EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution authorizing the City Manager to execute the Third Amendment to the Contractual Services Agreement with VSCE, Inc., in the amount of $647,000, for a total contract amount of $1,530,100, for Project Management Services for the Quarry Lakes Parkway Project, City Project No. 18-04.

STRATEGIC PLAN ALIGNMENT
This agenda item is in alignment with the following:

Goal C, Strategy 2: Economic, Community Development and Public Safety – Facilitate the build-out of the greater Station District Area through the construction of the Quarry Lakes Parkway, completion of the pedestrian rail crossing, and implementation of the recommendations of the Southern Alameda County Regional Rail Integration Study to make the Station District a passenger rail hub served by ACE.

BACKGROUND
The Alameda County Transportation Commission (Alameda CTC) in 2018 approved a request from the City of Union City to be the project sponsor for the remaining phases of the I-880 to Mission Boulevard/East West Connector Project and to update the project description eligible for the remaining commitment from the 1986 Measure B Transportation Expenditure Plan to reflect the Quarry Lakes Parkway Project.

On February 12, 2019, the City Council adopted Resolution No. 5444-19, which authorized renaming the I-880 to Mission Boulevard/East West Connector Project to the Quarry Lakes Parkway Project. The Quarry Lakes Parkway, City Project No. 18-04, is funded with 1986 Measure B funds, 2014 Measure BB funds, and other transportation funds administered by Alameda CTC. The City of Union City has accepted over $9.0 million from the Alameda CTC Project Funding Agreement (PFA) No. A22-0053 for the Final Design of Quarry Lakes Parkway, City Project No. 18-04, see Exhibit A for City Agenda Item No. 4.5

Council Action for the Project Funding.

The City Council has identified in the Strategic Plan Goal C, Strategy 2: Facilitate the build out of the greater Station District Area through the construction of the Quarry Lakes Parkway, completion of the pedestrian rail crossing, and implementation of the recommendations of the Southern Alameda County Regional Rail Integration Study to make the Station District a passenger rail hub served by ACE.

The Quarry Lakes Parkway (QLP) Project is a new four-lane multimodal corridor, parallel to Decoto Road between Paseo Padre Parkway in Fremont and Mission Boulevard in Union City, and the Decoto Road “Complete Streets” Project is the modification of the existing four-lane Decoto Road to a transit priority and multimodal corridor between I-880 and Paseo Padre Parkway in Fremont, which the City of Fremont will implement. QLP in Union City consists of Phase 1: 7th Street Connection, Phase 2: Gateway Connection, Phase 3: 11th Street Connection, and Phase 4: Grade Separations and Alvarado-Niles Connection. QLP also includes Phase 5: Paseo Padre and Trail Connection, which is in both the cities of Union City and Fremont.

On August 9, 2021, the City of Union City entered into a Consulting Services Agreement with VSCE, Inc., in the amount of $74,100, for Project Management Services in the preparation of a Request for Proposal (RFP) for selecting a Consultant for the Final Design of Quarry Lakes Parkway for Phases 1 and 2, City Project No. 18-04, and managing the selected Design Consultant for the Preliminary Engineering (30% Design) Phase of Phases 1 and 2.

On January 11, 2022, the City Council adopted Resolution No. 5878-22, awarding the design of Phases (Segments) 1 and 2 of Quarry Lakes Parkway (East West Connector) to Mark Thomas & Company, Inc. This award came after several months of a Request for Proposals (RFP) process, conducting a pre-proposal meeting, responding to consultant questions, conducting a project interview and then, finally, selecting the most qualified, experienced consultant team, all for which VSCE was instrumental.

On September 13, 2022, the City Council adopted Resolution No. 6003-22, approving the First Amendment to the Consulting Services Agreement with VSCE, Inc., in the amount of $375,000, for a total contract amount of $449,100, and extending the “Term of Services” of the Agreement to December 31, 2023, for continued provision of project management services.

On January 9, 2024, the City Council adopted Resolution No. 6244-24, approving the Second Amendment to the Consulting Services Agreement with VSCE, Inc., in the amount of $434,000, for a total contract amount of $883,100 for the Project Management Services for the Quarry Lakes Parkway Project, City Project No. 18-04, and extended the “Term of Services” of the Agreement to December 31, 2025.

The Design Phase of Quarry Lakes Parkway, Phase 2 (Gateway Site) is proceeding from the 65% Plans, Specification and Estimate (PS&E) to Final PS&E, scheduled for Summer 2026, with interim project milestone submittals of 95% PS&E by January 2026 and 100% PS&E by April 2026. The Design Phase of Quarry Lakes Parkway, Phase 1 (7th Street Connection) is currently at the 65% PS&E Phase, and an amendment to the Mark Thomas & Company contract will be brought to City Council for approval in December 2025 to Agenda Item No. 4.5

DISCUSSION

The Third Amendment to the Consulting Services Agreement with VSCE, Inc., in the requested amount of $647,000, if approved, will allow VSCE, Inc., to continue to provide Project Management Services for Quarry Lakes Parkway, Phases 1-2. If approved, this will bring the total contract amount to $1,530,100 and will extend the “Term of Services” in the Agreement to December 31, 2027.

FISCAL IMPACT
The Third Amendment to the Consulting Services Agreement with VSCE, Inc., in the amount of $647,000, will be funded with monies available in the Public Improvement Fund (Account Number 41691804-57115).
