Hi, Thai:

Please add to the the public record an additional written public comment:

The original hearing proposal for Use Permit (UP-25-001), Site Development Review (SD-25-001) - Southern Alameda County Buddhist Church, that was approved during the October 16 Public Hearing, included:

Staff Is Recommending This Project Be Considered Categorically Exempt from the California Environmental Quality Act (CEQA) under Section 15303, New Construction or Conversion of Small Structures, of the CEQA Guidelines
The exemption details are here:
https://govt.westlaw.com/calregs/Document/I8CE6FB435B4D11EC976B000D3A7C4BC3? viewType=FullText&originationContext=documenttoc&transitionType=CategoryPageItem&contextData= (sc.Default)&bhcp=1
The relevant sections to the exemption are:

Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The numbers of structures described in this section are the maximum allowable on any legal parcel. Examples of this exemption include but are not limited to:
(c) A store, motel, office, restaurant or similar structure not involving the use of significant amounts of hazardous substances, and not exceeding 2500 square feet in floor area. In urbanized areas, the exemption also applies to up to four such commercial buildings not exceeding 10,000 square feet in floor area on sites zoned for such use if not involving the use of significant amounts of hazardous substances where all necessary public services and facilities are available and the surrounding area is not environmentally sensitive.

Note, the proposed new Wireless Carrier Facility includes:
... Construction of a New 2,320 Square-Foot Roof-Mounted Enclosure and a 359 Square-Foot Equipment Ground-Mounted Enclosure.

So 2,320 + 359 = 2,679 sq. ft., is beyond and exceeds the 2500 sq. ft. allowed for an exemption. So the exemption would be invalid, and the Approval from October 16 should be revoked. Subsequent actions should include all required studies and reports as required by the California Environmental Quality Act, to ensure, as the California Governor's Office of Land Use and Climate Innovation states:
... public agencies to “look before they leap” and consider the environmental consequences of their discretionary actions.

Details of the CEQA are here:
https://lci.ca.gov/ceqa/
Thank you.
