Agenda Item No. 4.4
DATE: October 14, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Joan Malloy, City Manager
SUBJECT: Adopt A Resolution Authorizing the City Manager to Execute the First Amendment to the Consulting Services Agreement with Olberding Environmental, Inc. for the Design of a Habitat Mitigation and Monitoring Plan for the Quarry Lakes Parkway Project, City Project No. 18-04

EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution authorizing the City Manager to execute the First Amendment to the Consulting Services Agreement with Olberding Environmental, Inc., in the amount of $200,000, for a total contract amount of $274,500, for the design of a Habitat Mitigation and Monitoring Plan (HMMP) for the Quarry Lakes Parkway Project, City Project No. 18-04.

STRATEGIC PLAN ALIGNMENT
This agenda item is in alignment with the following:

Goal C, Strategy 2: Economic, Community Development and Public Safety – Facilitate the build-out of the greater Station District Area through the construction of the Quarry Lakes Parkway, completion of the pedestrian rail crossing, and implementation of the recommendations of the Southern Alameda County Regional Rail Integration Study to make the Station District a passenger rail hub served by ACE.

BACKGROUND
A transportation corridor (formerly Route 84 and the East West Connector) from Mission Boulevard (SR 238) to I-880 in the cities of Union City and Fremont was planned about 40 years ago. It was an identified project in the original 1986 Alameda County’s Measure B half-cent sales tax measure. For the past four decades, this transportation project was managed by Caltrans, various Alameda County transportation agencies, and, most recently, the Alameda County Transportation Commission (Alameda CTC).

Section 3.3, Biological Resources, in the 2009 approved Final Environmental Impact Report (EIR) of the East West Connector Project, the environmental impacts of the project and potential mitigation areas are addressed.

Agenda Item No. 4.4
City Council Staff Report Page 2 of 3 October 14, 2025
On March 22, 2018, the Alameda County Transportation Commission (Alameda CTC) approved the request from the City of Union City to be the project sponsor for the remaining phases of the I-880 to Mission Boulevard/East West Connector Project and to update the project description eligible for the remaining commitment from the 1986 Measure B Transportation Expenditure Plan to reflect the Quarry Lakes Parkway Project.

On February 12, 2019, the City Council adopted Resolution No. 5444-19, which authorized renaming the I-880 to Mission Boulevard/East West Connector Project to the Quarry Lakes Parkway Project. The Quarry Lakes Parkway, City Project No. 18-04, is funded with 1986 Measure B funds, 2014 Measure BB funds, and other transportation funds administered by Alameda CTC. The City Council has identified in the Strategic Plan Goal C, Strategy 2: Facilitate the build out of the greater Station District Area through the construction of the Quarry Lakes Parkway, completion of the pedestrian rail crossing, and implementation of the recommendations of the Southern Alameda County Regional Rail Integration Study to make the Station District a passenger rail hub served by ACE.

The City of Union City has accepted over $9.0 million from the Alameda CTC Project Funding Agreement (PFA) No. A22-0053 for the Final Design of Quarry Lakes Parkway, City Project No. 18-04, see Exhibit A for City Council Actions for the Project Funding.

The Quarry Lakes Parkway (QLP) Project is a new four-lane multimodal corridor, parallel to Decoto Road between Paseo Padre Parkway in Fremont and Mission Boulevard in Union City, and the Decoto Road “Compete Streets” Project is the modification of the existing four-lane Decoto Road to a transit priority and multimodal corridor between I-880 and Paseo Padre Parkway in Fremont, which the City of Fremont will implement.

QLP in Union City consists of:
 Phase 1: 7th Street Connection
 Phase 2: Gateway Connection
 Phase 3: 11th Street Connection
 Phase 4: Grade Separations and Alvarado-Niles Connection  Phase 5: Paseo Padre and Trail Connection, which is in both the cities of Union City and Fremont
Mark Thomas and Company, Inc. (Consultant) is the Engineering Consultant for this complex and challenging multimodal transportation project. See Exhibit B for City Council Actions for Mark Thomas & Company. The Consultant team and City staff held several technical meetings from 2022 to 2024 with the San Francisco Bay Regional Water Quality Control Board (RWQCB), Alameda County Water District (ACWD), and City of Fremont, reviewing and evaluating options for on-site mitigation improvements within Old Alameda Creek. The on-site mitigation options within Old Alameda Creek proved challenging to construct due to the expected high construction costs and the 10-year mitigation monitoring and maintenance costs, as well as the maintenance agreements with ACWD and the City of Fremont. Consequently, the Project Team and City staff concluded that off-site environmental mitigation is likely a more feasible and realistic option.

On March 25, 2025, the Consultant team and City staff held a technical meeting with San Francisco Bay Regional Water Quality Control Board (RWQCB) staff to provide an update on the challenges of on-site mitigation options, the project mitigation impact calculations, and the off-site mitigation concepts. See Exhibit C for Meeting Presentation. At the same Agenda Item No. 4.4

meeting with RWQCB, the off-site mitigation location identified was the Manning Ranch (part of Eagle Ridge Ranch) and the Livermore Valley Preserve areas managed by Oberling Environmental, Inc.

On April 2, 2025, the Consultant Team and City staff met with Olberding Environmental, Inc., to discuss the project off-site mitigation needs and to confirm if there was an available area within the Manning Ranch or Livermore Valley preserve for Quarry Lakes Parkway, City Project No. 18-04. Olberding Environmental, Inc., staff noted the RWQCB staff had recently visited the mitigation site to observe the habitat growth and natural development of the site.

On July 25, 2025, the City entered into a Consulting Services Agreement with Olberding Environmental, Inc., in the amount of $74,500, for the design of an Initial Conceptual Habitat Management and Mitigation Plan for Quarry Lakes Parkway, City Project No. 18-

04. DISCUSSION
The First Amendment to the Consulting Services Agreement, in the requested amount of $200,000, if approved, will allow Olberding Environmental, Inc. to proceed with the completion of the Manning Ranch Habitat Development Project, which is required for the environmental mitigation permits for Quarry Lakes Parkway, Phases 1-4, see Exhibit D - Manning Ranch Title Sheet. If approved, this will bring the total contract amount to $274,500 and will extend the “Term of Services” in the Agreement to December 31, 2027.

FISCAL IMPACT
The First Amendment to the Consulting Services Agreement with Olberding Environmental, Inc., in the amount of $200,000, will be funded with $100,000 available in the SB1 Fund (Account Number 25191804-57115) and $100,000 available in the Public Improvement Fund (Account Number 416091804-57115).

RECOMMENDATION
Staff recommends that the City Council adopt a resolution authorizing the City Manager to execute the First Amendment to the Consulting Services Agreement with Olberding Environmental, Inc., in the amount of $200,000, for a total contract amount of $274,500, for the design of a Habitat Mitigation and Monitoring Plan (HMMP) for the Quarry Lakes Parkway Project, City Project No. 18-04.
