely on septic systems to hold the domestic wastewater from their properties.

The District provides drinking water to their customers from deeper groundwater aquifers (>300 feet below ground surface). It is the District’s understanding that there is a clay layer separating the shallow groundwater from the deep groundwater. However, water naturally flows through paths of least resistance, so the potential for shallow groundwater to make its way down to the deeper groundwater remains present.

Page 613 of 630 ends

One of the main potential impacts to groundwater is septic systems. Within the City, there are individual systems for residential housing, and there are package systems (batch treatment) for residential developments, hotels and commercial areas.

With septic systems come different responsibilities. Due to systems holding domestic wastewater underground, they can pose a severe risk to our groundwater if they are not properly maintained. If installed, managed, and maintained as intended, septic systems are considered an acceptable solution to domestic wastewater treatment for rural areas. When septic systems are not regularly inspected and maintained, the results for potential water quality can impact the shallow groundwater.

There are eight (8) batch treatment systems in the City. The City and the District are aware of three systems that are failing. These systems are permitted by the Water Board. The other septic systems are individual residential systems that are permitted separately. Failing batch treatment plants may also effect water quality in the shallow groundwater.

The Water Board upholds that all water shall be protected, regardless of whether or not it is used for drinking, recreation or natural habitat. There is a need to better understand the quality of the shallow groundwater beneath the City. As part of the SNMP, measures have been identified to obtain information, communicate with residents and business owners, and implement ways to protect, or minimize the potential for further degradation of the shallow groundwater aquifers beneath the City.

The easiest and most immediate way to support these measures is to establish continual communications with the City Council, residents, and business owners. Communications can be used to provide education about septic systems and reminders about proper inspections and maintenance. These communications have just now begun with the addition of this memo and corresponding presentation by Matt Shragge with the District to City Council meetings. The City will have an item on the Consent Calendar each meeting to keep the City Council updated on this topic. The following are additional communication options to consider:

1. Add information to the City Website:
a. Community Events page:
i. Weekly Certified Farmers Market
b. Community Development Department Page
i. We could add a link called “Septic Systems” in it where we can add information. c. City Public Works website

2. Add information to the City Newsletter (info tidbits about septic systems and maybe information about timely inspections of septic systems).

3. Annual Pioneer Days – could be an opportunity to share how wastewater is managed

4. Community Health & Resource Fair
The District will also be looking into ways to spread the word about septic systems such as:

1. District Website:
a. Front Page - Hot Topics section (inclusion of tidbits about septic systems) b. Water Quality page – “Protecting Your Water”
c. Providing links to existing SNMP and other groundwater related reports d. Septic Tank Maintenance Section

2. District Quarterly Newsletter
These are options to consider and do not need to be implemented at once, but little by little as deemed appropriate. The intent is to keep residents informed of the City’s activities with respect to water quality, so that a foundation is established, conversations can begin, and improvements made as they are identified.

The Water Board has been engaged in discussions with the City and the District. Progress on septic system management is expected and accomplishments are reported on annually. Progress has now begun with the inclusion of this memo and the District’s presentation to this City Council Meeting.

BACKGROUND:

Staff is requesting a sub-committee of two Council members to assist with the design work for the proposed Animal Shelter. This sub-committee would provide staff with guidance on elements of the design and sheltering program. The design work has resulted in numerous questions that should be addressed by members of the City Council, ensuring the work can progress in a timely manner. Some of the issues include budgetary concerns, design elements, program elements, and location issues.

Staff feels that consistent guidance would be beneficial to avoid scope creep and excess costs. Any major changes would be brought to the full City Council for review. Staff is currently reviewing the 2nd iteration of the design at the third site location.

This project is tied to the 2023 Strategic Plan.

STAFF REPORT
TO: City Council
FROM: City Manager
FOR MEETING: Nov 12 2025
SUBJECT: Affordable Housing Update (November 2025).

RECOMMENDATION:

This an informational item and an opportunity for City Council discussion and potential direction on any number of items including (i) issuing an RFP on the three acres west of City Hall, and (ii) issuing an RFP for developers/service providers interested in administering programs geared towards helping existing elderly or low income homeowners stay in their homes through rehabilitation and/or adaptation. In all cases, issuing an RFP would be feasible in Q1 or Q2 2026.

BACKGROUND:

Pursuant to Council direction, City Staff continues speaking with various housing providers and/or evaluating opportunities to promote the development or maintenance of market rate, attainably-priced, owner-occupied rehab programs, and/or subsidized (affordable) housing.

Since the last update, some of the most notable actions which have taken place include:
1) The Housing and Homeless Subcommittee met several times. 2) Councilmember Scott met with constituents to discuss housing needs and priorities. 3) Councilmember Ramirez met with NPHS to discuss constructing affordable housing within Twentynine Palms. Councilwoman Ramirez also discussed what programs NPHS can leverage to help older Twentynine Palms residents age-in-place.
4) Staff met with a LA-based developer.
5) On August 27, 2025, Milestone Housing Group, an affordable housing developer, confirmed they are not able to move forward with developing the three acres west of City Hall (specifically located east of Smoketree Ave, north of Civic Center Drive, and west of City Hall). While MHG will continue looking for available funding sources, they have not found any funding resources which would allow development in our area.
6) City Manager James (co-chair), Robin Schlosser (co-chair and Twentynine Palms Senior Center Director), and Councilwoman Ramirez (board member) continue to attend the East Desert Regional Steering Page 625 of 630 Committee meeting. Christina Benton does an exceptional job managing all meeting organization, operation, notes, minutes, and communications.
7) Councilmember Scott continues to nurture a positive relationship with CVHC.

Recognizing MHG is out of the three-acre deal, the City Council could recommend to Staff to issue an RFP for:
1) The three acres located west of City Hall.
2) In an effort to prevent homelessness through displacement from existing homes, the City Council could suggest that Staff search for developers and/or service providers interested in administering programs geared towards helping existing elderly or low income homeowners stay in their homes through rehabilitation and/or adaptation. In all cases, issuing an RFP would be feasible in Q1 or Q2 2026.

Re: Expression of Interest – Affordable Housing Development Partnership (APN 0618- 262-05)
Dear Councilwoman Ramirez and Councilmembers,
On behalf of Neighborhood Partnership Housing Services (NPHS) and our development partner, Homes & Hope, we are writing to express our strong interest in partnering with the City of Twentynine Palms to develop high-quality affordable housing on the City-owned site identified as APN 0618-262-05 (“City Hall Site”).

NPHS is a nonprofit affordable housing provider with 35 years of experience creating innovative housing solutions across the Inland Empire and surrounding region. We have developed and preserved hundreds of affordable homes, administered millions in down payment and rehabilitation assistance, and partnered with multiple cities to transform underutilized land into thriving, sustainable neighborhoods. Our mission is to build equitable communities where every family has the opportunity to achieve housing stability and generational wealth.

Our partner Homes & Hope are more than developers, but rather architects of opportunity, crafting vibrant communities where everyone has a place to call home. As a mission-driven affordable housing developer, their leadership brings nearly 20 years of experience in delivering impactful housing solutions for low-income families, seniors, veterans, and special needs populations.

Homes & Hope combines the positive attributes of the nonprofit affordable housing model with the efficiency, market responsiveness, and innovation of a market-rate developer. With in-house general contracting and construction management capabilities, they reduce building costs and maximize limited public resources. Their developments span the full continuum of affordable housing, including permanent supportive housing, workforce housing, and low/moderate-income for-sale homes.

Page 627 of 630 ends

As an affiliate of McCarthy Companies, an established real estate development and construction firm with over 40 years of experience, Homes & Hope leverages shared resources and decades of expertise in managing tax credit and publicly financed projects.

We believe the City Hall Site is an ideal location for this type of catalytic investment. The site is located within a Qualified Census Tract (QCT), enabling a 30% LIHTC basis boost, and achieves a perfect site amenity score for tax credits. Its central location offers walkable access to schools, public facilities, transit, retail, and civic destinations—conditions which also support strong public and political alignment.

We respectfully request the City’s consideration in entering into an Exclusive Negotiating Agreement (ENA) or similar arrangement that would allow our team to conduct predevelopment due diligence and prepare a conceptual proposal. Specifically, we seek to:
• Collaborate with City staff to establish a framework for phased predevelopment and funding access to accelerate project readiness.
• Deliver a conceptual affordable housing proposal within approximately 60 days, including preliminary site planning, design concepts, financing strategy, and anticipated community benefits.

Our vision is to create a thoughtfully designed, sustainable housing community that addresses local needs, maximizes affordability, and enhances the surrounding neighborhood. With early City support and a collaborative planning process, NPHS and Homes & Hope are confident in bringing forward a competitive, fully financed development plan that leverages local, state, and federal resources.

We welcome the opportunity to meet with you and your staff at your earliest convenience to discuss next steps. Thank you for considering NPHS and Homes & Hope as partners in advancing the City’s housing goals.

Sincerely,
Jesse Ibarra

STAFF REPORT
TO: City Council
FROM: City Manager
FOR MEETING: Nov 12 2025
SUBJECT: Holiday Closure.

RECOMMENDATION:

The City Council approve the holiday closure schedule as presented by the City Manager.

ORDER OF PROCEDURE:

Request Staff Report (City Manager Presenting)
Council Questions of Staff

Council Discussion

Discussion on Motion
Call the Question
BACKGROUND:

The holiday season is a special time for both the community and City Staff. Having worked hard throughout the year to provide residents and guests a high level of customer service throughout the year, City Staff looks forward to down time during the Christmas and New Year holidays. In past years, as a thank you to Staff, the Mayor allowed the City Manager to dismiss City Staff three hours early the day before a City-observed holiday. The City Manager is requesting City Council permission to grant all City employees the ability to leave work three hours early the day before a city-observed holiday. This early departure allows employees traveling outside the area additional time to get on the road and avoid both heavy traffic and/or traveling at night. Since each departments' hours and work requirements are different (e.g., Animal Control, Public Works, and Parks and Recreation), early departure varies by department and what specific responsibilities individual employees have that day.

Customer Service Demand and City Staffing between Christmas and New Years Historically, the week between Christmas and New Year is slow, from a customer service standpoint.

Few, if any, customers come into City facilities requesting assistance. Given efforts to automate frequently requested items (e.g., business license, public records, etc.), the need for in-person customer service has further declined. Residents and guests are able to access many core business needs online.

Some departments like Animal Control require staffing to be on-call seven days a week as well as on site for care taking of the animals. Public Work has on-call Staff for emergency response. Closing City facilities between Christmas Eve and New Year, uninterruptedly, allows City Staff to take additional time off to enjoy the holidays. The City currently observes the following holidays: Christmas Eve, Christmas

Page 629 of 630 ends

Day, New Year’s Eve, and New Year. Staff will use accrued paid leave for the additional time off taken during the holiday closure.

Given the above, the City Manager requests City Council permission to close City facilities to the public on Friday, December 26th and return on Monday, January 5, 2026. If the City Council supports being closed to the public beginning December 26th, the City would be closed to the public from Wednesday, December 24, 2025, to Friday, January 2, 2026. City Staff would be back to work on Monday, January 5, 2026.
