TO: HONORABLE MAYOR AND CITYCOUNCIL
FROM: JOAN MALLOY, CITYMANAGER
SUBJECT: ADOPT A RESOLUTION AWARDING A CONSTRUCTION CONTRACT TO ROSAS BROTHERS CONSTRUCTION, IN THE AMOUNT OF $539,954, FOR THE ANNUAL SIDEWALK, CURB & GUTTER, AND RAMP REPAIR PROJECT, CITY PROJECT NO. 25-03, AND APPROVING A TOTAL CONSTRUCTION BUDGET IN THE AMOUNT OF $647,945

EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution awarding a construction contract to Rosas Brothers Construction, in the amount of $539,954, for the Annual Sidewalk, Curb & Gutter, and Ramp Repair Project, City Project No. 25-03, and approving a total construction budget in the amount of $647,945.

STRATEGIC PLAN ALIGNMENT
This agenda item is aligned with the following:

Goal D, Strategy 2: Environmental Sustainability and Infrastructure – Implement the City’s capital improvement plan.

BACKGROUND
The scope of this project consists of making improvements in front of private property at approximately 117 locations citywide. The project work is comprised of repairing uplifted or damaged sidewalks and curbs & gutters, upgrading ramps, and removing trees uplifting sidewalks throughout the City. The list of locations to be repaired was compiled from inspection findings prompted by public works service requests submitted through the City’s website and by staff observations made during the course of daily work duties.

DISCUSSION
On July 18, 2025, plans and specifications for the Annual Sidewalk, Curb & Gutter, and Ramp Repair Project were released and advertised for bid as the 2025 Sidewalk, Curb & Gutter Replacement Project. Four (4) bids were received and opened on July 29, 2025 (Exhibit A). The low base bid was submitted in the amount of $539,954 by Rosas Brothers Construction, of Oakland, California, which is more than 8% lower than the engineer’s base bid estimate at $588,000 for the project.

Following the standard practice of allocating a contingency amount to address any unforeseen conditions that may require additional work, the Public Works Department recommends a 20% construction contingency to ensure a successful project. The estimated project budget for the construction phase is as follows:

Construction Contract Amount $539,954
Contingency - 20% of Contract $107,991
Total Estimated Construction Cost $647,945
Rosas Brothers Construction has performed work for the City in the past as a subcontractor. Reference checks found their work to be satisfactory. Public Works staff recommends the award of the construction contract to Rosas Brothers Construction.

Pursuant to the California Streets and Highways Code, Section 5610-5618 and Union City Municipal Code, Section 12.08.615, Sidewalk Maintenance - Duty and Liability, the maintenance and repair of the sidewalk is the responsibility of the adjoining property owner. At the beginning of August, letters were mailed to all affected Union City property owners to advise them of their estimated costs for the sidewalk repairs and the projected timeline. Upon completion of the work, a second letter with the exact cost of the sidewalk repairs will be sent to the property owners, who will be given three options for either payment in one lump sum, payment in installments, or a lien on their property.

FISCAL IMPACT
Funding for the Annual Sidewalk, Curb & Gutter, and Ramp Repair Project, City Project No. 25-03, is identified in the approved Five-Year Capital Improvement Plan for Fiscal Years 2025-2026 to 2029-2030. The construction costs will be funded with $147,945 of State Gas Tax funds (Account Number 25092503-57128), $150,000 of SB 1 Road Maintenance & Rehab funds (Account Number 25192503- 57128) funds, and $350,000 of Measure BB Bike & Pedestrian funds (Account Number 26792503-57128). There are sufficient funds in these accounts to fund the project costs.

By the end of 2026, twelve months after the projected completion of the project, staff estimates homeowners will have paid approximately $292,000 towards reimbursing the City for the sidewalk repairs as outlined earlier. Again, any amounts due for which the property owner has not elected to either pay in one lump sum or pay through an installment plan will have a lien placed on their property for the costs of their sidewalk repairs. All reimbursement funds received from property owner payments will be deposited back to the State Gas Tax Fund, SB 1 Road Maintenance & Rehab Fund, and/or the Measure BB Bike & Pedestrian Fund.

There is no impact to the General Fund.
