A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY APPROVING AMENDMENT NO. 1 TO THE POST-RETIREMENT
EMPLOYMENT AGREEMENT WITH RETIRED ANNUITANT ANITA
CASTILLO TO EXTEND THE AGREEMENT THROUGH JUNE 30, 2026, FOR A NOT-TO-EXCEED AMOUNT OF $35,000
WHEREAS, Anita Castillo retired from the City of Union City in the position of Budget Manager on February 4, 2024; and
WHEREAS, on February 13, 2024, the City Council adopted Resolution No. 6257- 24, approving an exception to the 180-day waiting period for post-retirement employment and appointing Anita Castillo as an extra help retired annuitant to perform the duties of the Extra Help Budget Manager for the City of Union City under Government Code Section 21224, effective February 14, 2024; and
WHEREAS, the Parties desire to amend the Agreement to extend the term of the Agreement; and
WHEREAS, the City desires to extend the term of said appointment through June 30, 2026, to allow Ms. Castillo to continue to assist with special projects and the implementation of the Tyler Munis ERP; and
WHEREAS, this Amendment No. 1 (Attachment No. 1) to the Post-Retirement Employment Agreement between Anita Castillo and the City of Union City has been reviewed by this body and is attached herein; and
WHEREAS, the continued employment shall be limited to 960 hours per fiscal year for all CalPERS employers for which retired annuitant Anita Castillo may work; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties as listed on a publicly available pay schedule, divided by 173.333 to equal the hourly rate; and
WHEREAS, the minimum base salary for this position, or its equivalent, is $12,846 per month, and the hourly equivalent is $74.11, and the maximum base salary for this position, or its equivalent, is $15,388 per month, and the hourly equivalent is $88.78; and WHEREAS, the hourly rate paid to Anita Castillo will be $88.78, effective August 18, 2025; and
WHEREAS, Anita Castillo has not and will not receive any other benefit, incentive, compensation in lieu of benefit, or other form of compensation in addition to this hourly pay rate; and

WHEREAS, the Parties agree that should the salary range for the position of Budget Manager be changed from January 1, 2026, through June 30, 2026, a commensurate change to the pay for retired annuitant Anita Castillo will be made, without further Council action, so long as the pay remains within the publicly available salary schedule for the Accounting Manager position.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Union City hereby approves Amendment No. 1 to the Post-Retirement Employment Agreement with Anita Castillo, extending the term through June 30, 2026, for a not-toexceed amount of $35,000.
