SUBJECT: Adopt a Resolution Approving the Award of a Construction Contract to G. Bortolotto & Company, Inc., in the Amount of $1,992,760, and Approving a Total Construction Budget in the Amount of $2,391,312, for the Annual Citywide Pavement Rehab Project, City Project No. 25-01
EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution approving the award of a construction contract to G. Bortolotto & Company, Inc., in the amount of $1,992,760, and approving a total construction budget, in the amount of $2,391,312, for the Annual Citywide Pavement Rehab Project, City Project No. 25-01.
STRATEGIC PLAN ALIGNMENT
This agenda item is aligned with the following City Council priority:
Goal D: Environmental Sustainability and Infrastructure Strategy 2: Implement the City’s capital improvement plan.
BACKGROUND
The Metropolitan Transportation Commission (MTC) uses federal funds to establish the Pavement Management Technical Assistance Program (P-TAP) to assist Bay Area cities and counties to optimize their roadway maintenance programs by: 1) implementing, updating and maintaining pavement management databases; 2) providing accurate pavement condition data to city councils, county supervisors or local decision makers; and, 3) supporting the region’s management of non-pavement street and road assets such as signs, storm drains, curbs and gutters, traffic signals and street lights, as pilot projects.
The P-TAP Program includes the preparation of Pavement Management Program (PMP) reports which identify the conditions of the local streets and roadway pavement surfaces and measure the condition by a Pavement Condition Index (PCI) with the following breakdown: Excellent (PCI = 90-100); Very Good (PCI = 80-89); Good (PCI = 70-79); Fair (PCI = 60-69); At-Risk (PCI = 50-59); and, Poor (PCI = 25-49). For a majority of the past decade-plus, Union City’s pavement condition was measured as either Very Good (PCI = 80-89) or Good (PCI = 70-79).

However, the 2022 PMP Report, dated March 2023, reported a decline in the City’s overall PCI rating to Fair, with a PCI of 69, and noted this fair condition with moderate deterioration of the City’s major corridors and residential streets. This pavement rating downgrade is attributable to a combination of factors, including the City’s 2019 cyberattack, the worldwide COVID-19 pandemic, staffing shortages, and recent major utility construction projects along Decoto Road and Alvarado-Niles Road. The combination of these factors rendered Public Works unable to prepare and manage pavement rehabilitation projects on a regular basis.
DISCUSSION
On February 25, 2025, the City Council adopted Resolution No. 2025-024 to accept a $75,000 grant from the California Department of Resources, Recycling and Recovery, Project Funding Agreement No. TRP14-21-0007, for the Annual Citywide Pavement Rehab Project, City Project No. 25-01. These supplemental project funds will be used to extend the life of streets using rubberized chip seal, a newer method of street paving (also called a rubberized cape seal).
As part of the pavement maintenance program, the Annual Citywide Pavement Rehab Project, City Project No. 25-01, will improve over 104,503 square yards of roadway area throughout the City (see Exhibit B). This improvement will incorporate three methods of street surface treatment: overlay, rubberized cape seal, and slurry seal. In addition to street surface improvements, the contractor will also restripe high visibility crosswalks and lane lines, repair damaged curbs and gutters, upgrade curb ramps, and adjust utility covers to-grade.
Public Works advertised the project for bidding on October 23, 2025, with the release of a Notice Inviting Bids for the Citywide Street Pavement Rehabilitation Project, City Project No. 25-01 (see Attachment 2). During this off-peak construction period, but within a competitive bidding environment, the City received eleven bids, which were publicly opened on November 12, 2025 (see Exhibit A).
The apparent low base bid of $1,953,459 was submitted by Frontline General Engineering Construction, Inc., of San Lorenzo, California. Following a detailed review, staff determined that the bid was non-responsive because it did not include an executed copy of Addendum No. 1, which was a required component of the bid submission.
Consequently, the next lowest bidder, G. Bortolotto & Company, Inc., of San Carlos, California, is considered the lowest responsive and responsible bidder with a bid of $1,992,760.
The second-lowest bid is approximately 20% below the Engineer’s Estimate of $2,503,555, which is largely attributable to the off-peak construction period. The eleven bids received demonstrate a competitive bidding process, with the two lowest bids falling within 5% percent of each other.
G. Bortolotto & Company, Inc., has performed satisfactory work for the City in the past, including the Dyer Street Rehabilitation Project, City Project No. 18-20, and the Citywide Street Rehabilitation Project, City Project No. 23-01.

The recommended project budget for construction is as follows:
Construction Contract Amount (including Alternative Bids) $1,992,760 Contingency – 15% of Construction Contract $298,914
Construction Engineering (Project Management, Materials Testing, Inspection) – 5% of Construction Contract $99,638
Total Estimated Construction Cost $2,391,312
Construction of this project is anticipated to begin in Spring 2026 and to be completed in Summer of 2026.
FISCAL IMPACT
The Annual Citywide Pavement Rehab Project, City Project No. 25-01, in the amount of $2,391,312, will be funded with the following approved and budgeted funds: $75,000 of California Department of Resources, Recycling and Recovery grant funds in the Capital Projects Grants Fund (Fund 410), $700,000 in the SB 1 Road Maintenance & Rehabilitation Fund (Fund 251), $278,000 in the Traffic Congestion Relief Fund (Fund 252), $800,000 in the Solid Waste Street Restoration Fund (Fund 262), and $538,312 in the Measure BB (2014) Fund (Fund 264), as represented in the table below:
