Staff Report
Agenda Item No. 3.5
DATE: December 9, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Joan Malloy, City Manager
SUBJECT: Adopt a Resolution Authorizing the City Manager to Enter into a Consulting Services Agreement with Workforce Integrity and Training Solutions (WITS), for an Amount Not to Exceed $100,000, Through June 30, 2027, to Support the Compliance and
Coordination of the Community Workforce Agreement (CWA)
EXECUTIVE SUMMARY
The City Council places a high priority on the use of skilled labor to achieve quality construction outcomes for City projects, as well as on supporting programs that recruit, train, and employ local area residents. As a result of this priority, the City entered into a Community Workforce Agreement (“CWA”) with the Building and Construction Trades Council of Alameda County, attached as Attachment 1.
Staff now recommends that the City Council adopt the attached resolution to authorize the City Manager to enter into a consulting services agreement with Workforce Integrity and Training Solutions (“WITS”) for an amount not to exceed $100,000, through June 30, 2027, to support compliance and coordination under the CWA.
STRATEGIC PLAN ALIGNMENT
There is no direct alignment with the Strategic Plan.
BACKGROUND
On August 12, 2025, the City Council adopted Resolution No. 2025-120 authorizing the City Manager to enter into a CWA with the Building and Construction Trades Council of Alameda County for construction projects funded and directed by the City of Union City.
The CWA applies to all City construction contracts exceeding $1,000,000 in value. As a next step in the process, staff is seeking authorization to engage the professional services of WITS to support the administration of the CWA.
Agenda Item No. 3.5
City Council Staff Report Page 2 of 2 December 9, 2025 3 0 DISCUSSION
WITS will support the City in establishing, implementing, and maintaining the CWA strategy and program (see Attachment 2). WITS will provide evaluation and recommendations on bid documents to ensure compliance with the CWA. They will also aid in evaluating solicitations, labor relations, workforce development, supportive services, and all other CWA requests as needed.
Established in 2019, WITS has assembled a team of labor relations, labor compliance, and local hire consultants. WITS has a strong record of working with public agencies and companies throughout the Bay Area to coordinate CWAs and other labor matters, including (partial list) the cities of Pittsburg, Concord, and Dublin; the school districts of Antioch, Martinez, and Pittsburg; and companies such as Chevron and Mott MacDonald.
FISCAL IMPACT
Funding for this agreement was included in the FY 2025-2026 and FY 2026-2027 Adopted Biennial Budget in Account Number 11033001-54110 (General Fund - Public Works/Administration - Professional/Consulting).
While the General Fund includes a budget for contract administration, whenever possible, the cost of administering the CWA will be incorporated into construction contracts to minimize the direct impact on the General Fund.
RECOMMENDATION
Staff recommends that the City Council adopt the attached resolution authorizing the City Manager to enter into a consulting services agreement with Workforce Integrity and Training Solutions (WITS) for an amount not to exceed $100,000, through June 30, 2027, to support compliance and coordination under the Community Workforce Agreement (CWA).
