BACKGROUND
Since the early 2000s, the vision of the Union City Intermodal Station Project has been to Agenda Item No. 3.10

The completion of the at-grade pedestrian crossing will finally convert the BART Station into a two-sided station by constructing a new concrete walkway across the existing Union Pacific Railroad (UPRR) Oakland Subdivision tracks to connect BART with the public East Plaza in the Station District Area.
On May 9, 2019, the City entered into a Consulting Services Agreement with Rail Surveyors and Engineers, Inc. (C5320), in the amount of $40,000, to provide engineering design services for specific components of the At-Grade Pedestrian Crossing at BART Project, City Project No. 14-14 (“Project”).
On July 9, 2019, the City Council adopted Resolution No. 5503-19, authorizing the City Manager to execute the “Public At-Grade Pedestrian Crossing Agreement: BART Pedestrian Crossing with Union Pacific Railroad (“UPRR”) (C5376), for the BART Pedestrian Crossing (DOT 859611R) at the Oakland Subdivision (Mile Post 27.08), City of Union City, Alameda County, California, (Public At-Grade Crossing Permit), UP Real Estate Folder No: 3055-45 (“Original Agreement”), in the amount of $288,200, for the AtGrade Pedestrian Crossing at BART Project, City Project No. 14-14.
In order to open the new At-Grade Pedestrian Crossing at BART Project, City Project No. 14-14, which is currently under construction, the City is required by the California Public Utility Commission (CPUC) and Union Pacific Railroad Company (UPRR) to implement various railroad-related improvements, including making safety improvements at the existing Decoto Road railroad crossing at the Oakland Subdivision tracks and permanently closing the I Street at-grade railroad crossing between 11th Street and 12th Street on the Oakland Subdivision tracks (see Attachment 1).

On December 13, 2022, the City Council adopted Resolution No. 6053-22, authorizing the City Manager to execute the Second Amendment to the Consulting Services Agreement with RSE (C5850b), in the amount of $75,000, for a total not-to-exceed contract amount of $175,000, to provide engineering design services in support of the Decoto Road railroad crossing safety improvements.
On April 23, 2024, the City Council adopted Resolution No. 6287-24, authorizing the City Manager to execute the Third Amendment to the Consulting Services Agreement with RSE (C5850c), in the amount of $250,000, for a total not-to-exceed contract amount of $425,000, to continue providing engineering services for the Decoto Road railroad crossing safety improvements, including incorporating and responding to UPRR’s review comments to complete the final Track Plan, Profile and Details, the Decoto Road Plan, Profile and Details, and the traffic signal railroad crossing and preemption/interconnect Agenda Item No. 3.10

DISCUSSION
RSE is preparing the Final Design for the Decoto Road Railroad Crossing (Oakland Subdivision) which is a component (Phase II) of the At-Grade Pedestrian Crossing at BART Project, City Project No. 14-14, which is currently under construction.
The Phase II project requires railroad-related safety improvements along the Oakland Subdivision tracks including new railroad safety gates and signals, new sidewalks and railroad preemption.
The second component of this Phase II project consists of making required changes for the permanent closure of I Street.
The Fourth Amendment to the Consulting Services Agreement with RSE, in the amount of $199,200, for a total not-to-exceed contract amount of $624,200, will allow the consultant to continue providing engineering services for the Decoto Road railroad crossing (Oakland Subdivision) safety improvements. The consultant’s tasks will include Project Management, Final Design, Traffic Signal Programming (Preemption related) and preparation of plans, specifications and estimates (PS&E), which will allow the Phase II project to go to bid. The scope also includes bid and design support during construction and preparation of As-Built plans at the completion of construction.
FISCAL IMPACT
The Fourth Amendment to the Consulting Services Agreement with Rail Surveyors and Engineers, Inc., in the amount of $199,200, will be funded with $99,200 from the Public Improvements Fund (Account Number 41691414-57115) and $100,000 from the DIPSA Development Fund (Account Number 26691414-57115), as identified in the approved Five-Year Capital Improvement Plan (CIP) for Fiscal Year 2025-2026 to Fiscal Year 2029- 2030.
