AMENDMENT NO. 5 TO CONTRACT NO. 5774,
THE POST-RETIREMENT EMPLOYMENT AGREEMENT BETWEEN
THE CITY OF UNION CITY AND LOLA TAPIA
This Amendment No. 5 to Contract No. 5774, the Post-Retirement Employment Agreement (“Amendment”), is entered into this 25th day of November 2025, by and between the City of Union City (“City”) and Lola Tapia (“Lola Tapia” or “Annuitant”), collectively referred to as “Parties.”
RECITALS
WHEREAS, on August 10, 2021, the Parties entered into a Post-Retirement Employment Agreement, Contract No. 5774 (Exhibit No.1), for Ms. Tapia to serve as an extra help retired annuitant; and
WHEREAS, the Parties agreed to Amendment No. 1 to Contract No. 5774 (Exhibit No. 2), to extend the term of the Agreement and increase the salary rate in accordance with the then-current PEG salary table; and
WHEREAS, the City Council adopted Resolution No. 5989-22, on August 9, 2022, approving Amendment No. 1 to Contract No. 5774; and
WHEREAS, the Parties agreed to Amendment No. 2 to Contract No. 5774 (Exhibit No. 3), to extend the term of the Agreement and increase the salary rate in accordance with the then-current PEG salary table; and
WHEREAS, the City Council adopted Resolution No. 6057-22, on December 13, 2022, approving Amendment No. 2 to Contract No. 5774; and
WHEREAS, the Parties agreed to Amendment No. 3 to Contract No. 5774 (Exhibit No. 4), to extend the term of the Agreement and increase the salary rate in accordance with the then-current PEG salary table; and
WHEREAS, the City Council adopted Resolution No. 6219-23, on October 24, 2023, approving Amendment No. 3 to Contract No. 5774; and
WHEREAS, the Parties agreed to Amendment No. 4 to Contract No. 5774 to extend the term of the Agreement and to authorize future salary increases in accordance with Council approved increases to the Senior Accountant salary range; and WHEREAS, the City Council adopted Resolution No. 6396-24, on November 26, 2024, approving Amendment No. 4 to Contract No. 5774; and
WHEREAS, the Parties desire to amend the Agreement again to further extend the term of the Agreement; and

WHEREAS, the Parties agree that should the salary range for the position of Senior Accountant be changed during the period of January 1, 2026 through June 30, 2026, a commensurate change to the pay for Annuitant Lola Tapia will be made, without further Council action, so long as the pay remains within the publicly available salary schedule for the Senior Accountant position; and
WHEREAS, the Parties desire to enter into this Amendment No. 5 to Contract No. 5774, the Post-Retirement Employment Agreement with Lola Tapia.
NOW, THEREFORE, the Parties hereby agree as follows:
1. TERM. The term of this Agreement is hereby extended through and until June 30, 2026.
2. COMPENSATION. City shall pay Annuitant for her services hereunder as an extra help retired annuitant and Annuitant shall accept, as full and complete compensation for said services, the sum of Seventy Dollars and Eighteen Cents ($70.18) per hour, effective November 25, 2025. Annuitant shall receive no other payment, benefit, or remuneration other than the hourly wage for her services. There shall be no deductions from her wages for health insurance (including medical, dental, vision care, life or disability), or accrual of vacation leave, or any other similar benefits of whatever kind or nature.
3. FUTURE COMPENSATION. If at any time between January 1, 2026 and June 30, 2026, the salary range for Senior Accountant is changed by resolution of the City Council, the pay for Annuitant Lola Tapia will be changed commensurately effective the same date as the effective date of such change in the salary range for the Senior Accountant position.
IN WITNESS WHEREOF, the Parties hereto have caused this Amendment No. 5 to Contract No. 5774, the Post-Retirement Employment Agreement with Lola Tapia, to be executed on the dates hereinafter respectively set forth.
