SUBJECT: ADOPT A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH TRI-CED COMMUNITY RECYCLING TO REAUTHORIZE THE USE OF THE $250,000 GRANT OF IMPORT MITIGATION FUNDS FROM THE CITY OF UNION CITY
THAT WERE PROVIDED BY THE ALAMEDA COUNTY WASTE MANAGEMENT AUTHORITY IN 2005 FOR THE CONSTRUCTION OF A COMMUNITY ENVIRONMENTAL EDUCATION AND
TRAINING CENTER
EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution authorizing the City Manager to enter into a new agreement with Tri-CED Community Recycling (“Tri-CED”) for a $250,000 grant. This grant, originally sourced from the Import Mitigation Funds from Alameda County Waste Management Authority in 2005, is being proposed to construct a training and community education center. The proposed facility will serve as both a training room and a community environmental education center.
STRATEGIC PLAN ALIGNMENT
There is no direct alignment with the Strategic Plan.
BACKGROUND
On September 13, 2005, the City Council approved Resolution No. 3045-05 (see Attachment 1), appropriating $250,000 from the City's Import Mitigation Fund to Tri-CED for the construction of an environmental education facility at 33377 Western Avenue, Union City. The Import Mitigation Funds (totaling of $474,246) were received by the City from Alameda County Waste Management Authority for the purpose of developing new programs that supported the Authority’s goals of “increasing recycling and landfill diversion throughout Alameda County.” The City sponsored several programs to enhance diversion from the landfill and also granted $250,000 to Tri-CED for the purpose of constructing an education center.
In March 2007 the City and Tri-CED entered into a Grant Agreement for the purpose of funding the education center. The City transferred the funds to Tri-CED at that time. The funds were to be returned to the City if they were not used for hard construction costs within three years.
In early 2010, prior to the expiration of the agreement, Tri-CED approached the City with a revised proposal to purchase a mobile educational facility patterned after successful mobile facilities operated by cities ranging from Long Beach to Cambridgeshire County, England. The proposed facility consisted of a 40 to 55-foot custom trailer, pulled by a full-size tractor-type truck and was expected to cost an estimated $1 million. The City Council authorized the revised proposal with the adoption of Resolution No. 3958-10 (see Attachment 3) and authorized the Mayor to enter into a new agreement. Based on City records, a new agreement was never executed.
In 2012, Tri-CED informed the City that it abandoned the trailer project due to its large carbon footprint and logistical challenges, opting for a smaller education and training facility on the Tri-CED property. The City Council adopted Resolution No. 4300-12 (see Attachment 4) authorizing the City to enter into a new agreement with Tri-CED and allow the re-programming of the funds, subject to approval of Alameda County Waste Management Authority. Once again, no agreement was executed in 2012, and there is no information why the agreement may have stalled.
DISCUSSION
Tri-CED is seeking City Council support to prepare a new grant agreement that would reestablish the use of the funds to be used to purchase a modular unit to be placed on the Tri-CED property for an Environmental Education and Workforce Training Program (“Program”), as well as employee training. (See Attachment 5 for a description of the Program).
Tri-CED’s Program would provide community education for individuals in Alameda County on proper waste management practices, aiming to increase recycling rates and reduce waste sent to landfill. In addition, Tri-CED would provide workforce development programs for young people aged 14 to 24 who may be interested in the recycling industry and would provide development of core job skills, on-thejob training, certifications, leadership development, and supportive services. Lastly, Tri-CED is proposing to provide an apprenticeship program for recycling collection vehicle operators.
The proposed facility would serve as both a training room and an education center. This updated proposal is similar to the proposed use approved by the City Council in 2012.
FISCAL IMPACT
There is no fiscal impact to the City arising from the proposed resolution as Tri-CED received the Import Mitigation Funds from the City in 2007.
If the City Council does not reauthorize the use of the $250,000 and enter into a new agreement for the use of the funds, the funds should be repaid to the City as all previous agreements have expired.
RECOMMENDATION
Staff recommends that the City Council adopt a resolution authorizing the City Manager to enter into a new agreement with Tri-CED Community Recycling to reauthorize the use of the $250,000 grant of Import Mitigation Funds from the City of Union City that were provided by Alameda County Waste Management Authority in 2005 for the construction of a community environmental education and training center.
