RESOLUTION NO. 2025-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY APPROVING AMENDMENT NO. 5 TO CONTRACT NO. 5774, THE
POST-RETIREMENT EMPLOYMENT AGREEMENT WITH RETIRED
ANNUITANT LOLA TAPIA, TO EXTEND THE AGREEMENT THROUGH
JUNE 30, 2026, FOR A NOT-TO-EXCEED AMOUNT OF $30,000
WHEREAS, Lola Tapia retired from the City of Union City in the position of Senior Accountant on July 15, 2021; and
WHEREAS, on August 10, 2021, the City Council adopted Resolution No. 5818- 21, appointing Lola Tapia as an extra help retired annuitant to perform the duties of the Extra Help Senior Accountant for the City of Union City under Government Code Section 21224, effective August 11, 2021; and
WHEREAS, the Parties agreed to Amendment No. 1 to Contract No. 5774, to extend the term of the Agreement and increase the salary rate in accordance with the then-current PEG salary table; and
WHEREAS, the City Council adopted Resolution No. 5989-22, on August 9, 2022, approving Amendment No. 1 to Contract No. 5774; and
WHEREAS, the Parties agreed to Amendment No. 2 to Contract No. 5774, to extend the term of the Agreement and increase the salary rate in accordance with the then-current PEG salary table; and
WHEREAS, the City Council adopted Resolution No. 6057-22, on December 13, 2022, approving Amendment No. 2 to Contract No. 5774; and WHEREAS, the Parties agreed to Amendment No. 3 to Contract No. 5774 to extend the term of the Agreement and increase the salary rate in accordance with the then-current PEG salary table; and
WHEREAS, the City Council adopted Resolution No. 6219-23 on October 24, 2023, approving Amendment No. 3 to Contract No. 5774; and WHEREAS, the Parties agreed to Amendment No. 4 to Contract No. 5774 to extend the term of the Agreement and to authorize future salary increases in accordance with Council-approved increases to the Senior Accountant salary range; and WHEREAS, the City Council adopted Resolution No. 6396-24, on November 26, 2024, approving Amendment No. 4 to Contract No. 5774; and WHEREAS, the Parties desire to amend the Agreement again to extend the term of the Agreement further; and
WHEREAS, the City desires to extend the term of said appointment through June 30, 2026, to allow Ms. Tapia to continue to assist with special projects and the implementation of the Tyler Munis ERP; and

WHEREAS, this Amendment No. 5 (Attachment No. 1) to Contract No. 5774, the Post-Retirement Employment Agreement between Lola Tapia and the City of Union City, has been reviewed by this body and is attached herein; and WHEREAS, the continued employment shall be limited to 960 hours per fiscal year for all CalPERS employers for which retired annuitant Lola Tapia may work; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties as listed on a publicly available pay schedule, divided by 173.333 to equal the hourly rate; and
WHEREAS, the minimum base salary for this position, or its equivalent, is $10,010 per month, and the hourly equivalent is $57.75, and the maximum base salary for this position, or its equivalent, is $12,164 per month, and the hourly equivalent is $70.18; and WHEREAS, the hourly rate paid to Lola Tapia is currently $70.18; and WHEREAS, Lola Tapia has not and will not receive any other benefit, incentive, compensation in lieu of benefit, or other form of compensation in addition to this hourly pay rate; and
WHEREAS, the Parties agree that should the salary range for the position of Senior Accountant be changed from January 1, 2026, through June 30, 2026, a commensurate change to the pay for retired annuitant Lola Tapia will be made, without further Council action, so long as the pay remains within the publicly available salary schedule for the Senior Accountant position.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Union City hereby approves Amendment No. 5 to Contract No. 5774, the Post-Retirement Employment Agreement with Lola Tapia, extending the term through June 30, 2026, for a not-to-exceed amount of $30,000.
