The City of Union City’s 2040 General Plan Annual Progress Report (“GP APR”) includes the following required elements:
A. The degree to which its approved general plan complies with the guidelines developed and adopted pursuant to Section 65040.2 and the date of the last revision to the general plan;
B. An overview of the City’s General Plan status and progress; C. A summary of recently completed and active General Plan and Development Code amendments;
D. The progress of the city or county in adopting or amending its general plan or local open-space element in compliance with its obligations to consult with California Native American tribes.
The Housing Element Annual Progress Report (“HE APR”) includes the progress in meeting its share of regional housing needs and the City’s consistency with implementation programs included in both the 5th Cycle 2015-2023 Housing Element and the 6th Cycle 2023-2031 Housing Element. The reason staff were required to include the status of implementation programs from the 5th Cycle and 6th Cycle Housing Elements is because the 6th Cycle Housing Element was adopted in May 2023, which was halfway through the reporting year. The HE APR is prepared using standards, forms, and definitions adopted by the Department of Housing and Community Development.
II. DISCUSSION
Attached to this staff report is the City’s 2023 GP APR, labeled Exhibit A, and the HE APR, labeled Exhibit B. The contents of the reports are briefly summarized in sections A and B, below.
A. General Plan Annual Progress Report
Consistency with State General Plan Guidelines
The 2040 General Plan, adopted in 2019, was prepared in compliance with the State’s General Plan Guidelines (Government Code 65040.2). The Background section of the GP APR describes the process of shaping the 2040 General Plan and the implementation programs to guide the plan’s goals.

General Plan and Housing Annual Progress Report Update
Government Code section 65302 requires general plans to include eight elements which are listed below along with the corresponding Union City General Plan elements in parenthesis:
• Land use Element (Chapter 3 - Land Use Element);
• Circulation Element (Chapter 5 – Mobility Element);
• Conservation Element (Chapter 8 - Resource Conservation); • Open Space Element (Chapter 8 - Resource Conservation); • Noise Element (Chapter 6 – Safety Element);

General Plan and Housing Annual Progress Report Update
2023 Zoning Amendments
The City processed several zoning amendments in 2023. Some of the notable zoning amendments included:
• Creation of a new zoning district called Corridor Mixed Use Employment for consistency with the 2040 General Plan and related update to the City’s Official Zoning Map to update zoning for parcels located within the Union City Boulevard corridor;
• Addition of standards related to outdoor dining and adding/streamlining review processes for outdoor dining areas;

Consultation with California Native American Tribes
A description of the City’s consultation with California Native American tribes is provided in the GP APR. Chapter 905 of the Statutes of 2004 requires that when preparing or amending a general plan or adopting a specific plan, opportunities for involvement of citizens of the California Native American tribes must be provided by cities and counties. complies with. The GP APR provides a detailed overview of compliance.
B. Housing Element Annual Progress Report
The HE APR provides progress on housing development and housing-related programs for 2023. The State requires detailed and specific reporting of the City’s progress in meeting its share of the regional housing need allocation (RHNA). The HE APR is attached and labeled Exhibit B.
In addition to the progress in meeting its share of regional housing needs, the reporting requirements include information related to discretionary applications for new housing development, compliance with various state requirements including identification of the City Council/RSA Agenda 512 Tuesday, May 14, 2024
General Plan and Housing Annual Progress Report Update
City’s surplus lands and projects that were processed consistent with SB 35, and status on State grants that the City received.
The HE APR tracks housing progress by reporting on the number of discretionary housing applications submitted, building permits issued, as well as certificates of occupancy that have been issued, which is the final step in the building permit process.
For housing projects completed or building permits issued, the reporting requires the units to be broken into affordability categories based on Area Median Income (AMI) for households. The categories include: Very Low Income (0-50% AMI), Low Income (50%- 80% AMI), Moderate (80%-120% AMI), and Above-moderate (Above 120% AMI). AMI for 2023 for a family of four is broken down as follows:
• Very Low Income was between $22,200 –$73,950,
• Low Income was between $73,950 - $112,150,
• Moderate Income was between $112,150 - $177,500, and
• Above-moderate Income was $177,500 or more.
For 2023, the City issued building permits for 24 units including seven (7) Very LowIncome units, seven (7) Low-income units, seven (7) Moderate Income units and three (3) Above-moderate income units. All of the Very Low-Income, Low-Income, and ModerateIncome units were accessory dwelling units (ADU). The breakdown of affordability for ADUs was based on feedback from the State Housing and Community Development Department. The Above-moderate units were associated with permits issued for three (3) single -family residences. The Planning Division also approved two (2) housing applications with two (2) units of housing approved by the Planning Division.
As part of the APR, the City also includes a Housing Programs Progress Report that provides a summary of the implementation of the Housing Element programs. As detailed above, due to the 6th Cycle Housing Element being approved in May 2023, the report includes status on implementation of both the prior 5th Cycle Housing Element as well as the 6th Cycle Housing Element.
III. RECOMMENDATION
It is recommended that the Planning Commission recommend the City Council accept the 2023 General Plan Annual Progress Report, included in Exhibit A, and the 2023 Housing Element Annual Progress Report, included in Exhibit B.

1. 2023 General Plan and Housing Annual Progress Reports Update Natalie Dean, Associate Planner, provided an extensive PowerPoint presentation on the 2023 General Plan and Housing Element Annual Progress Reports (APR) Update. Staff recommended the Planning Commission make the following motion: That the Planning Commission recommend the City Council accept the 2023 General Plan Annual Progress Report and 2023 Housing Element Annual Progress Report.
Commissioner Guio understood specific items had been covered in the PowerPoint presentation but not others and asked whether anything had not been included in the PowerPoint presentation.
Ms. Dean acknowledged there was a lot of information. Staff had highlighted those programs that had the most significant progress and were important to the City.
Commissioner Guio referenced the APR and asked whether the City was meeting its Regional Housing Needs Allocation (RHNA) given there were concerns in many communities about the Builder’s Remedy.
Mr. Farmer advised the City’s Housing Manager, Francisco Gomez, was present remotely and could respond to any questions related to the Housing Element.
City Council/RSA Agenda 516 Tuesday, May 14, 2024
ATTACHMENT 3
Planning Commission Minutes 3 May 2, 2024
Alex Mog, Deputy City Attorney clarified the Housing Element must zone for capacity to accommodate the RHNA and the City must report on the progress of getting those units built.
Mr. Mog reported that Union City’s Housing Element had been certified by the state and the Builder’s Remedy would not apply. Whether or not the units were built was largely out of the City’s control and the Builder’s Remedy would only be triggered absent a compliant Housing Element in place. That was not the case for Union City.
Commissioner Romero asked about the unhoused population and what significant progress had been made including work with the Bay Area Community Services (BACS) Program and the City of Hayward.
Francisco Gomez, Housing & Community Development Manager, reported that Union City had received a conditional award from the State Department of Housing and Community Development (HCD) for the City’s application in conjunction with the City of Hayward and BACS for the purchase of single-family homes, to be converted to house Extremely Low-Income persons experiencing homelessness. The City was preparing an application with HCD and had gone through the initial stages of documentation submittal requirements for final review and approval.
Mr. Gomez explained that an award of $9.2 million had been received, which allowed in coordination with BACS, the purchase of one single-family home in Union City and six singlefamily homes in the City of Hayward, in the hopes of providing housing for up to 31 individuals. It had been determined this was one of the best ways to address homelessness while Union City did not have the current capacity to build a homeless shelter.
Mr. Gomez stated Union City also worked with the City of Fremont to have homeless individuals go to Fremont’s Sunrise Village Shelter facility given it was prohibitive for Union City to build a homeless shelter as the base costs for an emergency homeless shelter at minimum would be $8 to $10 million to build and another $1 to $3 million in yearly operating costs.
Mr. Gomez explained that when Homekey, an HCD program and statewide effort to sustain and rapidly expand housing for persons experiencing homelessness or at risk of homelessness, came up with another round of funding, they could show proof of concept and reapply for additional funding to purchase additional homes in Union City to integrate those experiencing homelessness back into the community.
Mr. Gomez confirmed there was no plan to build an emergency homeless shelter in Union City at this time, with the plan to address homelessness now based on the model described. Community partner BACS had already purchased the homes and was waiting to finalize all agreements between the cities of Union City and Hayward along with Memorandums of Understanding (MOUs) and standard agreements with the state to ensure all funding was in line. It was hoped they would be up and running in the next three to four months.
Commissioner Sandhu suggested the City needed more homeless shelters given the number of people living near the creek or under the bridges, with the homeless having been asked to leave those areas located near residential areas.
Mr. Gomez explained that Union City’s Homeless Manager managed direct outreach to homeless residents and had increased staff for homeless outreach, but in terms of generating shelters, again that had been determined to be cost prohibitive, although if the opportunity arose the City could always work with its affordable housing development partners to determine a willingness to be a partner and develop that type of plan in Union City.
City Council/RSA Agenda 517 Tuesday, May 14, 2024
ATTACHMENT 3
Planning Commission Minutes 4 May 2, 2024
Commissioner Sandhu added that Union City’s fees were higher than other cities. As an example, she understood the fees for adding units to a residence were high. She asked if that would be addressed.
Mr. Gomez commented that while not part of the APR presentation, there had been a lot of Accessory Dwelling Unit (ADU) development in Union City this year that had been counted, with more individuals building ADUs on their properties. There were differences between an ADU to be occupied by a family member or an ADU placed on the market. At this time, there were no requirements to rent out an ADU to those in the Low-Income category. It was hoped that ADU rental units would be targeted to that segment of the community given the need for housing.
Ms. Dean reported the City offered a 20 percent discount for seniors 65 years of age or older for resident or owner-occupied projects.
Mr. Farmer added the City Council annually adopted a Fee Schedule for the year not related to the programs under discussion but was an annual discussion based on input from all City Departments and approved prior to the fiscal year, which started on July 1 each year. He also clarified that ADUs that were less than 750 square feet in size were usually exempt from most Development Impact Fees. Guidance was provided to the public on potential fee reductions.
Commissioner Gupta Garg thanked staff for the detailed report. Referencing Attachment 1, General Plan APR Summary Table, Program ED-5.A, Warehouse Transformation Strategy, she found that to be a great initiative and asked whether there had been any new applications or areas of development in the City that would fall under this category.
Ms. Dean confirmed there were some industrial projects coming up. As an example, there was an application for a very large operating warehouse/industrial facility that would be required to comply with requirements for employee amenities, design requirements and new objective design standards for Industrial Districts. The applicant would also be required to meet criteria for the location of windows, breaks in the façade to provide a more attractive design and new parking requirements to accommodate more office jobs.
Commissioner Gupta Garg asked whether those applications involved renovations, additions to a warehouse or just tenant improvements.
Ms. Dean clarified the application she was speaking of was for a building, as she had described, which would be subject to certain design requirements to ensure an attractive building design.
Mr. Farmer reported that on February 15, 2024, the Planning Commission approved Site Development Review and Variance requests for the United Mechanical, Inc. (UMEC) project for a new industrial building on Western Avenue.
Commissioner Gupta Garg also speaking to Attachment 1, asked the status of Program HQL-2.A, Parks and Recreation Master Plan.
Farooq Azim, City Engineer, commented while not his area of expertise, he understood the City was going through the Request for Proposal (RFP) process for consultants to provide proposals to prepare a plan that could take about three months or so and another six months thereafter to complete the review process. It would likely be a year before a Parks and Recreation Master Plan was in place. He confirmed the Plan would come before the Planning Commission for approval eventually.
Commissioner Gupta Garg again speaking to Attachment 1, asked the status of Program CD-6.A, Public Art Master Plan and CD-6.B, Mural Program, and whether those programs would be considered this fiscal year.
City Council/RSA Agenda 518 Tuesday, May 14, 2024
ATTACHMENT 3
Planning Commission Minutes 5 May 2, 2024
Ms. Dean understood the Arts and Culture Commission would designate the programs as priorities starting this year. The Arts and Culture Commission meets every Tuesday. and their priority is the Public Art Inventory of existing public art throughout the City with the goal to make that inventory available online.
Ms. Dean highlighted some of the development projects that had been required to provide public art as a condition of project approval and prior to final approvals and the issuance of a Certificate of Occupancy which she emphasized the City did enforce.
Commissioner Gupta Garg lastly referenced Attachment 1, Program RC-7.A, Update the Climate Action Plan. While it was great the City was meeting the requirements of the Bay Area Air Quality Management District (BAAQMD), she urged the City to push the boundaries more and cited CALGreen’s more stringent requirements for carbon reduction that should be adopted for the built-in environment and should be pushed by the City more.
Chairperson Lew referenced Attachment 1, specifically the Time Frame column on each page, and questioned what the City was doing with some of the outdated fiscal year dates and whether updates were being provided on the line items.
Ms. Dean cited Program ED-1.A, Economic Development Strategic Plan as an example, and reported the City Council had approved an update to the Economic Development Strategic Plan to begin later in the year. This effort had been delayed due to a lack of staffing and other priorities, but a consultant is currently working with staff on a scope of work. The City’s General Plan had been adopted in 2019 and the time frame dates had been identified as shown. In the case of program ED-1.A, the time frame reflected when the Economic Development Strategic Plan had been adopted and that it would be updated every five years. Staff was actively pursuing the work and any other questions could be directed to planning staff or the Economic Development Director.
Chairperson Lew understood an update to the Economic Development Strategic Plan had not occurred since 2019.
Ms. Dean reiterated the Economic Development Strategic Plan would be updated but she would check with staff to verify when the last update had occurred.
Chairperson Lew asked how often the APR for the General Plan was issued.
Ms. Dean advised the APR report for the current General Plan had been submitted in 2023 for calendar year 2021 and 2022 since they had missed 2021. That was the first APR submitted by Union City after the acceptance of the General Plan in 2019.
Chairperson Lew asked why they were using fiscal years for the program time frames and calendar year for the reports.
Mr. Farmer clarified that the funding for programs on the City level was done in the fiscal year, grants were allocated by the state in the fiscal year and the General Plan was in the calendar year. The same applied to the Housing Element.
Mr. Gomez added that on the federal level everything was done in the fiscal year, which was why a fiscal year had been referenced for the Housing Element programs.
Chairperson Lew asked why some of the time frames in Attachment 1 had shown fiscal year 2020/21 when some updates had been provided today.
City Council/RSA Agenda 519 Tuesday, May 14, 2024
ATTACHMENT 3
Planning Commission Minutes 6 May 2, 2024
Ms. Dean suggested that was related to the staff shortage and the pandemic or other City priorities affecting staff, but she would have to get more information and get back to the Planning Commission.
Mr. Farmer clarified the General Plan had been formally adopted in December 2019, the programs started in calendar year 2020/21, the baseline for the annual reporting for the General Plan. He could not speak to every policy and program shown and confirmed some things had been put on hold due to staffing issues and the pandemic. There had been some annual reporting on different cycles moving forward.
Chairperson Lew suggested some of the time frames should be adjusted since it did not make sense to have the old dates and some of the programs may not call for any updates. She asked staff to provide that clarification since the information was otherwise confusing. She asked whether every line item had been updated for 2023.
Ms. Dean noted some updates had occurred in 2021 or 2022, as indicated in the Updated Status for 2023, as shown in Attachment 1. She understood the time shown in Attachment 1 had been left to reflect what the time frames for implementation program completion in the General Plan had been taken directly from the General Plan.
Chairperson Lew reiterated her concern with the time frames shown and whether the dates were correct and whether they should be shown as completed in Fiscal Year 2020/21, which would not require an update. She asked whether any of the elements had been completed pursuant to the time frames shown.
Ms. Dean suggested moving forward they could work that out to indicate completion rather than include outdated dates. She emphasized the importance of identifying the goals and policies of the General Plan, when adopted, with the spreadsheet directly from Chapter 10 of the General Plan, that is meant to track the progress of meeting goals and adhering to policies, and that the progress would be used for the next General Plan update. A few of the programs were not happening and had been canceled. Also, in the General Plan amendments in 2023, General Plan Implementation Programs had been added to the Safety Element and Housing Element. The General Plan Annual Progress Report Summary Table in Attachment 1 provided a way to track progress.
Chairperson Lew suggested the General Plan Implementation Chapter was frozen in time, she had not seen an update to the plan and found it difficult to provide progress reports on something that was frozen in time when the dates were not updated.
Mr. Mog reported staff could not change the General Plan and if the City Council wanted to direct staff to change the dates in Chapter 10 that was something the City Council could do, but staff could not administratively change the dates. While it may be helpful to acknowledge when things were done and include that information in Attachment 1 in the time frame column, Chapter 10 could only be updated at the direction of the City Council.
Chairperson Lew reiterated she found it difficult to work with a published report that was so outdated and confusing.
Mr. Gomez explained that for the APR for the Housing Element Programs, HCD asked that the City maintain those years and items that were complete or had been completed and were not to be removed from the list. As a result, they had started to mention the programs first mentioned in the 5th Cycle Housing Element and any new items included the corresponding change of letters and program name. Since the time period HCD required reporting was from January 1 to City Council/RSA Agenda 520 Tuesday, May 14, 2024
ATTACHMENT 3
Planning Commission Minutes 7 May 2, 2024
December 31, many times the programs overlapped from year to year, which was why the fiscal year period was used and to be consistent on the APR side of the Housing Element. If there was a specific item done in a specific program year, it would be reported.
Chairperson Lew spoke to the Housing Element tracking system for the APR and the date on
January 31, 2031, which was more than a year. She asked for clarification whether this was or was not an annual report.
Mr. Gomez explained the date was the program period for the 6 th Cycle Housing Element itself
provided by HCD and the City was not allowed to change any of the dates since HCD provided the dates for the program period to work within. The Housing Element period covered the period from 2023 to 2031, with yearly reporting expected during that period from 2023 through 2031.
The only change would be the date of the reporting year.
Chairperson Lew referenced a court decision that had involved some cities in Southern California that had issues with split residential parcels and removing Single-Family zoning. She asked whether there would be any impacts to Union City.
Mr. Mog explained that the court case referenced was a trial court decision and only applied to the cities that were a party to the case. He expected the state to appeal and or the legislature to fix the issue the court found. Even if the state found the case would apply statewide, it would only apply to charter cities and would not apply to Union City. He acknowledged other housing laws had been challenged by cities and the courts had found in favor of the state legislature, but for the court case referenced, the legislature had indicated the need to increase the supply of affordable housing. Ultimately, the law only applied to charter cities which had local control that general law cities did not have. He also acknowledged that Union City had attempted to become a charter city a few years ago but voters had rejected the idea and had voted it down.
Chairperson Lew asked whether there were any funds expected from the state to build affordable housing.
Mr. Mog reported the state had significantly increased the amount of money put towards affordable housing projects and he expected a large regional bond in the November 2024 election.
He emphasized the cost to build affordable housing was significant, at over $1 million per unit due to various costs. While there was money available, it would not go very far and those types of costs prohibited the development of homeless shelters, as an example. However, the City of San Leandro was developing a homeless navigation center that involved a multi-million-dollar endeavor.
Commissioner Sandhu commented she too had been confused by the time frames in the APR and whether the dates were fiscal year or calendar year, particularly Program RC-3.A, Green Infrastructure Plan.
Ms. Dean clarified Program RC-3.A, Green Infrastructure Plan had been completed and adopted in 2019.
Commissioner Sandhu also referenced Program PF-12.A, Evaluate Feasibility of Building a New Library, which had shown no established timeline for the work, with the project pending. She suggested that the timeline be identified.
Ms. Dean explained that the information as written had come exactly from the General Plan. A General Plan Amendment (GPA) would have to be considered to show a different time frame.
Moving forward adjustments may be considered to incorporate some of the input provided. She City Council/RSA Agenda 521 Tuesday, May 14, 2024
ATTACHMENT 3
Planning Commission Minutes 8 May 2, 2024
noted some of the programs had moved forward with great success while others had not, and she understood Project PF-12.A was one of those projects. She also clarified Project RC-4.A, Maintain Inventory of Historical Resources, with the timeline shown was ongoing.
Commissioner Sandhu suggested fiscal or calendar years should be clarified in the APR.
Ms. Dean again explained why the timelines had been shown as they had.
Mr. Farmer added the way the information had been provided in the tables included a lot of information from the City Council and City Manager’s Office. Input from the Planning Commission, including the potential change in the way the information was shown, would have to consider other City factors but the concerns could be relayed to the City Manager’s Office and City Council.
Commissioner Sandhu also referenced Project S-8.A, Review Community Noise Ordinance, and asked for clarification since the updated status for 2023 had shown that no changes to the Noise Ordinance had been required.
Mr. Mog explained that Project S-8.A, Review Community Noise Ordinance, was intended to evaluate whether or not to update the Community Noise Ordinance, with the status showing no changes were necessary, and with staff to address noise complaints on an individual basis.
Commissioner Guio referenced Exhibit B, Housing Element Tracking System, Annual Progress Report, Table D – Programs Implementation Status, HE-6.D, Increase Opportunities in the Decoto and Historic Alvarado District Neighborhoods (6th Cycle Housing Element) and asked for clarification of the status of the program implementation, which referenced the City having completed a park upgrade in the Historic Alvarado District in 2024, and had identified a park project that would benefit the Decoto Neighborhood to begin work in FY 2024/25. He asked if the references were to Cesar Chavez Park.
Mr. Gomez confirmed that Program HE-6.D was related to park upgrades to the Historic Alvarado District Park/Cesar Chavez Park, and with upgrades in the current Decoto Neighborhood, Charles F. Kennedy Park, which had been selected since it met Community Development Block Grant (CDBG) federal funding criteria and was located adjacent to a low-income housing census tract.
Commissioner Romero suggested the time frame for both reports, the General Plan and Housing Element, should be provided in the same fashion which would be helpful in the future.

City Council/RSA Agenda 523 Tuesday, May 14, 2024
Agenda Item
DATE: 5/14/2024
TO: HONORABLE MAYOR AND CITY COUNCIL
FROM: JACKIE ACOSTA, FINANCE DIRECTOR
SUBJECT: ADOPT A RESOLUTION APPROVING THE FISCALYEAR 2024-2025
MASTER FEE SCHEDULE
Staff recommends that the City Council conduct a public hearing, consider information and updates provided by staff, and adopt a resolution approving the proposed Fiscal Year 2024-2025 Master Fee Schedule as presented.
STRATEGIC PLAN ALIGNMENT
GoalA: Fiscal Stability and Sustainability
BACKGROUND
Staff annually reviews and analyzes rates, fees and charges for providing City services and incorporates these rates, fees and charges into a single document known as the Master Fee Schedule. The last revisions to the Master Fee Schedule were approved and adopted by the City Council in May of 2023. Updates to the Solid Waste, Recycling and Stormwater Fees will be addressed through separate, subsequent actions by the City Council at a future meeting, which is typical since these taxes and fees are collected by the County through property taxes.
DISCUSSION
The Master Fee Schedule consolidates in one place the rates, fees and charges for services charged by each department. The fees are updated each year to reflect: 1) the actual costs of providing the various services, 2) rate increases as prescribed in the Union City Municipal Code, 3) the City’s share of Federal rates, if applicable, and/or 4) increases in the Consumer Price Index (CPI). Staff uses the February to February CPI for the San Francisco Bay Area - All Urban Consumers Index, which was 2.4% for that time period.
City Council/RSA Agenda 524 Tuesday, May 14, 2024
Below, and attached to this staff report, is a summary of significant changes to the Master Fee Schedule from Fiscal Year 2023-2024. Attached to the resolution is a schedule showing the proposed Master Fee Schedule for 2024-2025.
FISCAL IMPACT
The fiscal impact will vary depending upon the volume of activity related to each fee.
