BACKGROUND:

On February 11, 2025, the City Council approved the purchase of a 2015 Ford-F750 Water Truck in the amount of $48,393.75 from HercRentals. Unfortunately, the vendor misrepresented the description and conditions of the truck, and upon its delivery, Public Works Staff identified various defects that needed repairs. Given these issues, Public Works Staff ultimately made the decision to cancel the purchase and searched for other alternatives.

The Public Works Department is requesting that the City Council approve the purchase of a 2,000-gallon water truck to replace the current unit, which has been in service since 2010 and is now 22 years old.

Despite extensive efforts to maintain the vehicle, it continues to experience significant mechanical Page 17 of 61 issues due to a failing Caterpillar C7 engine, a model widely recognized within the industry for inherent design deficiencies. Additionally, ongoing challenges in achieving compliance with California Air Resources Board (CARB) requirements further limit the vehicle's viability. Replacing this unit with a 2014 model year or newer water truck would significantly extend the City's ability to maintain long-term regulatory compliance and operational reliability.

This asset plays a critical role in both emergency response and routine maintenance activities by supporting dust control efforts required by state regulatory agencies, including the Air Quality Management District (AQMD) and the Environmental Protection Agency (EPA). It is utilized on the majority of Public Works projects, making it an essential resource for storm recovery and for the effective completion of many critical tasks performed throughout the year. Given that the water truck is integral to Public Works' daily operations, City Staff strongly recommends that City Council approve the purchase of a replacement truck before the old truck reaches its failure point.

Public Works Staff obtained three quotes, selecting the lowest, most responsible vendor. The proposed truck has been inspected and is in good reliable condition. Furthermore, the truck is newer than the previously approved truck and it has a two-year factory drive train warranty. The vendor, however, requires a $1,000 deposit to hold the truck. Given the time-sensitive nature of this acquisition and given how difficult it has been to find a used reliable water truck, with City Manager's approval, the $1,000 deposit was issued on February 4, 2026.

ENVIRONMENTAL:

N/A
ALTERNATIVES:

The City Council could choose not to approve the purchase of this unit.

FISCAL IMPACT:

This unit would be funded through Gas Tax funding. The funds have already been committed in the budget for FY 2025-2026. Total purchase price $63,685.00, plus any delivery fees.

STAFF REPORT
TO: City Council
FROM: Finance Director
FOR MEETING: Feb 10 2026
SUBJECT: Adoption of Resolution No. 26-__ to Approve and Adopt the City's Duplication of Benefits Policy and Processes.

RECOMMENDATION:

The City Council approve Resolution No. 26-__ to approve and adopt the City of Twentynine Palms' Duplication of Benefits Policy and Processes in accordance with the U.S. Department of Housing and Urban Development.

ATTACHMENTS:
• Exhibit A - Duplication of
Benefits Policy
• Resolution No. 26 -
Duplication of Benefits Policy
BACKGROUND:

On July 11, 2022, the City of Twentynine Palms was awarded a Community Development Block Grant – Coronavirus Response (CDBG-CV) grant in the amount of $713,255 from the California Department of Housing and Community Development (HCD). The CDBG-CV grant funded the acquisition and rehabilitation of a single lot with four (4) residential units: 6937 Elm Ave., 6939 Elm Ave., 6941 Elm Ave., and 6943 Elm Ave., collectively referred to as the Elm Property Project.

CDBG-CV funds were allocated under the 2020 CARES Act and governed by the Federal Register Notice FR6218-N-01-CDBG-CV, dated August 7, 2020, and issued by the U.S. Department of Housing and Urban Development (HUD).

As a recipient of CDBG-CV funds, the City of Twentynine Palms is required to develop, establish, and maintain adequate policies and procedures to prevent any duplication of benefits for assisted activities (individually or collectively). A grantee's policies and procedures are not adequate unless they include, at a minimum: (1) A requirement that any person or entity receiving CDBG-CV assistance (including subrecipients and direct beneficiaries) must agree to repay assistance that is determined to be duplicative; and (2) a method of assessing whether the use of CDBG-CV funds will duplicate financial assistance that is already received or is likely to be received by acting reasonably to evaluate the need and the resources available to meet that need.

Page 27 of 61 ends

In addition to the $713,255 CDBG-CV grant for the Elm Property Project, the City used General Funds to pay for the additional work needed to complete the project. The General Funds, however, are additional and not duplication of benefits received under the CDBG-CV grant.

The City's Duplication of Benefits Policy and Processes do not apply to the voucher subsidies currently received through the VASH program.

The purpose of the proposed policy is to uphold, enforce and document conformance with the duplication of benefit requirements under the CDBG-CV assistance program. City Staff recommends the adoption of the Duplication of Benefits Policy through the attached Resolution.

ENVIRONMENTAL:

Not applicable.

ALTERNATIVES:

The City Council could reject, change, or modify the proposed policy.

FISCAL IMPACT:

No fiscal impact at this time; however, implementation of this policy and processes will require use of significant Staff time.

DUPLICATION OF BENEFITS POLICY AND

1 City of Twentynine Palms
Duplication of Benefits Policy and Processes
The City of Twentynine Palms Duplication of Benefits Policy The Elm Property Project is funded through CDBG-CV funds allocated under the 2020 CARES Act and governed by the Federal Register Notice FR-6218-N-01-CDBG-CV, dated August 7, 2020, and issued by the U.S. Department of Housing and Urban Development (HUD).

Duplication of Benefits Policy
All CDBG-CV grantees are required to complete a duplication of benefits (DOB) analysis to ensure that each CDBG-CV activity provides assistance only to the extent that the project’s funding needs have not been met by another source. To comply with this requirement, the City of Twentynine Palms and its subrecipient(s) will demonstrate that no other funds are available for an activity by maintaining records of compliance with mandatory duplication of benefits requirements described in the Federal Register Notice of August 7, 2020.

A CDBG-CV grantee is required to develop, establish, and maintain adequate policies and procedures to prevent any duplication of benefits for assisted activities (individually or collectively).

The purpose of this policy is to uphold, enforce and document conformance with the duplication of benefit requirements under the CDBG-CV assistance program.

Duplication of Benefits Process
All applicants to the City’s CDBG-CV assisted programs are required to complete a Duplication of Benefits Affidavit as part of the application process. This affidavit acknowledges the City's requirement that any person or entity receiving CDBG-CV assistance must agree to repay assistance that is determined to be duplicative.

To meet the program requirements, the City has developed a method of assessing whether the use of CDBG-CV funds will duplicate financial assistance that is already received or is likely to be received by acting reasonably in evaluating the need and the resources available to meet that need.

Page 30 of 61 ends

1 The Duplication of Benefits analysis will be performed in accordance with guidance set forth by HUD as follows:

1. Assess Need: Determine the amount of need (total cost).

2. Determine Assistance: Determine the amount of assistance that has or will be provided from all sources to pay for the cost.

3. Calculate Unmet Need: Determine the amount of assistance already provided compared to the need to determine the maximum CDBG-CV award (unmet need).

4. Document analysis: Document calculation and maintain adequate documentation justifying determination of maximum award.

The assessment will be conducted by the City’s Finance Director and/or her/his designee. The process will include the following:

1. Upon receipt of the completed application packet, City’s Finance Director and/or her/his designee will review the Duplication of Benefits Statement and documentation to determine if the applicant has reported receiving any potentially duplicative assistance.

2. The City’s Finance Director and/or her/his designee will perform a third-party verification and validation of DOB information provided by the applicant. The documentation supporting the verification and validation may include:
a) Award letters from other funders
b) Screenshots from reports with applicant award and use of funds information (e.g., Small Business Administration (SBA) loan page, local program recipient reports, etc.)
c) Verification of benefits form completed by the funding agency or organization verifying and validating the amount awarded and the purpose of the funds.

3. The third-party verification of information must include the following information:
a) Dates funds were received
b) Specific uses of funds received, including dates of applicability as appropriate.

4. Based on a review of this information, City’s Finance Director and/or her/his designee may:
a) Determine that there is no duplication and proceed with consideration of the application for the full amount requested.

Page 31 of 61 ends

1 b) Determine that there is a partial duplication and proceed with consideration of the application for an amount that reduces the request by the DOB amount i.Amount Needed – Amount of DOB = Eligible Amount, subject to program cap c) Determine that there is a complete duplication and calculate the award as a zero award
i.NOTE: a complete duplication does not automatically make the applicant ineligible. If they can demonstrate that they used the funds for a different purpose or for a different time period than what is allowable under the CDBGCV funds, then they may be eligible for assistance. See next step for that process.

5. Calculation of potential duplication of benefits shall exclude nonduplicative funds, including, but not limited to:
a) Funds received that are not for the same purpose as the project or CDBG-CV activity.
b) Funds for the same purpose as the project or CDBG-CV activity but intended for a different eligible use or a different period of time.
c) Funds from private loans not guaranteed by the SBA.
d) SBA declined or cancelled loans

6. The City’s Finance Director and/or her/his designee may document the lack of a duplication of benefits utilizing the HCD Individual DOB Tracking Form and the HCD Project Tracking Forms.

7. All beneficiaries (individuals and entities) will be required to sign a Subrogation Statement or Agreement to address concerns around the potential for future duplication (for example a Paycheck Protection Program (PPP) application was made and was not denied but the applicant has not heard back).

8. When an application is approved in part, the City’s Finance Director and/or her/his designee will also include in the funding documents specific information around what the funds may be spent on so as to avoid duplication of benefits.

9. City’s Finance Director and/or her/his designee will require all successful applicants to provide documentation as to how funds are actually expended and will review this documentation to ensure no duplication has taken place.

1 Subrogation and Recapture Policy
The City of Twentynine Palms is responsible for ensuring that the CDBG-CV funds awarded by HUD comply with all federal, state and local requirements. In situations where funds are disbursed to applicants determined to be ineligible for assistance or are used for ineligible activities, the applicants, meaning those benefiting entities or persons from the program may be required to repay all or a portion of the funds received. The reasons for recapture include, but are not limited to, the following:

1. Recipient of funds does not comply with the terms of the agreement;

2. Recipient of funds withdraws from the Program prior to completion of the project and/or fails to meet a National Objective;

3. A project does not meet the requirements specified in Section 3 below;

4. Recipient of funds is found to have used program funds for an ineligible activity or cost;

5. Recipient of funds receives assistance for the same purpose as the subject CDBG-CV program, including, but not limited to, other federal, state, or philanthropic funding; and

6. Funds are remaining after the project is completed, the expenditure deadline has passed, or the agreement has expired.

The method of recapturing funds and the timeframe for doing so are determined on an individual project basis. However, the recapture method and timeframe are consistent with 2 CFR part 200 and other applicable cost principles. Complete recapture provisions are included in the agreement with the Grantee and are also included in any agreements between the Grantee and Housing Community Development (HCD).

All application documents, including the Subrogation Statement or Agreement, shall be retained in compliance with HUD’s record retention requirements.

Recapture Policy Components

1. Prioritization
The City of Twentynine Palms has the authority and shall consider recapturing the full amount of ineligible assistance, regardless of City staff or recipient responsibility in errors.

Recapture priority levels are based on ineligible amounts of funds received. In all cases, the City of Twentynine Palms will assess the recovery amount, recipient’s ability to repay, cost effectiveness, and other mitigating circumstances, to make a determination.

Page 33 of 61 ends

1 Each priority level has a progressively higher threshold for waiver consideration.

Recipient case files shall include documentation noting consideration factors and results.

Grant Recovery Amount Priority Level
>$5,000 High Priority
$1,000 - $5,000 Medium Priority
<$1,000 Low Priority

2. Notification
All grant fund recipients including business entities and individual beneficiaries have an obligation to notify the City of Twentynine Palms upon the award and/or receipt of any funds that may be a duplication of benefits for funds awarded through the CDBGCV program.

If the City of Twentynine Palms identifies a duplication of benefits or payment of ineligible funds, the City of Twentynine Palms will notify the recipient(s) via e-mail and/or registered/certified mail. The notice will include the amount of ineligible assistance to be repaid, the reason for ineligibility, and a timeline for recipients’ response (up to 30 days at the discretion of the City of Twentynine Palms).

3. Method of recapture and repayment
If recipients cannot repay ineligible grant funds, the City of Twentynine Palms may be able to waive repayment under terms of a signed Promissory Note, Grant Agreement, or similar document.

Compromise settlements may be negotiated. If reached, the contract must state that if default occurs, recipient will owe the entire amount of the distribution, not simply the negotiated amount. Compromise settlements should consider recipient’s finances and ability to pay. Recipients can repay in a lump-sum payment of the entire amount due or enter into a repayment agreement. This formal document is prepared by the City of Twentynine Palms, signed by both parties, and stored in the City of Twentynine Palms’ record system. Accrued interest may be waived from the repayment agreement if the City of Twentynine Palms determines interest is “against equity and good conscience”. The recipient will pay a set fee each payment period equaling the repayment amount plus processing costs of collection. For Rehabilitation or Reconstruction grants, a lien will be placed on the property for the duration of the payment schedule.

Page 34 of 61 ends

1 Enforcement actions, such as civil or criminal charges, shall be initiated if an ineligible assistance recipient refuses to pay in full or enter a repayment schedule. If no agreement can be reached, the City of Twentynine Palms may use the fullest extent of the law to seek repayment of all ineligible assistance received plus the collection costs. The City of Twentynine Palms’ efforts to collect ineligible assistance may include repayment agreements, court orders, garnishment of wages and/or income tax returns, the use of private or public collection agents, and any other remedies available, on a case-by-case basis. The City of Twentynine Palms retains rights to resolve disputes, compromise debts (negotiate settlement amounts less than the full amount), suspend or terminate
collection, and refer debt for litigation.

4. Redistribution of funds
Recaptured funds will be made available for redistribution by the City of Twentynine Palms within the activity the funds were originally appropriated under, if applicable.

If collected funds exceed eligible recipients at program end or after a program’s operational period, the City of Twentynine Palms will coordinate redistribution with the State.

BACKGROUND:

CalRecycle Local Assistance grants were designed to assist local jurisdictions with the implementation requirements of SB1383. The City used the first round of funding known as OWR1 for education and outreach materials specific to our community. While this outreach campaign was successful, Staff determined a more detailed assessment should be conducted should the legislature choose to fund a second round.

The City was notified by CalRecycle of the second round of the Local Assistance Grant in late 2022. This round, while technically the second round, was referred to as OWR4 and provided a stricter criterion for expenses than OWR1. City Staff conducted informal meetings with a variety of stakeholders and partners to determine challenges related to SB1383 regulations. In 2023, Staff developed the required project narrative based on these assessments and submitted the required documents to CalRecycle. This narrative included more education and outreach, the purchase of a single design unified front of house restaurant collection system and compliance training. The City was notified in April 2024 that our OWR4 grant narrative, budget, and plan had been approved.

Upon receiving this approval, Staff reached out to the same stakeholders and partners to discuss moving forward with the projects approved. During these later discussions it was determined that most stakeholders no longer desired to participate with the approved centralized collection bins. Staff then conducted a needs assessment to determine the most pressing issues, given two years since the previous assessment had passed. It was determined that refrigeration capacity was seriously lacking and Staff filled out an initial modification request in late 2024. This request was promptly denied, with a statement that no narrative modifications were allowed. This began a yearlong battle back and forth between City Staff and CalRecycle grants administrators requesting modification of the proposed narrative.

CalRecycle Staff repeatedly denied our modification requests even though the proposed changes were permitted by the grant guidelines. Staff began discussions about returning the funds but decided to continue pushing for modification. After multiple unsuccessful attempts, Staff requested assistance from John Davis of Desert Mountain Joint Powers Authority. Mr. Davis elevated our request and concerns to the Director of CalRecycle. With the efforts and contacts of Mr. Davis, we were successfully granted our budget modification.

Staff prepared and received approval to shift our grant funds towards assisting with refrigeration capacity at our qualified Food Recovery Organizations (FRO). Staff then worked to ensure these FROs were fully compliant with all requirements of the grant and would continue to provide resources to our community members. This caused some delays but ultimately all FROs are approved and compliant. Staff is asking the City Council to approve the following items:

1. City Council approves placement of refrigeration equipment to the following Food Recovery Organizations.

These organizations have all been vetted by San Bernardino County EHS and City Staff, ensuring compliance with all grant requirements.
a. The Hope Project 29 Palms, Inc (C.L.E.P.) operating out of Sanctuary Church. b. 29 Palms Community Food Pantry, Inc operating at First Assembly of God Church. c. Reachout Morongo Basin, Inc operating out of 29 Palms Senior Center.

2. City Council authorizes the purchase of True refrigerators, True freezers, and steel NSF storage racks from Best Buy Restaurant Equipment, with the lowest qualified bidder in the amount of $73,751.73 from the received Local Assistance Grant Funds (OWR4). Authorize a big contingency of $1500 for inflation from received Local Assistance Grant Funds (OWR4).

3. Require all Food Recovery Organizations to enter into a Memorandum of Understanding (MOU) with the City. This requirement is best practice and required due to the grant funding.

4. Authorize the City Manager to execute all documents necessary to purchase the quoted items.

5. Authorize the deposit for a special order per the quote terms of 50% of total quote, deviation from procurement policy.
